Epic may use your trademarks, service marks, trade names, and logos used with any Product, as well as publicly released screen shots and video content from the Product, in connection with Epic’s marketing, advertisement, and promotion of the Unreal® Engine in any and all media without restriction.
MeSnakeman :: Disclaimers and Limitation of Liability
Licensed Material is provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. We disclaim all warranties, conditions, common law obligations, and representations (express, implied, oral and written) with respect to the Licensed Material, including, without limitation, any express, implied or statutory warranties and conditions of any kind, such as title, no interference with pleasure, authority, no violation, commercial suitability, suitability or suitability for any purpose, system integration, accuracy or completeness, results, reasonable care, work effort, no negligence and no viruses, regardless of whether they allegedly arise from the provisions of law, due to customs or use in trade or through proceedings. Without limiting the generality of the foregoing, We make no warranty that the Licensed Material will function properly, continuously, meet your requirements, be error-free or error-free in all or all circumstances, that any defects will be corrected. Any warranty against violations that may be contained in sections 2-312 of the Uniform Commercial Code or in any other comparable law is expressly rejected. We do not guarantee continuous, error-free, virus-free, secure operation or access to the Licensed Material. This paragraph shall apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, We shall not be responsible for any loss or damage arising from the use or inability to use the Licensed Material or otherwise related to this Agreement, including but not limited to goodwill, downtime, failure or computer failure and any other damage or commercial loss. In no event will we be responsible for any loss of profit or any indirect, incidental, consequential, special, punitive or exemplary damages, or any other damages arising out of or in connection with this Agreement or the delay or inability to use or non-functionality of the licensed material, even in the event of fault, tort (including negligence), strict liability, damages, product liability, breach of contract, breach of warranty or otherwise, even if we have been informed of the possibility of such damages. These damage limitations and exclusions apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in those states or jurisdictions, the foregoing limitations of liability shall apply only to the full extent permitted by law.
Definitions:
- "Licensed Material" means the artistic or literary work, database, or other material to which the Licensor applied this License.
- "We" , "Licensor" means the individual(s) or entity(ies) granting rights under this Licence.
- "You" means the individual or entity exercising the Licensed Rights under this License. Your has a corresponding meaning.
