END USER LICENSE AGREEMENT
This End User License Agreement (“EULA”) is a legal agreement between you (“Licensee”) and Aerilian Games (“Licensor”). This EULA governs your use of the video game software product, including any updates or patches thereto, and any related documentation provided by Licensor (the “Game”).
BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, COPY, OR USE THE GAME.
License. Subject to your agreement to and continuing compliance with this EULA, Licensor hereby grants you a non-exclusive, non-transferable, limited license to install and use the Game solely for your personal, non-commercial use. This license is limited to the intellectual property rights of Licensor and does not include any rights to other patents or intellectual property. All rights not expressly granted herein are reserved by Licensor.
Restrictions. Licensee shall not:
(a) Copy or reproduce the Game, except as necessary to install and use the Game in accordance with this EULA;
(b) Sell, rent, lease, distribute, broadcast, sublicense, or otherwise transfer the Game or any rights to use the Game to any third party;
(c) Reverse engineer, decompile, disassemble, modify, or create derivative works of the Game or any part thereof, except as expressly permitted by applicable law;
(d) Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the Game or any related documentation;
(e) Use the Game for any commercial purpose or in any way that violates any applicable law or regulation.
Ownership. Licensor retains all right, title, and interest in and to the Game, including all intellectual property rights therein. Licensee acknowledges that this EULA does not grant Licensee any ownership interest in or to the Game, but only a limited license to use the Game in accordance with the terms of this EULA.
Termination. This EULA shall terminate automatically if Licensee fails to comply with any of its terms. Upon termination, Licensee shall immediately cease all use of the Game and destroy all copies of the Game in Licensee’s possession.
Disclaimer of Warranties. THE GAME IS PROVIDED “AS IS” AND LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability. LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OR INABILITY TO USE THE GAME, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing Law. This EULA shall be governed by and construed in accordance with the laws of the State of Buenos Aires, Argentina, without giving effect to any choice of law or conflict of law provision or rule.
Entire Agreement. This EULA constitutes the entire agreement between the parties with respect to the Game and supersedes all prior or contemporaneous understandings regarding such subject matter.
