This End User License Agreement ("EULA") is between you and Viola Corporation ("Viola"), whose address is 246, Kubo 7-chome, Kanazawa, Ishikawa, Japan. This license is valid for the software product and all related documentation (manuals, packaging), whether printed, on file, downloaded or accessed online, and also for any updates or upgrades that update or supplement the software. and are not distributed as separate licenses (collectively, the "Software").
The Software is licensed, not sold. by installing or using the software, you acknowledge that you have read this eula and agree to be bound by the terms and conditions as defined herein. If you do not agree to the terms of this EULA, you may not install or use the Software.
The Software is protected by international intellectual property treaties and national copyright laws.
LICENSE
Subject to this EULA, Viola grants you a non-exclusive, limited license to install and use the Software only for personal, non-commercial use on a single computer or other gaming device (depending on the type of operating system for which the Software was designed). Permission is granted to you to You are not permitted to share the Software, install the Software on multiple computers or game consoles simultaneously, or install the Software on a network.
Viola is granting you a license to use the Software only, and no intellectual property rights, authority or ownership rights in the Software are transferred or assigned to you. Viola retains all rights (including, but not limited to, all copyrights, other intellectual property rights, and trademarks) in and to the Software and any portion thereof, particularly any part of the Software that may be considered a separate work (e.g., themes, sounds, soundtracks, graphics, artwork, characters, descriptions, dialogue, etc.) and related materials. Any rights not expressly granted to you by this EULA are retained by Viola.
This EULA shall immediately cease to be effective if you attempt to circumvent any technical protection measures used in connection with the Software.
RESTRICTIONS
You are not authorized to: (a) use the Software for commercial purposes, i.e., to generate direct or indirect economic benefit; (b) distribute, sublicense, rent, lease, or assign the Software to any third party except as expressly provided in this EULA; (c) use the Software for any purpose other than as expressly provided in this EULA; or (d) use the Software for any purpose other than as expressly provided in this EULA. (c) install, use, or grant access to the Software on a network or install the Software on multiple computers or game consoles simultaneously; (d) circumvent technical protection measures used to prevent the unlawful use or reproduction of the Software or its functions (e) reverse engineer, decompile, disassemble, create derivative works from, or otherwise modify the Software; or (f) remove or alter any trademarks, logos, or other notices contained in the Software.
If you breach any of the provisions defined in the "License" or "Restrictions", Viola has the right to terminate this EULA after fourteen (14) days of notice and/or to pursue any rights granted to Viola to the fullest extent of applicable general law. This EULA will terminate immediately if you attempt to circumvent any technical protection measures used in connection with the Software. Upon termination of this EULA, you must permanently uninstall and remove the Software and any copies thereof.
limited warranty
Viola warrants to you that the Software is compatible with any personal computer or other gaming device that meets the minimum system requirements set forth in the Software User Manual. Although the Software has been tested, Viola does not warrant that the Software will not interfere with any third party software or drivers installed on your computer. Such interference may interfere with the proper working of the Software or even with its startup. If the Software in your possession is found to be defective, Viola will allow you to replace such Software by allowing you to download it from its servers. No support for the Software is provided with respect to this license. this software is provided on an "as is" basis.
Limitation of Liability
subject to the "consumer rights" section, in no event shall viola be liable for any damages, whether direct or indirect, special, incidental or consequential, arising out of the use or inability to use the software. Viola shall not be liable for any damages, whether direct or indirect, special, incidental or consequential, including, but not limited to, lost profits, work stoppage due to hardware or software damage, stoppage or malfunction. This means, among other things, that Viola's liability hereunder is excluded to the fullest extent permitted by law, whether in tort or any other legal theory.
Consumer's Rights
Depending on local law, certain consumer rights may be available to you that cannot be excluded by the provisions of this EULA. In the event of such a conflict between this EULA and the consumer rights provided by law, such rights will prevail subject to the following limitations: You accept and acknowledge that you are responsible for the security of the data you store on the computers you use. Viola will not be liable for any loss of data resulting from this.
Final Rules
This EULA shall be governed by the laws of Japan.
This Agreement contains the entire agreement of the parties and supersedes all prior agreements, written or oral, within the scope of this Agreement.
