# END USER LICENSE AGREEMENT
## IMPORTANT: PLEASE READ THIS EULA CAREFULLY. BY INSTALLING OR USING ANY GAME SOFTWARE PROVIDED BY Had2Apps THAT REFERS TO THIS EULA (EACH, A “GAME”), YOU AGREE TO BE BOUND BY THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE GAME.

### 1. Parties and scope
1.1. This EULA is a legal agreement between you (“User”, “you”) and Had2Apps (“Licensor”) regarding any Game that refers to this EULA, including its updates, downloadable content, and related files.
1.2. If you obtained a Game through a third-party platform (e.g., Steam), your use of that Game is also subject to that platform’s terms. As between you and the Licensor, this EULA governs your use of the Game, to the extent permitted by applicable law.

### 2. License and ownership
2.1. License grant
Subject to this EULA, the Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Game for your own entertainment.
2.2. Ownership
The Game and all graphics, audio, text, data and other content included in it (“Assets”) are owned by the Licensor and/or its licensors. The Game is licensed, not sold. You acquire no ownership in the Game or Assets.
2.3. Reservation of rights
All rights not expressly granted to you are reserved by the Licensor.

### 3. Streaming and user content
3.1. Streaming permission
You may record, stream, and upload gameplay videos or screenshots that show the Game in normal use (“User Content”), and you may monetize such content (e.g., ads, subscriptions, donations), as long as you comply with this EULA, applicable law, and platform rules.
3.2. No asset extraction
This permission does not allow you to extract Assets and use them separately as “resources”, “material packs”, or similar. The Game may appear only as part of normal gameplay footage.

### 4. Mods, translation patches, and reverse engineering
4.1. Permission to create Mods
You may create and distribute game modifications and translation patches (“Mods”), **provided that**:
- (a) Mods are distributed only as patch/delta files or packages that do **not** include the Game itself or its Assets in a usable or extractable form;
- (b) Mods require a legitimate, unmodified copy of the Game to function;
- (c) Mods comply with Section 6 (Prohibited uses) and applicable law; and
- (d) Mods are distributed for free, unless you obtain the Licensor’s prior written permission for commercial distribution.
4.2. Reverse engineering for Mods and translations
To the limited extent **technically necessary** to create Mods and translation patches allowed under 4.1, you may analyze, decompile, or reverse engineer the Game.
You must **not**:
- (a) bypass or remove technical protection measures or DRM;
- (b) use reverse-engineered information to create or distribute unauthorized copies of the Game; or
- (c) use it to create cheats or tools that disrupt other players or services.
4.3. Unofficial status and responsibility
- (a) Mod creators are independent from the Licensor. They are not agents, employees, or representatives of the Licensor.
- (b) The Licensor does not review or approve Mods in advance and is not responsible for Mod content or behavior.
- (c) Mods must clearly and prominently state:
“UNOFFICIAL MOD — Not affiliated with or endorsed by Had2Apps.”
- (d) You are solely responsible for your Mods, including all statements and content in or about them.

### 5. AI / Machine Learning use
5.1. No AI/ML training without permission
Unless you have the Licensor’s prior written permission, you may **not**:
- (a) use the Game or its Assets, in whole or in part, to train, fine-tune, or evaluate any machine learning or generative AI model (including but not limited to LoRA or similar techniques);
- (b) collect, extract, label, or compile the Assets into any dataset for AI/ML purposes; or
- (c) distribute any model or dataset that is based on or substantially incorporates the Assets.
5.2. Permission for AI/ML use
Any permission for AI/ML use, if granted, will be given in a separate written agreement. Unless you have such an agreement, you must assume you do **not** have permission.

### 6. Prohibited uses
The following uses are prohibited, unless the Licensor has given you prior written permission:
6.1. Redistribution
- (a) Selling, renting, leasing, lending, sublicensing, or redistributing the Game or any part of it;
- (b) Sharing unauthorized copies, keys, cracks, repacks, or equivalent;
- (c) Making the Game publicly available outside official distribution channels authorized by the Licensor.
6.2. Asset extraction and reuse
- (a) Extracting, ripping, or exporting Assets in a way that allows them to be used outside the Game;
- (b) Uploading or selling Assets (or substantial parts of them) as standalone materials, templates, or resource packs.
6.3. Harmful or targeted content
Using the Game, User Content, or Mods to:
- (a) defame, harass, or unlawfully violate the rights of real persons;
- (b) incite or promote violence, hatred, or persecution against real individuals or identifiable groups (e.g., based on nationality, ethnicity, religion, or political position); or
- (c) turn the Game primarily into a tool for attacking real persons or groups in the real world.
6.4. Unlawful use and platform violations
Any use that is illegal under applicable law or violates the rules of the platform where the content is distributed.

### 7. Updates, enforcement, and termination
7.1. Updates and changes
The Licensor may provide patches or updates and may change or discontinue features of the Game at any time.
7.2. Enforcement and takedowns
If you violate this EULA, the Licensor may request removal of content, report violations to platforms, and use legal procedures (including DMCA takedowns where applicable).
7.3. Termination
This EULA is effective until terminated. Your rights under this EULA end automatically if you materially breach it. Upon termination, you must stop using the Game and uninstall/delete all copies under your control, to the extent technically feasible.
Sections that by their nature should survive termination (including Ownership, Disclaimers, Limitation of Liability, Governing Law and Jurisdiction) will survive.

### 8. Disclaimers and limitation of liability
8.1. No warranty
To the maximum extent permitted by applicable law, the Game is provided “AS IS” and “AS AVAILABLE”, without any warranties, whether express, implied, or statutory (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement).
8.2. Limitation of liability
To the maximum extent permitted by applicable law:
- (a) the Licensor is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption;
- (b) the Licensor’s total liability for all claims relating to the Game or this EULA shall not exceed the amount you paid for the Game (if any) in the twelve (12) months before the event giving rise to the claim.
Nothing in this EULA excludes or limits the Licensor’s liability for willful misconduct or gross negligence where such exclusion or limitation is not permitted under applicable law, including the Consumer Contract Act of Japan.

### 9. Governing law and jurisdiction
This EULA is governed by the laws of Japan, without regard to conflict-of-law principles.
Any dispute arising out of or relating to this EULA or the Game shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless mandatory law provides otherwise.

This EULA is written in English. If a translation is provided, the Japanese version will prevail to the extent permitted by law.
This EULA constitutes the entire agreement between you and the Licensor regarding the Game.
