Thank you for applying for the access to the online service of Extremely Realistic Siege Warfare Simulator (hereinafter referred to as “the game”) provided by Screambox Studio (Screambox, or “us”, or “we”, or “our”). To safeguard your (hereinafter referred to as “you”, “your”, or “End User”) rights, we recommend that you carefully read this agreement before accessing and playing the game, and related services (hereinafter referred to as “game services”).
By accessing, installing, copying, or otherwise using the game services (included but not limited to online services, Workshop, etc), you agree to be bound by the terms of this EULA.
Terms of this EULA may change in the future affected by the game’s status. We will keep you informed by releasing announcements. You agree that your use of the game and services acknowledges that you have read this agreement, understand it, and agree to be bound by its terms and conditions. If you do not agree to the terms of this EULA, you may not access or use services stipulated in this EULA.
To enter into this license agreement, you must be an adult of the legal age of majority in your country of residence.
You are legally and financially responsible for all actions using or accessing our game and services, including the actions of anyone you allow to access to your account. You affirm that you have reached the legal age of majority, understand and accept this agreement (including its dispute resolution terms).
If you are under the legal age of majority, your parent or legal guardian must consent to this agreement.
1.Definitions
a)Extremely Realistic Siege Warfare Simulator: is a physics-based tactical strategy game created by Screambox Studio. (Hereinafter referred to as “the game”)
b)Game Services: mean all the game related services provided by us to you including online services, Workshop, etc.
c)Worshop: Woroshop, based on the Sandbox Mode in the game, allows users to create customized contents like levels, maps, and units. Contents created by users can also be shared with others.
d)Online Services: Online Services is based on the Multiplayer Mode in the game that allows users to play with others via the Internet.
e)You: also referred to as “your”, or “User”, or “End User”, persons who are authorized to access the game and services.
2.Grant of License
THIS GAME IS LICENSED TO YOU, NOT SOLD. Ownership to the game and all intellectual property rights in and to it remains at all times the property of Screambox and, as applicable, its licensors.
Subject to your compliance with the terms and conditions of the Agreement, we hereby grants you a non-exclusive, non-transferable, limited, fully revocable right and license to install, access and use (and to let members of your family or household to use) the Game on your personal computer, strictly for non-commercial purposes only. You may install the Game on different computers, but may only run the Game on one computer at a time.
Unless otherwise provided in this EULA, you shall not:
i) Remove or alter any copyright or trade mark notices on any and all copies of the Game;
ii) Copy, rent, lend, lease, sublicense or distribute the Game other than as may be permitted according to applicable law;
iii) Remove, disable or circumvent any security protections such as digital rights management, proprietary notices or labels contained on or within the Game;
iv) Modify, adapt, translate, reverse engineer, derive source code from, disassemble, decompile or create derivative works of the Game, other than may be permitted according to applicable law;
v) Use, develop, distribute or sell cheats, automation software (bots), hacks or any other unauthorized third-party software designed to modify the Game;
vi) Exploit the Game or any of its parts for any commercial purpose.
3.Collection and Use of Information
We may collect information from you when you use the Game. Such information includes your SteamID, computer configuration, gameplay behavior and progress, browser type, platform type and software usage.
We may use the collected information to improve, manage, analyze the game or provide services to you. The information could also be used to support the game and services’ development, management, marketing, promotion, etc.
4.Online Services
The game’s online services are based on the Multiplayer Mode in the game. To access and play this mode, you need to have access to the Internet.
Online services is an auxiliary function to the game. If there are exceptions when you use online services, we have the right to take appropriate measures to tackle with these exceptions, which includes but not limited to suspense your access to online services, for which we are not obliged to compensate or make refund to you.
5.Anti-Malware
Malware refers to software, program, add-ons, or other forms of computer codes that could affect the game and services’ established rules, mechanics, and environments without our authority, including but not limited to cheating programs and automated software.
We object to any act of using or abetting the use, make, provide, distribute any malwares. We have rights to take appropriate measures against such malwares including but limited to acts like ban users who uses malwares from accessing the game or some services.
6.Intellectual Property and Grand of License about User Generated Content
i)Users can create content, upload, and share them in and via Sandbox Mode and Workshop in this game.
ii)Content generated by users in with the game is called UGC.
iii)You hereby grant Sreambox and its affiliates a nonexclusive, irrevocable, royalty-free, sublicensable, perpetual right to use, reproduce, modify, create derivative works from, distribute, transmit, broadcast, and otherwise communicate, publicly display and publicly perform your UGC, and derivative works of your UGC, in connection with the operation and promotion of the Game.
iv)We have rights to review, publish, and manage UGC contents. We reserve the final interpretation rights to measures we take upon the UGC contents, and you understand that we may restrict, or remove, your UGC for any reason.
v)You represent and warrant that the UGC, and your grant of rights in such UGC, does not violate any applicable contract, law or regulation, and that the UGC is your original work and does not infringe any third party´s intellectual property rights or any other rights, which includes but not limited to:
a)Breaking any laws
b)Disclosing any info that endanger national security
c) Inciting hatred and discrimination against any nation and race
d)Preaching superstition and beliefs of cults
e)Spreading rumors to endanger social security
f) Spreading obscenity, violence, and gambling. Abetting crimes.
g)Insult and slander others and violate others’ legal rights.
h)Others prohibited by national laws and regulations.
vi)We specifically disclaim any liability with regard to User Generated Content.
vii)Anyone who believes that their original work has been reproduced as UGC through our game in a way that constitutes copyright infringement may notify us by sending an email to gx@screambox.net.
7.Update of These Terms
We may amend this EULA from time to time by posting a prominent notice on the game’s steam page or via other way like email.

9.Dispute Resolution
i)You agree that this EULA shall be deemed to have been made and executed in People’s Republic of China and any dispute arising under this EULA shall be resolved in accordance with the laws of People’s Republic of China.
ii)If any of content in this agreement contradicts with the laws, taking law as the criterion. Contradicted content or terms should be remodified or reinterpreted according to the laws. The balance of this agreement shall remain in effect and be construed in accordance with its terms as if the invalid, unenforceable, or illegal provision had not been included.
iii)You and us agree that we should settle any controversies through friendly negotiation. If the negotiation is to no vail, we’ll settle through courts.
Screambox Studio reserves the rights of final interpretation. Terms of this agreement apply to all acts of your using of the game.
By accessing, installing, copying, or otherwise using the game services (included but not limited to online services, Workshop, etc), you agree to be bound by the terms of this EULA.
