Acceptance of Terms.
By using (a) the Proletariat website, (b) any of the game specific websites operated by Proletariat such as playspellbreak.com (collectively (a) and (b), the “Sites”) or (c) any of their associated services and features, you indicate your unconditional acceptance of the following Terms of Use. Please read them carefully, as they may have changed since your last visit. The most recent version of these Terms of Use may be viewed at [https://www.proletariat.com/tos]. These Terms of Use apply to all Proletariat online services and features, unless otherwise indicated. Your use of our Sites is also subject to our Privacy Policy at [https://proletariat.com/privacy].
Scope of Service.
Proletariat and our business partners and affiliates (collectively, “Proletariat” or “we”) maintain the Sites as a service to provide users with access to online games subject to these Terms of Use. These Terms of Use apply to all services and features available on our Sites, including but not limited to our online discussion forums and chat rooms. Users of any of the Sites (“you”) are responsible for obtaining any equipment and Internet service necessary to access the Sites and for any paying any fees for the equipment and service you select. We may alter, suspend, or discontinue one or more of the Sites or any features of services therein, in whole or in part, at any time and for any reason, without notice. One or more of the Sites may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
Sites Content.
Users have a limited, personal, non-transferable, non-exclusive right to access and use the Content of the Sites subject to these Terms of Use. The term “Content” means all games, information, technology, text, images, data, video, audio, links, software, messages, forum posts, links, music or sound, graphics, code, or other material accessible through one of the Sites, as well as the design and appearance of our Sites, whether created by us or provided by another person for display on one of the Sites.
The Content may contain errors or inaccuracies. We reserve the right to make changes to Content, or other information without obligation to issue any notice of such changes.
You may view, copy, download, and print any Content that is identified on one of the Sites as being available for download, subject to the following conditions:
The Content may be used solely for your own internal non-commercial purposes. No part of any Site or its Content may be reproduced or transmitted in any form, by any means, electronic or mechanical, including photocopying and recording for any other purpose;
The Content may not be modified;
Copyright, trademark, and other proprietary notices may not be removed;
you may not use any data mining, robots or similar data gathering or extraction methods;
you may not use the Sites or the Content other than for their intended purposes; and

Photosensitivity.
Certain individuals (regardless of whether such individuals have a diagnosed condition or history) may react to certain visual images or patterns appearing on our Sites, including without limitation on our games. Such images or patterns may include but are not limited to flashing lights. Reactions may be reduced by viewing or playing in a well-lit room, avoiding playing while drowsy, viewing the Sites or games from some distance or on a smaller screen, and limiting duration of use.
Links to Third-Party Websites.
The Sites may contain links to websites operated by third parties, such as retailers and other non-Proletariat websites that are provided to you as a convenience only. Any such third party website accessed from one of our Sites is independent from Proletariat, and we have no control over the content or operation of such websites. We are not responsible for the content of any linked website or for any loss or damage incurred in connection with your use such links or dealings with the operators of such third party websites.
No Implied Endorsements.
In no event shall any reference to any third party or third party product or service be construed as an approval or endorsement by Proletariat of that third party or of any product or service provided by a third party. Likewise, a link to any third party website does not imply that we endorse or accept any responsibility for the content or use of such website. Proletariat does not endorse, warrant or guarantee any product or service offered by any third party through an online discussion forum or chat room accessible through one of the Sites and will not be a party to or in any way monitor any transaction involving any third parties. You are solely responsible for exercising appropriate judgment and caution with respect to third party websites, products and services.
Content Submitted by Users.
Personal Information and Accuracy. You may use certain portions of our Sites without volunteering personal information, but you may not have access to all features and functions available on the Sites. Please refer to our Privacy Policy at [https://proletariat.com/privacy] for additional information on our practices for handling personal information. However, if you choose to provide information, including personal information, to us, such as to register for or participate in a service, event, or promotion on one of our Sites, you agree that you will provide accurate, complete, and up to date information.
Some areas of our Sites allow users to submit, post, display, provide, or otherwise make available content such as profile information, user forum features, chatroom features, comments, questions, and other content or information (any such materials a user submits, posts, displays, provides, or otherwise makes available on our Sites is referred to as “User Content”).
Liability. We are not responsible or liable for User Content or the conduct of users. We do not prescreen User Content. With respect to User Content, we acting as a passive conduit for such distribution and are not responsible for such User Content. Any opinions, advice, statements, services, offers, or other information in User Content are those of the respective author(s) or distributor(s) and not of Proletariat. We neither endorse nor guarantee the accuracy, completeness, or usefulness of any User Content. You are responsible for ensuring that User Content that you submit is not provided in violation of any copyright, trade secret or other intellectual property rights of entity third party. You shall be solely liable for any damages resulting from any infringement of copyrights, trade secret, or other intellectual property rights, or any other harm resulting from your uploading, posting or submission of User Content to any of the Sites. As a user of our Sites, you understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose, and you agree that we shall not be liable for any damages you allege to incur as a result of or relating to any User Content.
Interactions with Other Users. If the Sites permit interaction with other users, you are solely responsible for such interactions. We reserve the right, but have no obligation, to monitor disputes between you and other users. We shall have no liability for your interactions with other users, or for any user’s action or inaction.
Monitoring. We have the right, but not the responsibility or obligation, to monitor User Content to determine compliance with these Terms of Use, applicable law, and any other applicable rules that we may establish. We have the right in our sole discretion to edit or remove any User Content in our sole and absolute discretion
Acceptable Use.
You agree not to engage in any of the following prohibited activities in connection with your use of the Sites, the Content, and/or any features or functions therein: (i) copying, distributing, or disclosing any part of the Sites or the Content in any medium, including without limitation by any automated or non-automated “scraping”; (ii) using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Sites or the Content in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Sites; (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (vi) uploading invalid data, viruses, worms, or other software agents through the Sites; (vii) collecting or harvesting any personally identifiable information, including account names, from the Sites; (viii) using the Sites for any commercial solicitation purposes; (ix) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (x) interfering with the proper working of the Sites; (xi) accessing any Content through any technology or means other than those provided or authorized by the Sites; or (xii) bypassing the measures we may use to prevent or restrict access to the Sites, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Sites or the Content.
You agree not to post, submit, or otherwise make available any User Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; (ii) may create a risk of any other loss or damage to any person or property; (iii) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise; (iv) may constitute or contribute to a crime or tort; (v) contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, obscene, pornographic, or otherwise objectionable; (vi) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets); (vii) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or (viii) contains any information or content that you know is not correct and current or (ix) violates any applicable policy, including those related to cheating or ethics. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined above) or rights of privacy. We reserve the right, but are not obligated, to reject and/or remove any User Content that we believe, in our sole discretion, violates any of these provisions.
Children.
You must be at least 13 years of age (or such other minimum age as is applicable in your country of residence) to use our Sites. We do not knowingly solicit personal information regarding children under age 13. Parents and guardians are responsible for the acts of children under 18 years of age when using our Sites.
Intellectual Property Rights.
Unless otherwise noted, our Sites and all Content contained on our Sites is the property of Proletariat and/or its affiliates or licensors, and is protected from unauthorized copying and dissemination by United States copyright law, trademark law, international conventions and other intellectual property laws. Product names are trademarks or registered trademarks of their respective owners. You shall not at any time or in any way dispute, challenge, or undertake any action directly or indirectly that would be inconsistent with the ownership thereof by Proletariat or its licensors. You shall not at any time, without the prior written consent of Proletariat, use or adopt any trademark, trade name, or commercial designation that includes or is similar to or may be mistaken for the whole or any part of any trademark, trade name or commercial designation used by Proletariat.
We do not claim ownership rights in User Content, however, you understand that User Content may be made publicly accessible through our Sites. By submitting posting, displaying, providing, or otherwise making available User Content, you grant us a world-wide, royalty-free, perpetual, irrevocable, sublicensable, transferable, non-exclusive license to use, distribute, reproduce, modify, adapt, create derivative works from, and publicly perform or display such User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Sites and our (and our successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Sites (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Sites a non-exclusive license to access your User Content through the Sites, and to use, reproduce, distribute, display and perform such User Content as permitted through the functionality of the Sites and under these Terms of Use.
This license shall remain in effect until we delete the User Content from our Sites or systems.
Copyright Infringement; Notice and Take Down Procedures.
If you believe that any materials or Content on any of our Sites infringe your copyright, you may request that they be removed. This request must bear a signature (or electronic equivalent) of the copyright holder or an authorized representative and must include the following information: (1) identification of the copyrighted work that you believe to be infringed, including a description of the work and, where possible, a copy or the location of an authorized version of the work; (2) identification of the material that you believe to be infringing and its location, including a description of the material, its website location or other pertinent information that will help us to locate the material; (3) your name, address, telephone number, and email address; (4) a statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law; (5) a statement that the information in your claim is accurate; and (6) a statement that "under penalty of perjury," you declare that you are the lawful copyright owner or are authorized to act on the owner’s behalf. Security.
When you use certain portions of Sites or register to participate in an online discussion forum, chat room, promotion, or other service offered on any of our Sites, you may be required to establish a login identifier and a password. You are responsible for protecting your login and password from unauthorized use, and you are responsible for all activity that occurs on your account. You agree to notify us immediately if you believe that your login or password has been or may be used without your permission so that appropriate action can be taken. We are not responsible for losses or damage caused by your failure to safeguard your login and password.
Disclaimer of Warranty.
Under no circumstances will we be liable for any loss or damage caused by your reliance on information in any Content on any of our Sites. It is your responsibility to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through our Sites. You are responsible for seeking the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other Content.

Indemnification.
BY USING ANY OF THE SITES, YOU AGREE TO INDEMNIFY, HOLD HARMLESS AND DEFEND PROLETARIAT FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND ALL COSTS AND EXPENSES OF DEFENSE, INCLUDING BUT NOT LIMITED TO, ATTORNEYS' FEES, RESULTING DIRECTLY OR INDIRECTLY FROM A CLAIM BY A THIRD PARTY THAT ARISES IN CONNECTION WITH YOUR USE OF SUCH SITES, INCLUDING WITHOUT LIMITATION, YOUR USER CONTENT.
Jurisdictional Issues.
We make no representation that information on our Sites is appropriate or available for use outside the United States. Those who choose to access any of our Sites from outside the United States do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws.
Termination.
We may terminate or suspend any user’s access to any or all of our Sites, including access to any online discussion forum or chat room, in our sole discretion, for any reason and at any time, with or without prior notice. It is our policy to terminate users who violate these Terms of Use, as deemed appropriate in our sole discretion. You agree that we are not liable to you or any third party for any termination of your access to our Sites. Upon termination, your right to use the Sites will immediately cease. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers and limitations of liability.
Enforcement.
These Terms of Use shall be governed and interpreted pursuant to the laws of the Commonwealth of Massachusetts, United States of America, notwithstanding any principles of conflicts of law.
All disputes arising out of or relating to these Terms of Use shall be finally resolved by arbitration conducted in the English language in Boston, Massachusetts,
U.S.A. under the commercial arbitration rules of the American Arbitration Association. The parties shall appoint as sole arbitrator a retired judge who presided in the Commonwealth of Massachusetts. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys' fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator). All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding the foregoing, we shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the District of Massachusetts or any other court of competent jurisdiction. Under no circumstances shall the arbitrator be authorized to award punitive damages, including but not limited to federal or state statutes permitting multiple or punitive damage awards. Any purported award of punitive or multiple damages shall be beyond the arbitrator’s authority, void, and unenforceable.
Severability.
If any part of these Terms of Use is held to be unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Entire Agreement.
These Terms of Use constitute the entire agreement between the parties relating to the subject matter herein.
Updates.
We may modify or update these Terms of Use from time to time, so please review this page frequently. Your continued use of our Sites after an update or modification means you accept the changes.
Reservation of Rights.
All rights not expressly granted by Proletariat in these Terms of Use are reserved by Proletariat and its licensors. Such reserved rights expressly include, but are not limited to: (a) moral rights, such as the right of integrity; (b) publicity, privacy, and/or other similar personality rights; (c) patent rights; and (d) trademark rights.
Feedback.
If you provide to us any ideas, proposals, suggestions or other materials (“Feedback”), whether related to the Sites, the Content, or otherwise, you hereby acknowledge and agree that such Feedback is not confidential, and that your provision of such Feedback is gratuitous, unsolicited and without restriction, and does not place us under any fiduciary or other obligation.

Proletariat knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy for Proletariat’s games (such as Spellbreak) and Proletariat’s websites, such as the proletariat.com web site as well as the game specific websites operated by Proletariat such as playspellbreak.com and spellbreak.com (the “Properties”).

Notice of Information We Collect And How We Use It
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal information about you that we consider necessary for achieving this purpose.
In general, you can browse the Properties without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are no longer anonymous to us.
Information We Collect About Anonymous Visitors
We automatically track certain information based upon your behavior on certain of our Properties. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve you and our community.
Log Files
Like many Web sites, we automatically gather certain information about traffic on our Properties and store it in log files. A session ID cookie expires when you close your browser. We use session cookies to make it easier for you to navigate our Properties.

Clear Gifs (Web Beacons/Web Bugs)
We employ a software technology called clear gifs, also referred to as web beacons or web bugs, that help manage content on the Properties by tracking what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We tie the information gathered by clear gifs to our customers’ personally identifiable information.
We use clear gifs in our HTML-based emails to let us know which emails recipients have opened. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Choice and Opt-out.”
Information We Collect To Respond To Your Choices and Requests
Registration
In order to use some features of our Properties, you must first complete the registration form and create a user name and password. During registration you are required to give truthful contact information (such as name and email address) in accordance with our terms of use http://proletariat.com/tos. We use this information to contact you about the services on our Properties in which you have expressed interest.
Surveys or Contests
We may provide you the opportunity to participate in contests or surveys on one or more of our Properties. If you participate, we will request certain personally identifiable information from you. The requested information typically includes contact information (such as name and shipping address) and demographic information.
We use this information to notify contest winners and award prizes, to monitor Property traffic, or to personalize our Properties (in the case of anonymous information collected in surveys) and to send participants an email newsletter.
We may use a third party service provider to conduct these surveys or contests. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.
Chat Rooms, Forums and Messages
If you choose to post messages in our chat rooms, forums or other public message areas or leave feedback for other users, we will collect the information you post. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.
Any information that is disclosed in chat, forums or bulletin boards should be considered public information, and users who message one another may not know each other personally. Communication from Us or the Properties
Special Offers and Updates
We will occasionally send information on products, services, special deals, and promotions to our users. We give users the option to receive promotional email communications from us. You may opt out of these communications. Instructions for discontinuing receipt of promotional email communications from us will be provided in email communications to users.
Newsletters
If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. Out of respect for your privacy, we provide you a way to unsubscribe in each email we send to you. Please see the “Choice and Opt-out” section.
Profile
We store information that we collect through cookies, log files, clear gifs, and/or third party sources to create a “profile” of your preferences. We tie your personally identifiable information, and your purchasing history, to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the Properties for you.
We do not share your profile with other third parties.
Conditions Under Which We Share Information
Aggregate Information (Non-Personally Identifiable)
We share aggregated demographic information about our user base with our partners and advertisers. This information does not identify individual users.
Personally Identifiable Information
Except as discussed below, we do not share Personally Identifiable Information with Third Parties.
Third Party Advertisers
The ads appearing on Properties are delivered to users by our advertising partner(s). We share Web site usage information about users with our advertising partner for the purpose of targeting our Internet banner advertisements on our Properties.
Our advertising partner may use cookies and clear GIFs on the Properties, which allow it to recognize a user’s cookie when a user visits the Properties. The information that our advertising partner collects and shares through this technology is not personally identifiable.

Clear Gifs (Web Beacons/Web Bugs)
We employ a software technology called clear gifs, also referred to as web beacons or web bugs, that help manage content on the Properties by tracking what content is effective.
