**End-User License Agreement (EULA) for ExMORTALIS**
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Necrotek Labs for the use of ExMORTALIS software product, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, promptly uninstall the Software and delete any copies you may have.
**1. License Grant**
Necrotek Labs grants you a revocable, non-exclusive, non-transferable, limited license to use ExMORTALIS solely for your personal, non-commercial entertainment purposes in accordance with the terms of this EULA.
**2. Restrictions**
You may not:
a. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on ExMORTALIS;
b. Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer rights to ExMORTALIS;
c. Remove, alter, or obscure any proprietary notices, labels, or trademarks on ExMORTALIS;
d. Use ExMORTALIS for any illegal purpose or in any manner inconsistent with this EULA.
**3. Ownership**
ExMORTALIS is licensed, not sold. Necrotek Labs retains all right, title, and interest in and to ExMORTALIS, including all intellectual property rights therein. This EULA does not grant you any rights to trademarks or service marks of Necrotek Labs.
**4. Termination**
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term or condition of this EULA. Upon termination of this EULA, you must cease all use of ExMORTALIS and destroy all copies of ExMORTALIS in your possession or control.
**5. Disclaimer of Warranty**
ExMORTALIS is provided "as is" without warranty of any kind. Necrotek Labs disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
**6. Limitation of Liability**
To the maximum extent permitted by applicable law, in no event shall Necrotek Labs be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, loss of data, business interruption, or any other pecuniary loss) arising out of the use of or inability to use ExMORTALIS, even if Necrotek Labs has been advised of the possibility of such damages.
**7. Governing Law**
This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
**8. Entire Agreement**
This EULA constitutes the entire agreement between you and Necrotek Labs regarding ExMORTALIS and supersedes all prior or contemporaneous agreements, representations, and understandings, whether oral or written, regarding ExMORTALIS.
By installing or using ExMORTALIS, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
