End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you (your name or your company's name) and Chibum Ltd, a company registered in Brazil, with trade name Chibum ("Licensor"), for the game titled "Web Host Simulator" ("Game").
1. Grant of License
1.1. The Licensor grants you a non-exclusive, non-transferable, and revocable license to use the Game solely for personal purposes.
1.2. Commercial use of the Game is strictly prohibited unless you have acquired a specific commercial license from the Licensor. However, you are permitted to use the Game for content creation that generates revenue, such as streaming, videos, posts, and other forms of online media, provided that these activities comply with the terms of this Agreement and do not involve the sale or distribution of the Game itself. Any other use of the Game in a commercial setting, including but not limited to training centers, public events, or other revenue-generating activities that are not content creation, requires obtaining a commercial license.
2. Restrictions on Use
2.1. You may not:
- (a) modify, adapt, translate, decompile, disassemble, or reverse engineer the Game;
- (b) copy, distribute, rent, lease, or sublicense the Game;
- (c) use the Game for any illegal or unauthorized purpose;
- (d) exploit any bugs, cheats, or other faults in the Game to gain unfair advantages;
- (e) create or use mods that alter the functioning of the Game during online sessions. The use of mods or cheats in online sessions may result in banning or suspension of access to the Game.
3. Online Features
3.1. The Game includes online features that allow interaction with other users and access to online resources. You agree to use these features in accordance with applicable laws and the guidelines set by the Licensor.
3.2. The Licensor reserves the right to monitor and moderate online interactions to ensure a safe and respectful environment. Any abusive, offensive behavior, or violations of the Licensor’s guidelines may result in suspension or banning of access to online features.
3.3. You agree that all communications and content generated by you in the Game, including chats, messages, and posts, may be monitored and recorded by the Licensor to ensure compliance with this Agreement.
4. User-Generated Content
4.1. The Game may allow you to create and share content, such as mods, skins, or other contributions. By creating and sharing such content, you grant the Licensor a perpetual, irrevocable, worldwide, royalty-free license to use, modify, distribute, and display this content in connection with the Game.
4.2. You warrant that the content you generate does not infringe any third-party rights, including intellectual property rights, and that you are either the owner or have permission to grant the rights mentioned in clause 4.1.
4.3. The Licensor is not responsible for any user-generated content that uses real-world brands within the Game. Real-world brands presented in the Game have no responsibility for user-generated content.
5. Updates and Patches
5.1. The Licensor may provide updates, patches, and other modifications to the Game. These updates may be installed automatically, and you agree to accept such updates as part of your continued use of the Game.
5.2. The Licensor is not obligated to provide ongoing support or maintenance for the Game but may choose to discontinue support at any time.
6. Intellectual Property
6.1. All intellectual property rights related to the Game, including copyrights, trademarks, and patents, belong to the Licensor or its licensors.
6.2. You do not acquire any ownership rights over the Game, and any use of the Game outside the scope of this Agreement will be considered a violation of the Licensor’s intellectual property rights.
7. Disclaimer of Warranties and Limitation of Liability
7.1. The Game is provided "as is" without any warranties of any kind. The Licensor does not guarantee that the Game will be free of errors or interruptions. Under no circumstances will the Licensor be liable for any direct, indirect, incidental, special, or consequential damages related to the use of the Game.
7.2. The Licensor is not responsible for any technical issues, data loss, or other damages resulting from the use of online features of the Game.
8. Data Protection and Privacy
8.1. The Licensor is committed to protecting your personal data in accordance with the General Data Protection Law (LGPD) of Brazil, the General Data Protection Regulation (GDPR) of the European Union, and the American Data Privacy and Protection Act (ADPPA).
8.2. By using the Game, you consent to the collection, use, and processing of your personal data as described in the Licensor’s Privacy Policy. Your data may be used for operation, analysis, and improvement of the Game, as well as to comply with legal obligations.
8.3. You have the right to access, correct, or request the deletion of your personal data according to applicable laws. To exercise these rights, contact the Licensor as described in the Privacy Policy.
9. User Feedback
9.1. Any feedback, suggestions, ideas, or other communications you submit to the Licensor related to the Game become the Licensor’s exclusive property. The Licensor may use, modify, and distribute this feedback without any obligation for compensation or acknowledgment.
10. Termination
10.1. The Licensor may terminate this Agreement at any time if you violate its terms. In the event of termination, you must uninstall and destroy all copies of the Game in your possession.
10.2. The Licensor may also terminate access to online features without prior notice if you violate conduct guidelines or this Agreement.
11. Changes to the Agreement
11.1. The Licensor reserves the right to modify this Agreement at any time. Any changes will be effective immediately upon posting the updated version.
11.2. Your continued use of the Game after changes will be considered acceptance of the new terms.
12. Governing Law and Jurisdiction
12.1. This Agreement will be governed and interpreted in accordance with the laws of Brazil. Any disputes related to this Agreement will be resolved in the competent courts of Brazil.
13. Acceptance
13.1. By installing or using the Game, you agree to the terms of this Agreement.
