END USER LICENSE AGREEMENT
Regarding Alpha Particle (computer game)
Issued by Bruce Nicou of Function Unknown Studio (fustudiosa.com)
This End User License Agreement applies to and governs all use of the software product Alpha Particle created by Bruce Nicou (“Function Unknown”) and is a valid agreement between you and Function Unknown.
Please read this EULA carefully, as it sets out the foundation for the license of this Software.
Before you download the Game , you will be asked to agree to the provisions of this EULA.

1. Definitions
1.1. “EULA” refers to this End User Licence Agreement, including any amendments made to it in the future.
1.2. “FU Studio” , “Function Unknown” , “Licensor”, “we” or “us” refers to Bruce Nicou which is the creator and owner of this software.
1.3. “Game” , “Software” or “Alpha Particle” refers to the software product named 'Alpha Particle' created and owned by FU Studio including the demo version, all updates and upgrades.
1.4. “You” or “User” refers to you the Licensee, the person agreeing to this contract.
2. Intellectual Property Rights (Ownership)
2.1. Nothing in this EULA hands over, gives ownership, transfers or constitutes an assignment of any Intellectual Property Rights from the Licensor.
2.2. You, through your downloading, installing or use of this Software do not acquire any ownership rights to the Game. The Game as set out in this EULA is licensed, not sold, to You by FU Studio.
2.3. You may not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary notices, legends, symbols or labels in the Game. This EULA does not authorize you to use FU Studio's name nor the Game's name (Alpha Particle) except where otherwise stated on this EULA or if permission is granted directly by FU Studio.
2.4. FU Studio is the owner of all rights, titles and interests in and to the Game (including all copyrights, trademarks and patents) regardless of the media or form of the Game, whether online, by disk or otherwise.
2.5. You may not, at any time during or after the effective term of this EULA, dispute or contest, directly or indirectly, FU Studio's exclusive right and title to the Game or the validity thereof.
3. Term
3.1. This EULA shall come into effect when the User agrees to the terms during installation of the Game. Using this Software and/or having it installed on a User's device will also render the contract effective.
3.2. If you do not agree with the terms of this EULA, you may not use, download or install the Game and You and must destroy any copies you may have.
4. License grants
4.1. You are granted a personal, limited, non-exclusive, non-transferable license to install and use the Game for your personal use solely as set forth in this License and only one copy on one device owned by the User is permitted at any given time.
4.2. FU Studio grants You a license to publicly display the Game on online video and streaming websites, such as but not limited to YouTube.com and twitch.com, and social media, such as but not limited to twitter.com, provided it is done in a respectable manner. FU Studio may terminate or modify the scope of this license at any time without notice or compensation and will not be liable to You or any third party for any loss incurred relating thereto.
4.3. If You are a content creator or You are a site administrator of a fan based website You may display the Game, as well as content created by the Game including any logos of the Game or the game studio Function Unknown only as expressly stated in this EULA, provided it is done in a respectable manner. FU Studio may terminate or modify the scope of this license at any time without notice or compensation and will not be liable to You or any third party for any loss incurred relating thereto.
4.4. The User may permit family members and friends of the User to use the User's installation of the Game on the User's single allowed device only. The User must not allow any other person or persons to use the Game.
5. License limitations
5.1. Any commercial use is prohibited unless permission is granted directly by FU Studio.
5.2. You are expressly prohibited to sell, resell, rent, lease, loan, license, sub-license, gift, supply, transfer, publish, distribute or redistribute the Game.
5.3. You may not (do or attempt) de-obfuscate, modify, alter, edit, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works from the Game.
5.4. You may not make the Game available over a network where it could be downloaded by other users.
5.5. The User may not exploit the Game commercially or use the Game for providing any services including but not limited to using the Game at an internet café or computer gaming centre.
5.6. The User may not use the Game for anything regarding marketing, advertising or promotional purposes.
5.7. The User may not delete, disable, remove or circumvent any security protection measures or documentation notices in or associated with the Game.
5.8. This Game and all services provided may be used for lawful purposes only.
6. Termination
7.1. This EULA shall immediately and automatically be terminated if the User commits any breach of this EULA.
7.2. Inappropriate usage i.e. distasteful, abusive or any form of damage causing act to anyone regarding the use or display of the Software will cause a breach in this EULA and it is entirely and completely up to FU Studio's discretion as to what inappropriate usage is. A breach in this way will terminate this EULA.
7.3. If You have not acquired the Game legally then it is considered a breach of this EULA and You may not use this Software and must destroy it.
7. Termination effects
7.1. Except to the extent that this EULA expressly provides otherwise, the termination of this EULA shall not affect the accumulated rights of either party.
7.2. All licences granted to the User under section 5 (License grants) in this EULA shall terminate upon the termination of this EULA.
7.3. The User must destroy and delete all copies of the Game and all copies of all other works and materials licensed to the User under this EULA in the possession and/or control of the User.
8. Disclaimer
8.1. This Game, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether expressed or implied. The user must assume all risk of using the program.
8.2. Making games is a complex task and as such FU Studio can not guarantee a bug free Game.
8.3. In no event shall FU Studio, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive, or any other damages whatsoever relating to the use of the Game.
9. Other
9.1. Even if any provision of this EULA is proved to be invalid, illegitimate, or impossible to be enforced, the rest of the provisions shall not be affected or damaged therefrom.
