END USER LICENSE AGREEMENT
Limited Liability Company «Juvty Worlds», hereinafter referred to as «Administration» publishes this End User License Agreement (hereinafter referred to as «Agreement»), defining the procedure for granting a simple non-exclusive license to use the software «Wild Terra 2: New Lands», which is a public offer contract (official offer) to any interested person who agrees to the terms of this Agreement, and hereinafter referred to as «User».
TERMS AND DEFINITIONS
The Administration - «Juvty Worlds» Limited Liability Company, which is the owner of the exclusive proprietary rights to «Wild Terra 2: New Lands» software.
The Game - «Wild Terra 2: New Lands» software.
Game Client - the client application for use of the Game by the User under a non-exclusive license.
Site - the website is located at https://www.wildterra2.com, which provides information to Users.
Additional features - additional functionality of the Game which may be available to the User under a non-exclusive license.
Early Access - means the User's right to access the Game under a non-exclusive license during the development of the Game (the Alpha-version and beyond).
Confidential Information - is the User's identifying information that allows the User to access his or her part of the Wild Terra 2: New Lands Project. It is not personal information.
SUBJECT OF THE AGREEMENT
Administration grants to User on a non-exclusive license the right to use the Game, as well as additional features, within the limits specified in this Agreement.
This Agreement may be translated into other languages for convenience, but the User hereby agrees that the Russian language version of this Agreement shall govern all of the relations between the User and the Administration. In case of any discrepancies between the Russian version of the Agreement and the translation into any other language, the Russian version shall take precedence.
ACCEPTANCE OF THE AGREEMENT
Unauthentication of the User (registration and login) in the Game or payment by the User to the Administration for the right to access the Game means the full and unconditional acceptance of this Agreement.
USER RIGHTS AND OBLIGATIONS
• The User has the right to reproduce a copy of the Game Client by installing it on their personal computer.
• The User has the right to create an account, create a character and participate in the Game.
• The User may use and publicly distribute the audio-visual information of the Game with the condition that the integrity of the identifiable information is maintained.
• The User must independently take appropriate measures to ensure the security of their registration data and prevent unauthorized use of the Game by the third person.
• The User shall comply with the laws and regulations of the country of residence.
• The User may not use the information services of the Game to disseminate any information about commercial, political, social, or religious associations, as well as their actions in any form. The final assessment of the compliance of information norms of this paragraph remains with the Administration.
• The User are not allowed to use obscene language, profanity, threats of violence or physical violence in real life, slander, discrimination, harassment, defamation or hatred, or the promotion thereof in regards to race, color, religion, creed, sex, sexual orientation, gender identity, national origin, and disability, advertising drugs or their production methods in any form, pornographic materials or storerooms. It's up to Administration to make a final judgment whether the User's posting complies with the rules of this paragraph.
• The User may not use the information services of the Game to violate the rights and freedoms of other Users.
• The User haven't right to disseminate false or misleading information about the game, discuss actions of the Administration, or disseminate personal information of third parties. Final evaluation of the compliance of User's postings with the rules of this paragraph rests with the Administration.
• The User may not modify the Game or its environment to change the functionality of the Game or to take advantage of other Users of the Game.
• The User has no right to use bugs or defects in the game to get game benefits. If the User find bugs in the game, the User must inform the Administration about it in details.
• The User may not sell, offer for sale, or otherwise transfer any content or services from the Game in exchange for tangible or intangible assets outside of the Game.
RIGHTS AND OBLIGATIONS OF THE ADMINISTRATION
• The Administration has the right to unilaterally change the Game without prior notice to the User.
• The Administration has the right to unilaterally change the content of the Site without prior notice to the User.
• The Administration has the right to unilaterally change any information left by the User in the Game and/or on the Site without prior notice to the User.
• The Administration has the right to send informational or technical messages to the User.
• In case of violation of this Agreement, the Administration has the right to unilaterally and for any time limit the User's ability to send messages to other Users in the Game.
• The Administration has the right at any time unilaterally to make any changes in the functional of the Game and related information services at the User.
• The Administration may change the text of this Agreement without further notice to the User at any time.
EARLY ACCESS
• The final release date of the Game and any features or functionality thereof may be changed by the Administration during the development process without notice to the User.
DISCLAIMER OF WARRANTIES
• The game is provided «as is» without warranty of fitness for any use. In no event shall the Administration be liable for any damages, including direct damages and lost profits, even if the Administration has been advised of the possibility of such damages.
• Under any circumstances, the liability of the Administration cannot exceed the amount of income of the Administration received from the payment for the User's access rights to the Game.
DISPUTE RESOLUTION
• In case of disputes between the Administration and the User of this Agreement, the Parties undertake to take all measures to resolve them through negotiations between themselves.
• In case of failure to resolve such disputes through negotiations, shall be resolved by the court at the location of the Administration.
OTHER CONDITIONS
• All matters and conditions not stipulated in this Agreement shall be governed by the applicable laws of the Russian Federation.
• A court ruling that any provision of this Agreement is invalid or unenforceable shall not invalidate or render unenforceable any other provision of this Agreement.
