END USERS LICENCE AGREEMENT
1. Limited Use License
Please read the following terms and conditions carefully before using this Fractal Block World. Your use, distribution or installation of this copy of "Fractal Block World" indicates your acceptance of this License.
Fractal Block World here means Software, image files, all accompanying files, data and materials received with your order of "Fractal Block World".
You are not receiving any ownership or proprietary right, title, or interest in or to the Software or the copyrights, trademarks, or other rights related thereto.
You agree that the Software will not be downloaded, shipped, transferred, exported or re-exported into any country in violation of the United States Export Administration Act (or any other law governing such matters) by you or anyone at your direction, and that you will not utilize and will not authorize anyone to utilize the Software in any other manner in violation of any applicable law. The Software shall not be downloaded or otherwise exported or re-exported into (or to a national or resident of) any country to which the United States has embargoed goods, or to anyone or into any country who/that are prohibited, by applicable law, from receiving such property. In exercising your limited rights hereunder, you shall comply at all times with all applicable laws, regulations, ordinances, and statutes.
All components accompanying the software are copyrighted by Dan Hathaway and may not be taken apart, modified, used or published with other software or means except with the Fractal Block World software and may not be distributed or copied in any manner.
This Fractal Block World, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
Any liability of Fractal Block Team will be limited exclusively to refund of purchase price. In addition, in no event shall Fractal Block Team, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of Fractal Block World.
In addition, in no event does Fractal Block Team authorize you to use this Fractal Block World in applications or systems where Fractal Block World's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Fractal Block Team harmless from any claims or losses relating to such unauthorized use.
This software must not be used for anything harmful, sexually explicit, threatening, abusive, defamatory, obscene, hateful, misleading, false, or unlawful. It may not be used for racially or ethnically offensive imagery or libelous, defamatory, or other illegal material, material that is scandalous or invades the rights of privacy or publicity of any third party.
Dan Hathaway the owner of the copyright of this Fractal Block World, all of its derivatives, title and accompanying materials are the exclusive property of Fractal Block Team. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Fractal Block Team. You may not sell, rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble this Fractal Block World. You may not make access to Fractal Block World available to others in connection with a service bureau, application service provider, or similar business, or use this Fractal Block World in a business to provide file compression, decompression, or conversion services to others. There are no third party beneficiaries of any promises, obligations or representations made by Fractal Block Team herein.
You may not disclose to other persons the data or techniques relating to this Fractal Block World that you know or should know that it is a trade secret of the Fractal Block Team in any manner that will cause damage to Fractal Block Team.
This Fractal Block World and all services provided may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any [YOUR COUNTRY], State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Fractal Block Team harmless from any claims resulting from the use of this Fractal Block World, which may damage any other party.
Should any provision of this Agreement be held to be void, invalid, unenforceable, or illegal by a court of competent jurisdiction, the validity and enforceability of the other provisions shall not be affected thereby.
2. Permitted User Modifications and New Creations
You agree that any new creations or materials that you make for Fractal Block World (collectively referred to as “Mods”) are subject to the following restrictions:
2a) Your Mods must only work with the full, registered copy of Fractal Block World, not independently or with any other software without prior written consent from Fractal Block Team.
2b) Subject to the terms and provisions of this Agreement and so long as you fully comply at all times with this Agreement, Fractal Block Team grants to you the non-exclusive and limited right to create for the Software (except any Software code) your own modifications (the "Mods").
2c) Your Mods must not contain modifications to any executable file(s).
2d) Your Mods must not contain any sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, misleading, false, unlawful, racially or ethnically offensive imagery or libelous, defamatory, or other illegal material, material that is scandalous or invades the rights of privacy or publicity of any third party.
2e) Your Mods must not contain, or be used in conjunction with, any trademarks, copyright protected work, or other recognizable property of third parties without their written authority.
2f) Your Mods must not be used by you, or anyone else, for any commercial exploitation including, but not limited to in-game advertising, other advertising or marketing for any company, product or service.
2g) While we encourage folks to make Mods, Mods will not be supported by Fractal Block Team, and if distributed pursuant to this license your Mods must include a statement to that effect.
2h) You agree that the Mods will not be downloaded, shipped, transferred, exported, or re-exported into any country in violation of the United States Export Administration Act (or any other law governing such matters) by you or anyone at your direction, and that you will not utilize and will not authorize anyone to utilize the Mods in any other manner in violation of any applicable law. The Mods shall not be downloaded or otherwise exported or re-exported into (or to a national or resident of) any country to which the United States has embargoed goods or to anyone or into any country who/that are prohibited, by applicable law, from receiving such property.
2i) Your Mods must be distributed for free, period. Neither you, nor any other person or party, may sell them to anyone, commercially exploit them in any way, or charge anyone for receiving or using them without prior written consent from Fractal Block Team. You may exchange them at no charge among other end users and distribute them to others over the Internet, on magazine cover disks, or otherwise for free.
2j) You hereby agree to indemnify, defend and hold harmless Fractal Block Team and their respective officers, employees, directors, agents, licensees (excluding you), sub-licensees (excluding you), successors, and assigns from and against all losses, lawsuits, damages, causes of action, and claims relating to and/or arising from the Mods or the distribution or other use of the Mods or relating to and/or arising from your breach of this Agreement
2k) The prohibitions and restrictions in this section apply to anyone in possession of Fractal Block World or any Mods.
3. Final Remarks.
As noted below, in the event you commit any breach of this Agreement, the license you are granted herein and this Agreement automatically shall terminate, without notice.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, YOU UNDERSTAND THIS AGREEMENT, AND UNDERSTAND THAT BY CONTINUING THE INSTALLATION OF THE SOFTWARE, BY LOADING OR RUNNING THE SOFTWARE, OR BY PLACING OR COPYING THE SOFTWARE ONTO YOUR COMPUTER HARD DRIVE, COMPUTER RAM OR OTHER STORAGE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
