END USERS LICENCE AGREEMENT
TIDEWOKEN (“GAME” or “product”) is an online computer game developed by ALFRED HROMAS.
Please read the following terms and conditions carefully before playing TIDEWOKEN. Your use, distribution or installation of this copy of “TIDEWOKEN” indicates your acceptance of this License.
PLEASE READ THIS END USER LICENSE AGREEMENT (THIS “EULA” OR “LICENSE AGREEMENT”) CAREFULLY. BY INSTALLING, DOWNLOADING, COPYING, ACCESSING OR USING THE GAME, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, YOU MUST NOT CONTINUE TO INSTALL, DOWNLOAD, COPY, ACCESS OR USE THE GAME.
THE TERMS OF THIS AGREEMENT MAY BE AMENDED, SUPPLEMENTED, OR MODIFIED AT ANY TIME BY ITS OWNER IN ITS SOLE DISCRETION, INCLUDING, WITHOUT LIMITATION.
This product is for personal use only and may be installed and used by on only one computer. All components accompanying the software are copyrighted by ALFRED HROMAS and may not be taken apart, modified, used or published with other software or means except with the GAME software and may not be distributed or copied in any manner.
This GAME, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
I no event shall ALFRED HROMAS, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of the GAME. This GAME and all services provided may be used for lawful purposes only.
When performing the purchase of the in-game currency you agree to follow the payment instructions related to the payment order and methods.
For policies and procedures of the payment systems used to purchase in-game content and currency, the User shall contact the Payment Partner. ALFRED HROMAS does not make any explanations to the User regarding the rules and procedures of such payments in STEAM, and also does not make any money compensations to the User that performed funds transfer operations to purchases using STEAM payment services.
If the Game detects the use of an unauthorized third party program (“Hack”, “Cheat”, “Modification”, “Trainer”, “Mod”), your access to the Game may be terminated with or without additional notice to you.
This Agreement represents the complete agreement between you ALFRED HROMAS with respect to the subject matter hereof, and supersedes any prior or contemporaneous agreements between you and ALFRED HROMAS; provided however that this License Agreement shall coexist with, and shall not supersede, the Terms of Use or the Privacy Policy. To the extent that the provisions of this License Agreement conflict with the Terms of Use, the conflicting provisions in the Terms of Use shall govern. This Agreement shall be governed by the laws of AUSTRIA. Those who choose to access the Game from locations outside AUSTRIA do so on their own initiative and are responsible for compliance with applicable local laws. If this Agreement is held to be invalid or unenforceable for any reason, such provision shall be reformed to the extent necessary to make it enforceable to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.
This GAME and all of its derivatives, title and accompanying materials are the exclusive property of ALFRED HROMAS. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by ALFRED HROMAS. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this GAME.
If the GAME was provided to you for trial use (“Alpha”, “Beta”, “Demo”) for a limited period of time and/or number of uses, you agree not to use the GAME beyond the expiration or termination of the trial period
ALFRED HROMAS may provide updates and modifications to the Game that must be installed for you to continue to use the GAME. Provided updates and modifications subject to this Agreement.
You may terminate this EULA at any time by uninstalling the GAME and destroying all copies of the GAME in your possession or control. ALFRED HROMAS may terminate this EULA immediately upon notice to you if you breach any of its terms or conditions. Upon termination of this EULA, you agree to immediately uninstall the Game and destroy all copies of the Game.
You and ALFRED HROMAS agree to negotiate any Dispute informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiation commence upon written notice from one person to the other. This Dispute shall be forwarded to support@tidewoken.com.
