Terms of Service and EULA
This Terms of Service (Terms) and End User License Agreement (EULA) covers all of Isekai Entertainment LLC (“Company”)’s Games, Websites, Services, and Products, including but not limited to Sword Reverie, swordreverie.com, and isek.ai, as well as all software, image files, all accompanying files, data, and materials received with your order of our Games, Services, or Products.
In addition, when purchasing certain Games, Products, Services, or Materials through our website or on other platforms (such as Steam Store, Oculus Store, Kickstarter, etc.), users shall be subject to any posted rules and terms of use applicable to such services or platforms that may contain terms and conditions and EULA in addition to those in these Terms of Service and EULA. All such guidelines or rules are hereby incorporated by reference into these Terms of Service and EULA.
By using our Websites and/or Services and/or by installing, distributing, or playing our Games, you, the “User” agree to comply with all the terms, conditions, and notices contained or referenced herein (the “Terms of Service and EULA”), as well as any other written agreement between us and you. If you do not agree to any of the terms of the Terms of Service and EULA, then do not install, distribute, use, or play our games, websites, services, and products.
These Terms of Service and EULA are effective as of July 27, 2020. We expressly reserve the right to change these Terms of Service from time to time without notice to you. You acknowledge and agree that it is your responsibility to review our website and these Terms of Service and EULA at https://swordreverie.com/terms from time to time and to familiarize yourself with any modifications.
Your continued use of our website and/or services and/or by installing, distributing, or playing our games after such modifications will constitute acknowledgement of the modified Terms of Service and EULA and agreement to abide and be bound by the modified Terms of Service and EULA.
1. Intellectual Property
Isekai Entertainment LLC is the owner of the copyright of Sword Reverie. All title, ownership rights and intellectual property rights in and to the Sword Reverie, its service and all copies thereof (including, without limitation, any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, user translated in-game texts, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, and any related documentation) are owned by our Company. Sword Reverie is protected by the copyright laws of all countries, international copyright treaties and conventions, and other laws. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by our Company.
All of the Games, Services, and Products that we develop, publish, or distribute belong to Isekai Entertainment LLC or one of our affiliates. All concept art, screenshots, trailers, icons, logos, and service names used on the website are registered trademarks, service marks, software, and/or artwork held under copyright of Isekai Entertainment LLC or its Affiliates. All other marks are property of their respective owners.
Your license to use and play one of our Games, Services, and Products do not grant you any ownership interest in the Game, Service, or Product or the license to use or ownership interest in any of the other Company Games, Services, or Products. Participation in a playtest does not grant you license to use and play the full version of that Game, Service, or Product, nor a license or use or play or a ownership internet in any other Game, Service, or product. This Terms and EULA does not entitle you to any subsequent releases of the Game, Service, or Product, or to any subsequent developments of the Game, Service, or Product unless otherwise stated in writing. We may update or otherwise enhance the Game at any time, and these updates may be required for the continued usage of our Game, Service, or Product, and there is no guarantee that you can continue using, playing, or otherwise accessing the original Game, Service, or Product that you purchased.
We may also create additional content (“DLC”) or premium content (such as skins, weapons, maps, story, in game currency, etc.) for any of our Games, Services, or Products and in doing so incurs no obligation to furnish such updates or content to you pursuant to this Terms of Service and EULA unless otherwise stated in writing. These additional or premium content might be available at additional cost to the User, or not available at.
You may not disclose to any other person data and techniques related to our Games, Services, or Products that you know is a trade secret or included under a nondisclosure agreement (NDA). User will be responsible for any damages caused by unauthorized disclosure of intellectual property.
You may not use any of our copyrighted material or trademarks, including title, logo, icon, character, character names, models, dialog, catch phases, likeness, sounds, animations, gameplay footage, screenshots, etc. in advertisements unrelated to Isekai Entertainment LLC and our Games, Service and Products or a Derivative work without prior written agreement from our Company.
When you view our website, trailers, or when you play our games our otherwise interact with our products or services, you may want to provide feedback and suggestions or otherwise contribute (code, artwork, story, etc.) to the our Games, Products, and Services. We welcome your feedback and suggestions. If you provide suggestions, feedback, or other contributions for our games, services, or products publicly or directly to us, you acknowledge that we may act upon those feedback, suggestions, and contributions without your permission and without compensation. By providing your feedback and suggestions in public or directly to our Company, you agree to waive all rights to compensation regarding your feedback, suggestions, and contributions. If you believe you can contribute to our Games, Products, or Services but would like to be compensated, please contact us at support@isek.ai and receive written confirmation of the agreed upon compensation before disclosing the content of your contribution.
2. Derivative works:
We support our vibrant community of Content Creators (anyone who creates derivative works related to our Company’s Games, Products, Services), and encourages the creation of Let’s Play videos, Review Videos, Fan Art, and other Fan Content, (collective as “Derivative Works”) based on our Game’s characters, character names, models, likeness, soundtrack, screenshots, and game footage (“Content”)
Streamers, press, and other content creators and influencers are free to use gameplay footage and other Content of our Games without prior consent as long as the resulting work is transformative (includes commentary) or informative (reviewing our games or comparing multiple games in a factual manner or providing opinion) and non-commercial (does not generate revenue or profit for the Content Creator outside of revenue and profits from YouTube, Twitch or other video streaming service, ads and affiliate links on a publication, which are allowed. Gameplay videos without commentary and videos that misinform the user about our Game, Products, or Services by misrepresenting material facts are not allowed.
You may create fan art, fan animations, MikuMikuDance (MMD), MAD, Game Music Videos (GMV), or similar artwork or video Content, but only if you clearly indicate the source where the Content comes from, and the Derivative Works do not generate any revenue or profit (including advertising revenue and crowdfunding (such as Kickstarter), but not including commission revenue or community donations (such as Patreon or Pixiv Fanbox)).
Modifications and Fan Games are allowed only if you clearly indicate where our characters, names, models, and likeness come from, do not include unmodified logos and icons, and the Derivative Works are non-commercial and do not generate any revenue or profit (including advertising revenue and crowdfunding (such as Kickstarter), but not including community donations (such as Patreon or Pixiv Fanbox)). For standalone fan games, you may not use any copyrighted software or source code from our Games, Services, Products, or Software. For modifications, you may distribute the modifications solely to licensed end users of the Game. Distribution of modifications that do not require the licensed base game is prohibited. You may not use our title, logo, or icon when advertising a modification or fan game.
You may reverse engineer, de-compile, disassemble, or data mine our Games, Products, Services, or Materials for the sole purpose of creating fan works or modifications as long as the methods used are not illegal and you are not performing any action for the purpose of piracy, unauthorized distribution, cheating, ban evasion, or any other purpose that will cause harm to the Company.
However, our Company reserves all rights related to our Games, Products, Services, and Content, and our company reserves the right to ask Content Creators to remove copyrighted and trademarked material from Derivative Works for any reason.
These reasons include but are not limited to usage of our Content in manners that are unauthorized according to the Terms of Service and EULA, unlawful, threatening, abusive, harassing, defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts, victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability or otherwise violates our rules or policies at the sole judgment of our Company.
Usage of our Content in Derivative Works does not give the Content Creator grant ownership of any copyrighted or trademarked material. Content Creators only retain copyright for the derivative portions of their work, and when Content owned by Company is used legally and according to the Terms and EULA.
3. Unauthorized use
Without a separate, additional license from Isekai Entertainment LLC. our Games, Services, and Products are for personal use only and may only be used by the User and immediate friends and family, with only one user using at the same time. Its component parts may not be separated for use on more than one computer. All components accompanying our Games, Services, and Products are copyrighted by our Company and may not be used or published with other software and may not be distributed or copied in any manner.
Our Games, Services, and Products may not be installed on a computer or device that is shared by multiple users that are not friends or from an immediate household. Installation of our Games, Services, and Products in an internet cafe, VR arcade, or exhibit machine (such as a museum display), and other public venue machines without written approval or separate, additional license from Isekai Entertainment LLC is strictly prohibited. If you would like to add any of our Games, Services, and Products to an internet cafe, VR arcade, or exhibit, please contact us at suppport@isek.ai.
Our Games, Services, and Products may not be installed on a network server for cloud streaming, remote access or otherwise be available to the public or multiple users without written approval or separate, additional license from Isekai Entertainment LLC. If you would like to add any of our Games, Services, and Products to a cloud gaming service, please contact us at suppport@isek.ai.
Except as expressly permitted by this Terms of Service and EULA or in circumstances expressly permitted by applicable law, you may not rent, lease, sub-license, loan, exploit for profit or gain, copy, reproduce, distribute, or otherwise deal in our Games, Services, or Products in any way without written agreement, contract, or an separate, additional license from Isekai Entertainment LLC.
Unauthorized distribution of our Games, Products, Services, or Materials, including all software and product keys is prohibited. Please support the developers, and do not put our game on piracy and torrent sites. You may not make our Games, Products, Services, or Materials available to others in any commercial use such as selling our Games, Products, Services, or Materials, without our authorization. You may purchase additional product keys to give as gifts though Steam Store, Oculus Store, Kickstarter, Humble Bundle or any other platform where our product is legally sold. You may gift product keys you received through Kickstarter, Humble Bundle, or through giveaways to friends and family. However, we do not allow the resell of product keys, and we may revoke product keys if they were purchased through an unauthorized channel. You MAY NOT export or re-export the Games, Services, and Products or any copy or adaptation. Only purchase the game through official channels such as Steam, Oculus, Kickstarter, Humble Bundle, etc. and not third-party key resellers (such as G2A or eBay). We make no guarantee that product keys that are bought through key resellers will work.
You MAY NOT remove, disable or circumvent any security protections or any technical measures such as digital rights management (DRM) software that control access to our Games, Products, and Services and/or are designed to prevent or inhibit the infringement of any copyright or other intellectual property right.
You MAY NOT create Games, Software, Products, Services, or other executable programs that mimic the likeness or functionality of our Games, Services, or Products.
You MAY NOT remove, modify, deface or circumvent any proprietary notices or labels contained on or within the Game, Services, or Products.
You MAY NOT use our Games, Services, and Products in violation of any applicable laws or regulations. In addition, in no event does our Company authorize you to use our Games, Products, Services, and other Materials when it may result in a physical injury, or in loss of life for the User or others.
4. Disclaimer of Warranties
To the extent permitted by applicable law, our Games, Products, Services, and other Materials, all accompanying files, data and materials, are distributed “AS IS” and with no warranties of any kind, whether express or implied unless otherwise specified in writing. While we aim to deliver a satisfactory user experience to all our customers, There is no guarantee that the Games, Products, Services or other Materials will be fun, uninterrupted, or error free, or all advertised features and content will work according to the buyers expectations. You understand and agree that our Games, Products, Services, and other Materials are provided “AS IS” and that our Company and all related third-parties, including developers, publishers, stores, distributors, as well as Company directors, officers, employees, and agent assume no responsibility for the fitness of purpose for our Games, Products, Services, and other Materials. The user must assume all risks of playing or using our Games, Products, Services, and other Materials.

6. Conduct on our website and in our games and services
Your use of the Websites, Games, Services, and Products and is subject to all applicable laws and regulations, and you are solely responsible for your behavior and communication in our Websites, Games, Services, and Products.
By posting information in or otherwise using any communications service, chat room, message board, or other interactive service that may be available to you on or through our Websites, Games, Services, and Products, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content — including text, communications, software, images, sounds, data, or other information — that:

Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party
Impersonates any person or entity, including any of our employees or representatives
Content available through our Websites, Products, Services, and Games may include speech and opinions from a third party such as other gamers, site users, or other person or entity not connected with us. We do not endorse, nor are we responsible for the accuracy or reliability of, any opinion, advice, or statement made by anyone other than an authorized Company spokesperson speaking in his/her official capacity.
We generally do not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this Website. If you paid for a Game, Product, or Service from the Company and your ability to consume or use the game, product or service is fully impaired due to termination caused by the Company for a reason other than those above, you will be eligible for a full refund if the purchase was made within 14 days of termination. If termination was made beyond 14 days of purchase, a full or partial refund will be at the discretion of the Company. If only certain features or parts of the Game, Product, or Service have been restricted, a full or partial refund will also be at the discretion of the Company. The platform (such as Steam Store or Oculus Store) where you purchased our game, product, or service may have different refund policy than ours. You are free to attempt to refund the game, product, or service through the platform in which you purchased the Game, Product, or Service.
Upon termination or suspension, regardless of the reasons therefore, your right to use the website, game, product, or service immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or our Websites, Games, Products, and Services. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.

Any liability of our Company will be limited exclusively to refund of purchase price. Without a separate, additional license from Isekai Entertainment LLC. our Games, Services, and Products are for personal use only and may only be used by the User and immediate friends and family, with only one user using at the same time. Its component parts may not be separated for use on more than one computer. All components accompanying our Games, Services, and Products are copyrighted by our Company and may not be used or published with other software and may not be distributed or copied in any manner.
