License Agreement
for the use of computer game “Smerch Battle Arena”
Effective Date: November 30, 2025
Last Revision: November 29, 2025
1. Definitions
Rights Holder: company Smerch Games.
User: individual who accepts the terms of this Agreement.
Game: computer game “Smerch Battle Arena”, including all updates, add-ons, and accompanying materials.
License: right to use the Game within the boundaries established by this Agreement.
In-game Progress: cumulative achievements, levels, resources, items, and other in-game assets acquired by the User while using the Game.
Account: personal User account created upon registration, containing identifying data and information about in-game progress.
User Content: any materials created by the User within the Game (texts, images, interface modifications, game constructs) posted in publicly accessible areas of the Game or on official Rights Holder’s platforms.
Cheats: software tools, algorithms, or methods enabling unplanned advantages in the Game (faster resource acquisition, circumventing restrictions, changing game settings), including bots, scripts, and other automated utilities.
2. Subject Matter of the Agreement
The Rights Holder grants the User a non-exclusive, non-transferable license to use the Game subject to the terms outlined hereinafter.
3. Rights and Restrictions
User is Allowed To:
Install and launch the Game on their device.
Utilize the functionalities of the Game for private non-commercial purposes.
Create user content within the framework of in-game possibilities.
User is Prohibited From:
Decompiling, modifying, or reverse-engineering the Game code.
Distributing, leasing, or sublicensing the Game.
Using the Game for commercial purposes without written permission from the Rights Holder.
Applying cheats, bots, hacking tools, or other means that disturb game balance.
Unauthorized access to the Rights Holder’s servers.
Using someone else’s account or transferring your account to third parties.
4. Intellectual Property
All rights to the Game, including trademarks, code, graphics, music, and text, belong to the Rights Holder. Use of these elements is only possible within the scope of the licensed rights.
User-generated content posted in the Game or on the Rights Holder's official platforms remains owned by the User but is granted to the Rights Holder under a free-of-charge non-exclusive license for usage, reproduction, modification, and distribution within the functioning and promotion of the Game.
5. Conditions for Using Online Services
Access to online features requires registering an account. The User is responsible for safeguarding their account credentials and all content published via their account.
The Rights Holder has the right to limit access to the account in cases of rule violations or technical issues. The Rights Holder does not guarantee retention of game progress in instances of breach of Agreement terms by the User or technical malfunctions.
6. Waiver of Warranty
The Game is provided ‘as is’. The Rights Holder makes no warranty concerning:
Uninterrupted operation of the Game;
Absence of bugs;
Meeting User expectations.
7. Limitation of Liability
The Rights Holder assumes no liability for:
Loss of data or game progress, including loss of account.
Indirect losses associated with the use of the Game.
Actions of third parties in online mode, including the use of cheats.
Damage resulting from unauthorized access to the account due to negligence by the User.
8. Updating and Terminating Effectiveness
The Rights Holder retains the right to amend the terms of the Agreement, providing notice to Users 14 days beforehand.
The Agreement ceases effect upon removal of the Game or breach of its terms by the User.
When the license expires, the User must remove the Game from all devices and stop using the account.
The Rights Holder can block the account and annul game progress if evidence emerges of cheat-code use or other violations.
9. Governing Law and Dispute Resolution
This Agreement is regulated by the laws of the Russian Federation. Legal disputes are settled in courts situated in the location of the Rights Holder.

By agreeing to the terms of this Agreement, the User confirms that he/she has:
Reviewed the rules and limitations.
Reached the minimum legal age for using the Game in his/her country.
Agreed to abide by all stipulations contained therein.
Acknowledged that the use of cheat-codes will lead to account suspension and loss of game progress.
