This End-User Limited License agreement (hereinafter, "License" or "Limited License") is between Platinum Thunder Studios ®2020 ©2020 Platinum Thunder Studios, the owner of the copyright of this game, all of its derivatives, title and accompanying materials are the exclusive property of Platinum Thunder Studios.hereinafter sometimes referred to as "Licensor") and a purchaser and/or user (sometimes hereinafter referred to as "you") of that certain single-player computer game and accompanying materials known as Solar Scion ® 2020 © 2020 (hereinafter sometimes referred to as the "game"). Your playing, installation, download, or any other use whatsoever of the game or any copy thereof constitutes your acceptance of this Limited License.
1. This Limited License authorizes you to use the game only for lawful purposes, only for your personal use, and only on one computer. If you want to use the game on more than one computer, you must contact Licensor for a Site License. You are not authorized to (a) play the game on more than one computer (the game may be accessed through a network only after obtaining a site license); (b) sell, resell, install, ship, share, copy, and/or reverse engineer the game; (c) separate any component part(s) of the game for any purpose; and/or (d) make any use of the game other than as stated in this Limited License regardless of whether or not such use is expressly stated as being excluded from this Limited License.
DISCLAIMER OF WARRANTY
2. This Disclaimer of Warranty is an essential and material part of this Limited License agreement. If you do not wholly agree to each and every term and condition of this Limited License, then do not install, distribute or make use of the game in any way whatsoever.
3. THIS GAME IS SOLD 'AS IS' WITH NO WARRANTIES EXPRESS OR IMPLIED. LICENSOR DISCLAIMS ALL WARRANTIES. LICENSOR DISCLAIMS ALL IMPLIED WARRANTIES, ALL WARRANTIES OF SUITABILITY FOR A PARTICULAR PLAYER, AGE, GROUP(S), COMPUTER(S), INDIVIDUAL(S), BUYER(S), PURCHASER(S), ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, ALL WARRANTIES OF MERCHANTABILITY, ALL WARRANTIES OF COMPATIBILITY WITH ANY WIRED AND/OR WIRELESS COMPUTER, ELECTRONIC DEVICE, OR SYSTEM, AND ALL EXPECTATIONAL WARRANTIES OF ANY GROUP, INDIVIDUAL, BUYER, OR PURCHASER.
4. If you have proof that the game was purchased within the United States of America (1) from Platinum Thunder Studios, or (2) from an authorized distributor or reseller or retail outlet of Platinum Thunder Studios, and, further, that the game is incapable of being downloaded due to a software defect in the game, then within thirty (30) days of the purchase date you may return said game to Platinum Thunder Studios for refund of your price paid, less any incidental charges determined by Licensor.
5. The purchase price of any game downloaded or shipped out of the United States of America is strictly non-refundable.
6. This game is only for personal use and only may be installed and used on one computer. Its component parts may not be separated or copied for any purpose. The game may not be accessed through a network unless and until after obtaining a site license. All components and materials included with the game are owned by Platinum Thunder Studios and are not authorized to be taken apart, modified, used, reverse-engineered, published or copied in any manner whatsoever.
7. THE USER ASSUMES THE SOLE RISK OF USING THE GAME. In no event shall Platinum Thunder Studios, its owner(s), investers, principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, and/or parent organizations, be liable for any incidental, actual, consequential, punitive or any other damages whatsoever relating to or associated with use of this game. Potential liability, if any, of Platinum Thunder Studios shall be limited exclusively to a refund of purchase price paid for the game.
8. You are not authorized to use the game in any application and/or in any system where the game's failure to perform might possibly be expected to result in physical injury or death. Any such use is strictly prohibited.
9. You agree to indemnify and hold harmless Platinum Thunder Studios from any claims or losses relating to unauthorized use under this Limited License agreement.
10. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Platinum Thunder Studios. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this game. You may not make and/or permit access to this game to be available to any other person and/or entity in connection with a service bureau, application service provider, or similar business.
11. There are no third party beneficiaries of any promises, obligations or representations made by Platinum Thunder Studios herein.
12. You shall hold in confidence, shall treat as confidential, and shall not disclose to any other person or entity any data, techniques relating to the game that you know or should reasonably know are trade secret(s) of Platinum Thunder Studios in any manner that may cause damage or harm to Platinum Thunder Studios.
13. This game and all services provided in connection herewith or related in any way hereto may be used for lawful purposes only. Transmission, storage, presentation, or any use whatsoever of any information, data, methodology, or material contained in and/or associated with this game in violation of any person's and/or entity's legal rights and/or in violation of any law, rule, statute, decree, injunction, ruling, dictate, directive, enactment, ukase, mandate, act, canon, or similar associated or related pronouncement having or given the force of law, of the United States of America and/or of any state, territory, or possession thereof and/or that of any lawful authority wheresoever located and having jurisdiction in the premises hereof is strictly prohibited. This prohibition includes but is not and may not be deemed or construed to be limited to copyrighted material, material we or any other person or entity may judge to be threatening, unsuitable or obscene, and/or any material protected as a trade secret and/or protected by any statute, decree, injunction, ruling, dictate, directive, enactment, ukase, mandate, act, canon, or similar or related or associated pronouncement having or given the force of law.
14. You agree to indemnify, defend, and hold Platinum Thunder Studios harmless from any and all claims, losses, damages, liabilities, fees, expense, and costs, including all reasonable legal expense, resulting from any use you make of this game.
15. This License agreement constitutes the entire statement of the agreement between the parties on the subject matter, and merges and supersedes all other oral or written understandings, purchase orders, agreements and/or arrangements. This Limited License agreement shall be governed by the laws of the State of Texas except any Texas law that would refer its interpretation or enforcement to another jurisdiction.
