This EULA constitutes a legal agreement between you and Prisms of Reality Inc. and governs your use of Pandemic (“the Software”). If you do not agree to all the terms and conditions of this EULA, click on the “DO NOT AGREE” button which indicates that you will not complete the installation of the Software.

(C) YOU ARE AUTHORIZED AND ABLE TO ACCEPT THIS EULA.
YOUR USE OF THE SOFTWARE IS ALSO SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THE OCULUS TERMS OF SERVICE, THE STEAM™ SUBSCRIBER AGREEMENT, AND/OR ANY OTHER TERMS SET FORTH BY VALVE CORPORATION AND/OR PRISMS OF REALITY INC. IN RELATION TO THE SOFTWARE SERVICE.
1.1 License Grant
We hereby grant you a non-exclusive, revocable, non-transferrable, and limited right to license one copy of the Software for your personal, non-commercial use.
We retain exclusive rights for any and all of any and all State, Federal, and International intellectual property and proprietary rights in and to and all copies of the Software, including without limitation all copyrights, inventions, trademark rights, trade secret rights, trade dress rights, and any and all other intellectual property and proprietary rights embodied in or derived from the Software. We prohibit the copying, reproduction, and circumvention of technology of the Software beyond the terms of this license. Your continued legal use of the Software is contingent upon your compliance with this EULA and the License Terms set forth below.
1.2 License Terms
Continued use of the Software is contingent upon your compliance with the following:
You represent that you are an adult in your country of residence, or you are at least thirteen (13) years old. You agree to this End User License Agreement on behalf of yourself and, at your discretion, for one (1) minor child for whom you are a parent or guardian and whom you have authorized to play the Software using the license granted to you;
You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, adapt, translate, sublicense, auction, rent, lease or sell all or any part of the Software. In addition, you may not hack, emulate, reverse engineer, decompile, or disassemble any part of the Software. All rights not expressly granted are reserved by us. You agree that you have no interest, monetary or otherwise, in any feature, content, or Intellectual Property contained in the Software.
All title, ownership rights and intellectual property rights in and to the Software, its service and all copies thereof (including, without limitation, any titles, source code, themes, objects, characters, character names, stories, dialog, catch phrases, user translated in-game texts, locations, concepts, artwork, structural or landscape designs, animations, sounds, audio-visual effects, storylines, character likenesses, methods of operation, and any related documentation) are owned by Prisms Of Reality Inc. The Software is protected by the copyright laws of all countries, international copyright treaties and conventions, and other laws. All rights are asserted and reserved.
As part of our early access release, we will collect anonymous, non-personally identifiable information (i.e. information which neither identifies you nor is linked to, associated with or capable of being used to identify, you) about how you are using the Software. The information we collect is limited to the server logs that record user activity during the learning experience in our modules. This information is only used to help us better understand how our customers are using the Software, their behaviour and preferences, so as to make improvements to our Software that will improve its design and enhance the user learning experience. No other users or third parties will be able to access this data.
This information will be collected, stored, retrieved and used in accordance with Prisms of Reality Inc.’s latest Privacy Policy, which is located at: https://www.prismsvr.com/privacy.
By clicking the Accept button you unconditionally and irrevocably agree to the terms of the Privacy Policy.
This EULA is effective until terminated. You may terminate this EULA at any time by uninstalling the Software. PRISMS OF REALITY may terminate this EULA immediately upon notice to you if you breach any of its terms or conditions, including if:
you breach any provision of this EULA
you infringe any intellectual property rights
you violate the Oculus Terms of Service, the STEAM Subscriber Agreement, and/or other agreements by Valve Corporation and/or Prisms OF Reality. that you consented to play the Game.
Upon termination of this EULA,
you will immediately discontinue use of the Software
all rights granted to you under this EULA will immediately terminate
you will promptly delete all installed copies of the Software
Any fees associated with your use of the Software and are payable in advance and not refundable in whole or in part.
THIS IS AN EARLY ACCESS RELEASE OF OUR SOFTWARE IN BETA VERSION. AS SUCH, TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND ALL INFORMATION, CONTENT AND SERVICES CONTAINED THEREIN ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PRISMS OF REALITY INC. EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES THAT THE GAME WILL BE UNINTERRUPTED OR ERROR FREE. USE OF THE GAME IS AT YOUR SOLE RISK.
You agree to indemnify, defend and hold harmless Prisms of Reality Inc., its partners, affiliates, contractors, licensors, officers, directors, employees and agents from all claims, damages, costs and expenses (including reasonable legal fees) arising directly or indirectly from your acts of omissions in connection with using the Software Product or any breach by you of the terms of this EULA.
YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING EULA AND THAT BY CLICKING “I AGREE” AND/OR INSTALLING THE SOFTWARE, YOU ARE ACKNOWLEDGING YOUR AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA.

4. TERMINATION

5. WARRANTY DISCLAIMER

6. INDEMNITY
You agree to indemnify, defend and hold harmless Prisms of Reality Inc., its partners, affiliates, contractors, licensors, officers, directors, employees and agents from all claims, damages, costs and expenses (including reasonable legal fees) arising directly or indirectly from your acts of omissions in connection with using the Software Product or any breach by you of the terms of this EULA.
