IMPORTANT: BEFORE YOU DOWNLOAD/INSTALL THE SOFTWARE, READ THE LICENSE AGREEMENT CAREFULLY AND THOROUGHLY.

1. LICENSE
This Agreement is between You ("You", "you") and the Developer Pawel Zajac ("Artbarian Games", "mine", "me", "Developer").
Dark Roll: Free Kick Challenge is a service ("Game", "The Game","Dark Roll: FKC", "Service", “The Service", “Software”) operated by the Developer.

By installing or using Dark Roll: FKC you agree to this End User License Agreement ("Agreement", "EULA"), confirming that it is a legally valid and binding contract for you. You agree to abide by the intellectual property laws and all of the terms and conditions of this Agreement.

If you do not agree to any of the terms and conditions set forth in this EULA, you may not install or use the Dark Roll: FKC software.

2. LIMITATION OF RESPONSIBILITY
You will indemnify and defend the Developer against any and all claims, demands, proceedings and costs resulting from your use of The Game. To the maximum extent permitted by law, in no event or circumstance (including, without limitation, negligence) will the Developer be liable for any consequential, indirect, incidental, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of information or data, business interruption, loss of use or pecuniary loss), in connection with, resulting out of or related to this Agreement, use of The Game or inability to use The Game or any other circumstances whether based upon contract, or any other theory including negligence. This includes, but is not limited to, any damages arising from your use of third-party software, hardware or services in conjunction with The Game, or any damages arising from the interruption or cessation of The Game or any of its features, whether due to technical issues, maintenance or otherwise. This limitation of liability also applies even if the Developer has been advised of the possibility of such damages.

3.UPDATES
Artbarian Games may provide you with patches, updates or modifications to Dark Roll: FKC. You understand that certain updates and modifications may be required in order to continue the use of The Game. You agree that Artbarian Games may stop to support previous versions of The Game upon availability of an updated version. However, please note that these updates or modifications are not guaranteed to be error-free or compatible with your device or operating system. Artbarian Games will not be liable for any damages that may result from the installation or use of these updates or modifications. Additionally, the Developer reserves the right to change, at any time, the way achievements, collectibles, items, or other in-game elements are obtained in The Game.

4. DATA SHARING, COLLECTION, AND PRIVACY POLICY
Using The Game, you understand and agree that The Game may collect and share data with other players via multiplayer matches or leaderboards, as well as with the Developer (numerical data used for research, analytics, and other applications). The data shared may include, but is not limited to, your game statistics, your ID, your player name, and your profile picture. Additionally, The Game stores game progress and match history information for each player.
By accepting this Agreement, you allow the data to be shared with other players, the Developer, and with Steam. Steam's Privacy Policy applies to the data collected and shared through their platform.
In case you decide you no longer want your data stored/visible on leaderboards, you can contact the Developer at artbariangames@gmail.com to request removal of your data.

The Developer retains the right to retain certain data for a period of time for statistical purposes and game improvement. However, such data will not be disclosed to any third party without your explicit consent, except where required by law. The Developer takes reasonable steps to ensure the security and integrity of the data collected and shared, but cannot guarantee that the data will be completely secure from unauthorized access, use, or disclosure. By using The Game, you acknowledge and accept the risks associated with the collection and sharing of data as described in this section.

5. ONLINE MULTIPLAYER
The Developer cannot guarantee that multiplayer modes in The Game will be accessible all the time. You understand that multiplayer modes may sometimes be unavailable or even permanently discontinued at any time in the future, without prior notice to you. Keep this in mind, especially if you decide to obtain any paid DLC or paid item for The Game, as potential discontinuity of online multiplayer does not give you the right for a refund from the Developer. However, Steam's refund policy applies to purchases made through their platform.

Although the Developer will do their best to ban every player who consciously acts in an unfair/harmful way, Artbarian Games is not responsible for any players who may cheat against you, ruin your gameplay experience, or cause you any damages. If you encounter an unfair player, feel free to report them at artbariangames@gmail.com.

6. WARRANTIES
Except if expressly stated in writing and signed by the Developer, the Developer makes no warranties in respect to The Game and expressly excludes all other warranties, implied or expressed, including, without limitation, any implied warranties of merchantable quality or fitness for a particular purpose.

7. GOVERNING LAW
This Agreement is to be governed by the law of Poland. You therefore irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Poland. Any unlawful provision, or otherwise considered unenforceable shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.

8. TERMINATION AND SANCTIONS
This License is valid unless terminated by Artbarian Games or you. In case of the Terms violation or any other inappropriate behaviour (including but not limited to changing the source code of The Game, using cheats, harassing players or doing any activities prohibited by law). Your online conduct should be guided by common sense and respect for others who access and use The Game. The Developer may limit or terminate your access to the Online Multiplayer part of The Game at any time.

The sections "Termination and Sanctions", "Data Sharing" of this Agreement are still in place after the termination.
