Net VR Theater
1. Introduction
Please read these Terms of Service carefully and thoroughly. Welcome to Net VR Theater, a virtual reality social platform for gamers and content creators. Net VR Theater is an application created by The Net VR LLC. This agreement covers Net VR Theater and any related software applications, services, and products offered by The Net VR (“The Net VR Services”).
When using, browsing, or signing up for The Net VR application, you will be subject to The Net VR’s Privacy Disclosure and these specific Terms of Service for Net VR Theater. You agree that by clicking “Submit” on the application, you are entering a binding agreement in regards to your use of The Net VR Theater. By using The Net VR Services, you hereby acknowledge that you have read and understood both our Terms of Service and Privacy Disclosure and agree to be bound by them. If, at any time, you do not agree with these Terms of Service, please terminate your use of The Net VR Theater.
2. Privacy Disclosure
Your privacy is very important to us. Please read our Privacy Disclosure for more information on how we collect and use your personal data.
3. Use of The Net VR Services by Minors and Blocked Persons
The Net VR Services are not available to persons under the age of 13. If you are between the ages of 13 and the age of legal majority in your jurisdiction of residence, you may only use The Net VR Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Service.
The Net VR Services are also not available to any users previously removed from the Net VR Services by The Net VR LLC or to any persons barred from receiving them under the laws of the United States (such as its export and re-export restrictions and regulations) or applicable laws in any other jurisdiction.
BY DOWNLOADING, INSTALLING, OR OTHERWISE USING THE NET VR SERVICES, YOU REPRESENT THAT YOU ARE AT LEAST 13 YEARS OF AGE, THAT YOUR PARENT OR LEGAL GUARDIAN AGREES TO BE BOUND BY THESE TERMS OF SERVICE IF YOU ARE BETWEEN 13 AND THE AGE OF LEGAL MAJORITY IN YOUR JURISDICTION OF RESIDENCE, AND THAT YOU HAVE NOT BEEN PREVIOUSLY REMOVED FROM AND ARE NOT PROHIBITED FROM RECEIVING THE NET VR SERVICES.
4. Modification of these Terms of Service
The Net VR LLC may amend any of the terms of these Terms of Service by posting the amended terms. Your continued use of The Net VR Services after the effective date of the revised Terms of Service constitutes your acceptance of the terms.
5. License
The Net VR Theater is owned and operated by The Net VR LLC. Unless otherwise indicated, all content on The Net VR Services (excluding User Content, set out in Section 7 below), including, but not limited to, logos, graphics, design, software, code, pictures, services, data, and other files (“Materials”, collectively) are property of The Net VR and are protected by proprietary rights and laws. By agreeing to these Terms of Service, you will be permitted a personal and limited right to access and use The Net VR Services.
This license does not allow any of the following: (a) resale of The Net VR Services and/or Materials; (b) distribution of any Materials; (c) modification of The Net VR Services and/or Materials; (d) use of data mining or similar practices; (e) downloading any of The Net VR Services and/or Materials, unless authorized by The Net VR to do so; or (f) any use of The Net VR Services and/or Materials except for their intended purposes. Without the written permission from The Net VR, any use of The Net VR Services and/or Materials except as stated in these Terms of Service is prohibited and may be a direct violation of property rights and other laws.
6. Account
To create an account download the application at https://www.thenetvr.com, you will be asked to provide a username, email, and password. This information is solely your responsibility to keep confidential and accurate. If you choose to use an alternate service The Net VR will use the information provided from partner services.
7. User Content
The Net VR allows users to share live streams, to use services such as live chat, and to participate in other features where you may stream, record, chat, and store content on The Net VR Services (“User Content”). You agree that you are the creator of or otherwise have sufficient rights to the User Content and that it does not breach the code of conduct. You may not stream or store any content that violates the code of conduct. All content is uploaded at your own risk and you are responsible for it, including the consequences, should you violate any rules.
Unless otherwise agreed to in a written agreement between you and The Net VR LLC, if you submit, transmit, display, perform, post, or store User Content using the The Net VR Services, you grant The Net VR LLC an unrestricted, worldwide, irrevocable, fully sub-licenseable, nonexclusive, and royalty-free right to: (a) use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (including without limitation for promoting and redistributing part or all of the The Net VR Services); and (b) use the name, identity, likeness, and voice (or other biographical information) that you submit in connection with such User Content. Should such User Content contain the name, identity, likeness, and voice (or other biographical information) of third parties, you represent and warrant that you have obtained the appropriate consents and/or licenses for your use of such features and that The Net VR LLC is allowed to use them to the extent indicated in these Terms of Service.
8. Code of Conduct
When using The Net VR Theater, you agree that you will abide by these Terms of Service. You are solely responsible for your conduct and you agree not to violate any laws or rules in your area. The following is strictly prohibited:

Hate Speech and Racism
Impersonation
Terrorism
Solicitation
Violence
Illegal Activity
Self-destructive Behavior
Malicious Conduct
Cheating
Violations of Intellectual Property Rights
Unauthorized Sharing of Private Information
Additionally, you will not stream or share content that you do not have the rights for, content that is illicit, infringing, defamatory, abusive, invasive of privacy, pornographic, or threatening.
You will not use The Net VR Services while operating a vehicle. Live streaming in a vehicle is permitted only if the passenger is in control of the stream and the driver is completely hands free.
To the extent permitted by applicable law, The Net VR LLC takes no responsibility and assumes no liability for any User Content or for any loss or damage resulting therefrom, nor is The Net VR LLC liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity you may encounter when using The Net VR Services. Your use of The Net VR Services is at your own risk. In addition, these rules do not create any private right of action on the part of any third party or any reasonable expectation that The Net VR Services will not contain any content that is prohibited by such rules.
The Net VR LLC is not liable for any statements or representations included in User Content. The Net VR LLC does not endorse any User Content, opinion, recommendation, or advice expressed therein, and The Net VR LLC expressly disclaims any and all liability in connection with User Content. To the fullest extent permitted by applicable law, The Net VR LLC reserves the right to remove, screen, or edit any User Content posted or stored on The Net VR Services at any time and without notice, including where such User Content violates these Terms of Service or applicable law, and you are solely responsible for creating backup copies of and replacing any User Content you post or store on The Net VR Services at your sole cost and expense.
If you violate these Terms of Service when using The Net VR Services, your account and rights to any of The Net VR Services may be suspended or terminated. Please see our Tier System.
9. Trademarks
The Net VR and its logo, slogan, and any other products or services used by The Net VR, including graphics, design, and icons, are trademarks of The Net VR and are not to be used in relation with any product or service that does not belong to The Net VR.
10. In-Game Currency
Net VR Theater uses an in-game currency called Lux, which can be purchased with real monetary value, and an in-game currency called Rays, which can be earned through participating in the Net VR Theater. Both Lux and Rays (collectively “Digital Currency”) hold no real dollar value (i.e., is not cash or equivalent) and cannot be exchanged or sold for any monetary value at any time. Except as required by applicable law in your jurisdiction, Digital Currency is non-refundable. The sole use of Digital Currency in the Net VR Theater is to make in-game purchases, including but not limited to avatars, clothing, display items, theater upgrades, and user actions. The Net VR LLC reserves the right to change and update our inventory of in-game purchases without notice. Any Digital Currency traded on a third party market for anything of value (money, goods, or services) outside of The Net VR Theater is considered a Terms of Service violation and all Digital Currency may be immediately seized and participating accounts suspended. Users who violate these Terms of Service may be held liable for all damages caused by the sale of Digital Currency and are subject to legal arbitration. Except as required by applicable law, any unused Digital Currency will be forfeited to The Net VR LLC upon termination of your account.
11. Content Creator Licensing
The Net VR LLC may, at any time, partner with a verified third party (“Content Creator”) to offer in-game purchases containing a logo, likeness, and/or design (“Creator Brand”) owned by that Content Creator. In exchange for the license to use and sell the Creator Brand, The Net VR LLC will enter a profit sharing agreement with the Content Creator. When Digital Currency is used in The Net VR Theater to purchase an item utilizing the Creator Brand, The Net VR LLC will share the net profit generated from the sale with the Content Creator. Nothing in this agreement guarantees a payment to the Content Creator. The Content Creator maintains their ownership of the Creator Brand at all times, and may terminate the profit sharing agreement at any time. The Content Creators must comply with all contracts agreed upon by partners of The Net VR LLC; additional information can be obtained through thenetvr.com.
