### 1. Scope and Subject Matter
1.1 This End User License Agreement (EULA) governs the relationship between the player (hereinafter referred to as the "User") and inferna UG (limited liability) (hereinafter referred to as the "Provider") regarding the use of the online game "Inferna" as well as the associated software and services.
1.2 By installing, registering, or using the game "Inferna," the User agrees to this EULA. If the User does not agree with the provisions of this EULA, they must not install or use the game.
### 2. License Grant and Usage Rights
2.1 The Provider grants the User a simple, non-exclusive, non-transferable, and revocable license to use the game "Inferna" for private, non-commercial purposes. Use is strictly in accordance with this EULA and other legal agreements (e.g., Terms and Conditions and Privacy Policy).
2.2 The User may only install and use the game on devices they own or control.
2.3 The User may not reproduce, copy, sell, rent, lease, transfer, sublicense, or otherwise make the game available to third parties, except where permitted by this EULA or by law.
2.4 The User is not permitted to modify, decompile, reverse-engineer, disassemble, or otherwise attempt to determine the source code of any part of the game or software, unless explicitly allowed by applicable law.
### 3. Intellectual Property Rights
3.1 All intellectual property rights in "Inferna," including but not limited to graphics, designs, texts, software, audio, video, and characters, belong solely to the Provider or its licensors.
3.2 The User does not acquire ownership rights to any content provided within the game or to any online services. All rights not expressly granted to the User in this EULA remain with the Provider.
3.3 The User may not sell or transfer any content or works created within the game or on the Provider's servers (e.g., characters, in-game items) outside of the game.
### 4. Code of Conduct and Misuse
4.1 The User agrees to use the game in compliance with applicable laws, this EULA, and the Terms and Conditions.
4.2 The User is prohibited from performing the following actions:
- Engaging in offensive, discriminatory, racist, or otherwise inappropriate communication in the game or related platforms (e.g., forums, Discord).
- Using cheats, hacks, bots, exploits, or any software that manipulates the game or gives an unfair advantage.
- Exploiting bugs (exploits) for personal gain or to disrupt the experience of other users.
- Using the game or related platforms for commercial purposes without the explicit permission of the Provider.
- Publishing personal data of third parties without their consent.
4.3 Violations of these conduct rules may result in the temporary or permanent suspension of the User's account and/or the deletion of characters and in-game items. There is no entitlement to refunds, compensation, or damages in such cases.
### 5. Premium Services and In-Game Purchases
5.1 The Provider offers paid content in the game, including premium services, items, and subscriptions. All payments are processed exclusively through Steam. The Provider has no access to the User's payment information.
5.2 Refunds for in-game purchases are processed solely through Steam in accordance with their policies. Refunds in cash are excluded.
5.3 The Provider reserves the right to change or adjust the availability, features, and balancing of in-game items and premium services at any time. Compensation will be provided exclusively in the form of in-game currency or items, if necessary. There is no right to a refund in real money.
5.4 If an in-game item or premium service needs to be removed or adjusted due to a technical error or misuse by the User, the User is only entitled to a refund in the form of the originally invested in-game currency, but not in real money.
### 6. Disclaimer of Liability
6.1 The Provider is fully liable for intentional misconduct and gross negligence, as well as for damages arising from injury to life, body, or health.
6.2 In cases of slight negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the typical, foreseeable damage.
6.3 The Provider does not guarantee the availability or error-free functionality of the game and servers. Temporary or permanent outages, server maintenance, bugs, or other technical issues do not entitle the User to claims for damages or refunds.
6.4 The Provider assumes no liability for any loss of data, including loss of game progress, in-game items, or achievements.
### 7. Termination and Account Suspension
7.1 The Provider reserves the right to terminate or suspend the User's access to the game at any time without stating reasons, particularly in cases of violations of this EULA or the Terms and Conditions.
7.2 The User can delete their account or stop using the game at any time. There is no right to a refund for payments made in such cases.
7.3 The Provider reserves the right to delete or adjust the User's content, in-game items, or progress in cases of violations of this EULA or the Terms and Conditions, particularly in cases of misuse or exploitation of bugs and exploits.
### 8. Changes to the EULA
8.1 The Provider reserves the right to change or supplement this EULA at any time with future effect. Changes will be communicated to the User in a timely manner via email or within the game.
8.2 If the User does not object to the changes within four weeks of notification, the changes will be deemed accepted. If the User objects, both parties have the right to terminate the agreement extraordinarily.
### 9. Data Protection
9.1 The Provider processes the User's personal data in accordance with the General Data Protection Regulation (GDPR) and the Provider's privacy policy. Further information can be found in the privacy policy at inferna.net.
### 10. Final Provisions
10.1 The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 The place of jurisdiction for all disputes arising from or in connection with this EULA is Frankfurt am Main, provided the User is a merchant, a legal entity under public law, or a special fund under public law.
10.3 Should any provision of this EULA be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that most closely reflects the economic purpose of the invalid provision.
