End-User License Agreement for ILYSIA™

You are agreeing to legal stuff here. You should read it.
This End-User License Agreement (EULA) is a legal agreement between you (either an individual, business or a single entity) and the mentioned author (Team 21 Studio, Inc. or it's predecessors/successors (the Author)) of this Software for ILYSIA™ identified above, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation (ILYSIA™).
By clicking accept, installing, possessing, or otherwise using ILYSIA™, you agree to be bounded by the terms of this EULA.
By accepting this EULA, you represent that you are lawfully able to enter into this EULA and, if you are entering into this EULA for a company or other entity, that you have legal authority to do so and to bind the entity to the terms set forth herein.
If you do not agree to the terms of this EULA, do not install or use the ILYSIA™.
ILYSIA™ LICENSE
ILYSIA™ is being distributed for personal use.
The Author reserves all rights not expressly licensed or otherwise granted under this EULA. Without limiting the generality of the foregoing, to the extent allowed by permissible law, the licenses granted to you hereunder are subject to the following limitations, and you agree to comply with these limitations:
You may NOT reverse engineer, decompile, alter, modify or disassemble the files for ILYSIA™ or any of its components or package contents.
You may NOT reproduce or distribute ILYSIA™.
You may NOT translate, adapt, arrange, or create derivative works based on ILYSIA™ for any purpose.
You may NOT rent, lease or lend ILYSIA™. You may NOT use ILYSIA™ for any unlawful purpose.
GRANT OF USE.
Subject to all restrictions and limitations set forth herein and your compliance with the terms and conditions of this EULA, the Author grants you a limited, non-exclusive, revokable, non-sublicensable, non-transferable license to install and use ILYSIA™ solely for your personal use and in accordance with any included documentation, and solely to participate in the Ilysia test. All licenses are for the object code version of ILYSIA™ (no rights to source code are granted).
COPYRIGHT.
All title and copyrights in and to the ILYSIA™ (including but not limited to any images, code, photographs, clipart, libraries, and examples incorporated into the ILYSIA™), the accompanying printed materials, and any copies of ILYSIA™ are owned by Team 21 Studio, Inc. or it's successors. ILYSIA™ is protected by copyright laws and international treaty provisions. Therefore, you must treat ILYSIA™ like any other copyrighted material.
FEEDBACK
To the extent that you provide the Author with information regarding errors you discover in ILYSIA™, improvements that The Author may make to ILYSIA™ (only The Author is permitted to modify ILYSIA™) or the performance of ILYSIA™ (Feedback), you agree that (a) you will not give Feedback that is subject to license terms that seek to acquire the Author's product, technology, service or documentation incorporating or derived from such Feedback, or any Author intellectual property, to be licensed or otherwise shared with any third party and (b) that the Author may make any use thereof that it considers, in its sole discretion, to be beneficial to its business, including to modify ILYSIA™ or develop new products, without payment or any other obligation to you or any limitation on Author's use thereof.
NO WARRANTIES.
The Author expressly disclaims any warranty for the ILYSIA™. The ILYSIA™and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of ILYSIA™ remains with you. The Author does not warrant that ILYSIA™ will meet your requirements, will be uninterrupted, or will be error-free.
NO LIABILITY FOR DAMAGES.
To the maximum extent permitted by applicable law, in no event shall the Author be liable for any direct, special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, medical, loss of property, mental health or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author is aware of the possibility of such damages and known defects.
TERMINATION
The Author may, without further obligation or liability to you or any other person or entity, terminate this EULA and your license to use ILYSIA™ immediately upon written notice to you (a) if you fail to materially comply with this EULA; (b) if the Author's relationship with any third party from whom the Author licenses software, technology or services used in ILYSIA™ terminates or expires; (c) if necessary in order for the Author to comply with applicable law or a request of a governmental agency; or (d) if the Author determines that your continued use of ILYSIA™ will expose the Author to liability. Upon any termination, cancellation or expiration of this EULA, you shall not have any further right to make any use of ILYSIA™. Upon termination, you shall return all software and documentation, and destroy any remaining non-returnable copies. Any provision of this EULA that by its nature should survive, will survive termination of this EULA.
MISCELLANEOUS
Any dispute regarding this EULA shall be governed by the laws of the State of Delaware, and the parties agree to accept the exclusive jurisdiction of the courts of King County, Washington regardless of conflicts of laws. This EULA will inure to the benefit of and be binding upon the parties, their successors and assigns, except that you may not assign or transfer this EULA without the Author' prior written consent. This EULA shall not be modified except by a separate written agreement signed by duly authorized representatives of the Author.
