This End-User License Agreement (EULA) is a legal agreement between a single entity or individual (you) and the developers of the accompanying software, The Binary Initiative (TBI), regarding your use of the accompanying software (the software). Some components of the software are excluded from this agreement, specifically those components described by the 'Third-Party Licenses' document that also accompanies the software; those components are governed by their own license agreements.

TBI grants you license to install and use the software on a single device. You may install the software on additional devices, but are only permitted to use one installation of the software at a time. You may create backup copies of the software, but you may not distribute these copies to any other individual or entity.

The software is protected by United States copyright law and the copyright law of other countries as applicable. We retain all intellectual property rights in the software. You may not separately publish, sell, market, distribute, lend, lease, rent, or sublicense the software, in whole or part. This agreement does not prohibit or limit any fair use specifically sanctioned by copyright law.

The software is provided "as is", and to the extent permitted by applicable law, we disclaim any implied warranty of merchantability or fitness for a particular purpose. In no event shall TBI be liable for any special, consequential, incidental, or indirect damages whatsoever arising from the use or inability to use the software, even if TBI is aware of the possibility of such damage or known defects.

Some individuals may experience negative side effects, including motion sickness, dizziness, or seizures when exposed to certain patterns of lights or flashing light effects in the software or its related media, even if they have no history of these symptoms or epilepsy. TBI is not liable for any side effects from your use of the software or any results thereof. Your use of the software is at your own risk.

You may not reverse engineer, decompile, or disassemble the software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. TBI may provide updates or other modifications to the software that may require installation to continue use of the software. All references in this agreement to "the software" also include such updates and modifications.

If any part of this agreement is found to be invalid or unenforceable, all remaining terms will remain in effect. This agreement will apply from the date of the installation of the software. Without prejudice to any other rights, TBI may terminate this EULA if you fail to comply with its terms and conditions. In such an event, you must destroy all your copies of the software.
