Ethyrial: Echoes of Yore - Terms of Service

Welcome to Ethyrial: Echoes of Yore, an online game developed by Gellyberry Studios AB ("Gellyberry," "we," "us," or "our"). Please read these Terms of Service ("Terms") carefully before accessing or using our game, as they constitute a legally binding agreement between you and Gellyberry Studios AB. You represent that you are
1. Limited License to Use the Service
Subject to your compliance with these Terms, Gellyberry grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use Ethyrial: Echoes of Yore and its related services, solely for your personal and non-commercial purposes. This license terminates if you do not maintain an active subscription to the game through the Steam platform. By accessing or using Ethyrial: Echoes of Yore, you represent and warrant that you are at least the age of majority in your jurisdiction or, if you are under the age of majority, that you have the consent of your parent or legal guardian to access and use the game. In any case, you affirm that you are at least 13 years of age. If you are under the age of 13, you are not permitted to access or use Ethyrial: Echoes of Yore or provide any personal information to us. Gellyberry Studios AB reserves the right to terminate any accounts or access to the game for users who are found to be under the age of 13 or unable to provide proof of parental or legal guardian consent if required.
2. Code of Conduct
As a player of Ethyrial: Echoes of Yore, you agree to follow these rules:
a. You will not harass, threaten, or harm any player or staff member.
b. You will not use any third-party software or tools to cheat, exploit, or gain unfair advantages in the game.
c. You will not impersonate any person, entity, or Gellyberry representative.
d. You will not engage in any form of advertising, soliciting, or selling within the game.
e. You will not share or disseminate any illegal, offensive, or inappropriate content within the game.
f. You will not attempt to reverse-engineer, disassemble, or modify the game software in any way.
g. You will not violate any applicable law.
Violation of these rules may result in suspension, termination of your account, or legal actions, at our sole discretion.
3. Virtual Currency and Items
Ethyrial: Echoes of Yore may include virtual currency and items, which can be earned through gameplay or purchased using real money. You acknowledge and agree that you have no ownership rights to any virtual currency or items, and they are licensed, not sold, to you. Gellyberry reserves the right to manage, regulate, control, modify, or eliminate virtual currency and items at its sole discretion, without any liability to you.
4. Disclaimer of Warranties and Limitation of Liability
To the extent permitted by law, Ethyrial: Echoes of Yore and its related services are provided on an "as-is" and "as-available" basis, without warranties of any kind, express or implied. Gellyberry disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Gellyberry does not warrant that the game will be error-free, uninterrupted, or secure.
In no event shall Gellyberry, its affiliates, directors, employees, licensees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the game, even if advised of the possibility of such damages.
5. Indemnity
You agree to defend, indemnify, and hold harmless Gellyberry, its affiliates, directors, employees, licensees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of Ethyrial: Echoes of Yore, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
6. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in the State of Alabama for the resolution of any disputes arising from or relating to these Terms, the game, or its related services.
7. Termination
Gellyberry reserves the right to terminate your access to and use of Ethyrial: Echoes of Yore, in whole or in part, at any time, without prior notice, for any reason or no reason, including but not limited to your violation of these Terms, the applicable law, or if we determine, in our sole discretion, that your use of the game is harmful to our interests or the interests of other players. Upon termination, you must immediately cease all use of Ethyrial: Echoes of Yore and its related services.
8. Changes to the Terms of Service
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any significant changes by posting the updated Terms on our website or in the game. Your continued use of Ethyrial: Echoes of Yore following any changes to the Terms constitutes your acceptance of those changes.
9. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
10. Waiver
No failure or delay by Gellyberry in exercising any right or remedy under these Terms shall operate as a waiver of such right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise thereof or the exercise of any other right or remedy.
11. Assignment
Gellyberry may assign its rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. You may not assign your rights or obligations under these Terms without our prior written consent.
12. Entire Agreement
These Terms constitute the entire agreement between you and Gellyberry regarding your use of Ethyrial: Echoes of Yore and supersede any prior or contemporaneous understandings or agreements, whether written or oral, between you and us regarding the subject matter hereof.
