Licence for Knights of the Chalice 2 Full Version (‘the software’)
PLEASE READ THIS SOFTWARE LICENCE AGREEMENT BEFORE USING THE SOFTWARE. By using the software, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, cancel the installation and destroy the software and related documentation.
1. Grant of Licence. HeroicFantasyGames.com grants you a non-transferable and non-exclusive licence to install and use the software. You may install the software on more than one computer provided that there is no chance that it will be used simultaneously on more than one computer. You may make as many copies of the software as you need for backup purposes only.
2. Spyware Policy. The software does not contain adware or spyware of any kind. It does not install any tracking software on your system, or collect personal information about you. The software does not come bundled with any third party software. Personal information given to HeroicFantasyGames.com will not be given to any third parties.
3. Restrictions. You may not disassemble, decompile or reverse engineer the software or attempt to extract the software's source code. You may not modify the software or create derivative works based on the software or parts of it without the written consent of HeroicFantasyGames.com. You may not remove proprietary notices from the software. You may not resell or transfer rights to the software. You may not exploit the software or use it for commercial purposes by any means. You may not use the Module Editor for commercial purposes, unless a specific agreement has been concluded with HeroicFantasyGames.com.
4. Distribution of the Software. You may not distribute Knights of the Chalice 2 Full Version in any form, including but not limited to Internet distribution. You may not distribute modifications of the Full Version. This includes, but is not limited to, changes in database, modules, maps, levels, scenarios, campaigns, scripts, items, spells, creatures, quests, missions, music, sound effects and graphics.
5. Use of the Module Editor. The software includes a Module Editor that allows you to create custom modules, maps, levels, scenarios, campaigns, scripts, items, spells, creatures, quests, missions and other materials for use in connection with the software. You acknowledge and agree that all modules, maps, levels, scenarios, campaigns, scripts, items, spells, creatures, quests, missions and other content created or modified using the Module Editor are and shall remain the sole and exclusive property of HeroicFantasyGames.com. You hereby assign to HeroicFantasyGames.com all of your rights, title and interest in and to all content created or modified using the Module Editor. HeroicFantasyGames.com may use your contributions for any purpose. HeroicFantasyGames.com may modify your contributions and distribute them to the public by any means without any further notice or compensation to you of any kind. You hereby waive any moral rights of paternity, publication, reputation or attribution. The licence grant to HeroicFantasyGames.com and the above waiver of any applicable moral rights shall survive any termination of the licence. You agree that you will not contribute any content that is unlawful, tortious, defamatory, obscene, invasive of the privacy of another person, threatening, harassing, abusive, hateful, racist or otherwise objectionable or inappropriate. You agree that your contributions and the compilation, arrangement or display of your contributions will not infringe any copyright, trademark, patent, trade secret or other intellectual property right of any third party.
6. Distribution of User-Created Modules. You may not distribute user-created modules that are being sold by HeroicFantasyGames.com online or through any outlet. You may not distribute user-created modules that are planned for commercial distribution. You may distribute user-created modules that are being distributed for free by HeroicFantasyGames.com. If there is any doubt concerning module distribution, please contact HeroicFantasyGames.com. You agree to use the website www.heroicfantasygames.com and any other websites explicitly approved by HeroicFantasyGames.com as the main portals for the uploading, downloading and distribution of user-created modules.
7. Intellectual Property Rights. This licence does not grant any ownership in the software. HeroicFantasyGames.com shall retain the ownership, title, rights and intellectual property rights, including but not limited to copyright, patent, trade secret and all other intellectual property and proprietary rights worldwide, to the software and its related documentation. HeroicFantasyGames.com shall retain the intellectual property rights to any sound, music, animations, images and text incorporated into the software, with the exception of the few sounds and images not owned by HeroicFantasyGames.com and used in the software. The software is protected by copyright laws and international treaties.
8. Disclaimer of Warranty. You expressly agree that use of the software is at your own risk. HeroicFantasyGames.com shall not be liable for any indirect or direct damage resulting from the use of the software, including but not limited to the loss of data. The software and related documentation is provided ‘as is’ and without warranty of any kind. HeroicFantasyGames.com expressly disclaims all warranties, implied or express, including but not limited to the implied warranty of fitness for a particular purpose. HeroicFantasyGames.com does not warrant that the software will meet your requirements or that the software’s operation will be error-free or uninterrupted, or that defects will be corrected. HeroicFantasyGames.com does not warrant the reliability, accuracy or correctness of the software and related documentation. No written or oral information given by HeroicFantasyGames.com shall create a warranty or increase the scope of this warranty.
9. Limitation of Liability. Under no circumstances shall HeroicFantasyGames.com be liable for any consequential, special or incidental damages resulting from the use of the software or the inability to use the software, even if HeroicFantasyGames.com has been advised of the possibility of such damages. Under no circumstances shall the total liability of HeroicFantasyGames.com to you for all losses and damages exceed the amount paid by you for the software.
10. Termination. This licence shall terminate immediately without notice from HeroicFantasyGames.com if you fail to comply with any provision of the licence. Upon termination, you must destroy all copies of the software and its related documentation.
11. Controlling Law and Severability. This Licence Agreement shall be governed by the laws of England and Wales, without giving effect to principles of conflict of laws or the United Nations Convention on the International Sale of Goods. Should any provision in this Licence be invalidated by a court of competent jurisdiction, this invalidity shall not affect the remaining portions of the Licence.
12. Export Restrictions. You may not use, export or re-export the software except as allowed by United Kingdom law and the laws of the jurisdiction in which the software was obtained.
13. Complete Agreement. This Licence constitutes the entire agreement between the parties with respect to the use of the software and related documentation. It supersedes all prior agreements, oral or written, regarding the subject matter. HeroicFantasyGames.com reserves the right to change the terms of this licence. Such changes will be posted on www.heroicfantasygames.com.
14. Reservation of Rights. All rights not expressly granted in this Licence are reserved by HeroicFantasyGames.com.
