END USERS LICENCE AGREEMENT
This EULA includes terms and conditions of using free version of Spinodrum. It explains limits, conditions, distribution and installation notes and other specific contents. Please consider on to read this EULA before using Spinodrum. Because your use, distribution or installation of this copy of "Spinodrum" means that you are agree with the terms and conditions of this agreement. If you do not agree with the terms and conditions on this License, cancel installation immediately, then you will not licensed to use the Spinodrum. In this case, if you have a direct setup for Spinodrum, you must uninstall and delete completely all copies of it.
Spinodrum is a digital 3d drum simulator game (software) that contains audio, text, visual and similar executable files which can be reachable through download. Therefore, it may need a site access through network connection.
Spinodrum is not suitable for commercial use; it is for personal use only. It may not be fulfill your user expectations. And it doesn’t guarantee any successful installations on your computer. Also, this License does not includes any support or update promises.
Ali Efe IRALI is the only developer, designer and the owner of the copyright of Spinodrum, all of its title, 3d or 2d models and similar graphical textures, effects, musical samples, drum samples, animations, logo and similar materials are the exclusive property of Ali Efe IRALI. Therefore, possible rights which are not expressly written in this License are belongs to Ali Efe IRALI. Any materials of Spinodrum must not be edited, used with other games or softwares and must not misrepresented, republished, redistributed or copied in any manner. You may not transfer, sublicense, network, loan, lend, lease, distribute, rent, modify, translate, disassemble, decompile, reverse engineer, translate the software into another computer language, otherwise reduce the software to human perceivable form, create derivative works based upon the software other than as otherwise provided herein, or copy or use the Spinodrum and/or the Spinodrum documentation in violation of this Agreement. However, you can share the end results of your recordings and compositions made with Spinodrum’s built-in features such as Beat Creator and Live Recorder by giving credits to Spinodrum. There are no third party beneficiaries of any promises, obligations or representations made by Ali Efe IRALI herein. Spinodrum doesn't have any kind of popular or non-popular trademark objects, violence based effects or imagery, bad language, nudity or any materials against society rules, due to strong copyright, lawful sensitivity and moral reasons. Therefore, Spinodrum and Ali Efe IRALI will not be responsible with your creations or editings. Same thing also applies for sound effects, texts, models, program codes and rest of all materials of Spinodrum.
In no event shall Ali Efe IRALI be liable for physical injury, any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of Spinodrum, even if advised of the possibility of such damage. Where legally liability cannot be excluded, but it may be limited, Ali Efe IRALI’s liability and that of its suppliers shall be limited to the sum of one Turkish Lira (1 TRY) in total.
Spinodrum is distributed “as-is” with all of its audio, text, code or visual based data files, and this distribution doesn’t includes guarantee for accuracy or applicability to any purpose. You agree to accept all risks of using the Spinodrum and you agree to keep Ali Efe IRALI harmless from all possible misuse or risks may caused by unclarified usage. In no event shall Ali Efe IRALI and his relatives (included but not limited to first degree relatives or parent organizations) be liable for any kind of damages in any manner related to using of Spinodrum.
Insofar as not otherwise agreed, this Agreement shall be governed exclusively by laws of Republic of Turkey. Spinodrum, as a software doesn't includes any micro-transactions or doesn't collect willingly or directly any kind of user data. But third parties (included but not limited to: download providing websites) may collect some of your data to make connection between you and their server. Ali Efe IRALI must not liable against these kind of operations. Any violation acts (included but not limited to: making third party people access to core datas of Spinodrum for any kind of data leaking or editing, or sharing built-in or user datas with public) against "Law No 6698" as known as "Law On The Protectıon Of Personal Data" in Republic of Turkey, and any other harmful acts against laws of Republic of Turkey are strictly prohibited. You agree to the being responsible by yourself and keep Ali Efe IRALI harmless from any damages caused by use of Spinodrum to any other third parties.
