CLANS TO KINGDOMS END-USER LICENSE AGREEMENT
This end-user license agreement (“EULA”) is a legal agreement between Clans to Kingdoms (hereinafter referred to as “CTK” and consisting of the Developers and Artists that made the video-game named above) and you (hereinafter referred to as “you” or “your”). Please read them. They apply to the video-game named above including both the Demo Version and the Full Version, and any associated media, printed materials, and/or “online” or electronic documentation and the media on which you received it, if any (“game”). The terms also apply to any CTK
• updates,
• additional content,
• supplements,
• Internet-based services, and
• support services
for this game. By installing, copying, or otherwise using the game, you acknowledge that you have read this EULA and agree to be bound by the terms.
IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE GAME.
If you comply with these license terms, you have the rights below.
1. INSTALLATION AND USE RIGHTS:
You may
• install any number of copies of the game on your devices;
• run and play the game Demo Version in any number of your devices;
• run and play the game Full Version on the same number of your devices at a time than the number of game copies you have licensed to you;
• create and make publicly available images and videos of the game through the social media channels in the context of “Let´s Play Videos” as long as copyright and/or game title is properly identified and are not used for any commercial services and/or purpose.
2. LICENSE:
The game is licensed, not sold, to you and members of your family, for personal non-commercial use. CTK grants you a non-exclusive, non-transferable license to use the game, but retains all property rights in the game and all copies thereof. Unless applicable law gives you more rights despite this limitation, you may use the game only as expressly permitted in this EULA. In doing so, you must comply with any technical limitations in the game that only allow you to use it in certain ways. You may NOT
• reverse engineer, decompile or disassemble the game, except and only to the extent that applicable law expressly permits, despite this limitation;
• work around any technical limitations in the game;
• use, develop, distribute or sell cheats, automation game (bots), hacks or any other unauthorized third-party game designed to modify the game;
• remove or alter any copyright or trade mark notices on any and all copies of the game;
• make more copies of the game than specified in this EULA or allowed by applicable law, despite this limitation;
• publish the game for others to copy, unless express consent is given by CTK;
• rent, lease or lend the game;
• transfer the game or this EULA to any third party;
• use the game for any commercial services and/or purpose, including without limitation use at a cyber café, computer gaming center or any other location-based site and/or performing services in exchange for payment outside the game; or
• use the game in a way which is not in compliance with all applicable laws.
3. BACKUP COPY:
You may make any number of backup copies of the game. You may use it only to reinstall the game.
4. SUPPORT SERVICES:
Because this game is licensed on an “as is,” “as available” basis CTK is not obliged to provide support services for it.
5. ENTIRE AGREEMENT:
This EULA, and the terms for updates, additional content, supplements, Internet-based services and support services that you use, are the entire agreement for the game and support services.
6. NO WARRANTY:
THE GAME IS LICENSED ON AN “AS-IS,” “AS AVAILABLE” BASIS YOU BEAR THE RISK OF USING IT. CTK, ITS LICENSORS, LICENSEE AND/OR SUBCONTRACTORS GIVES NO EXPRESS WARRANTIES, GUARANTEES OR CONDITIONS, YOU ARE RESPONSIBLE FOR ASSESSING YOUR OWN COMPUTER AND THE RESULTS TO BE OBTAINED THEREFROM. YOU MAY HAVE ADDITIONAL CONSUMER RIGHTS UNDER YOUR LOCAL LAWS WHICH THIS EULA CANNOT CHANGE. TO THE EXTENT PERMITTED UNDER YOUR LOCAL LAWS, CTK, ITS DEVELOPERS, ARTISTS, LICENSORS, LICENSEE AND/OR SUBCONTRACTORS EXCLUDES THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, REGARDING THE GAME. CTK, ITS DEVELOPERS, ARTISTS, LICENSORS, LICENSEE AND/OR SUBCONTRACTORS ASSUME NO RESPONSABILITY FOR ANY DAMAGES SUFFERED BY YOU, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, ITEMS OR OTHER MATERIALS FROM ERRORS OR OTHER MALFUNCTIONS CAUSED BY CTK, ITS DEVELOPERS, ARTISTS, LICENSORS, LICENSEE AND/OR SUBCONTRACTORS, OR BY YOUR OR ANY OTHER PARTICIPANT’S OWN ERRORS AND/OR OMISSIONS. CTK, ITS DEVELOPERS, ARTISTS AND LICENSORS MAKE NO WARRANTY WITH RESPECT TO ANY RELATED GAME OR HARDWARE USED OR PROVIDED BY CTK IN CONNECTION WITH THE GAME EXCEPT AS EXPRESSLY SET FORTH ABOVE.
7. LIMITATION OF LIABILITY:
You acknowledge and agree that CTK and its licensors shall not assume or have any liability for any action by CTK or its content providers, other participants, or other licensors with respect to conduct, communication, or content of the game. CTK, its developers, artists and licensors shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages resulting hereunder in any manner, even if advised of the possibility of such damages. Except as expressly provided herein, CTK’s, its developers’, artists’ and licensors’ entire liability to you and your exclusive remedy for any breach of this EULA is limited solely to the total amount paid by you for the game, if any. Because some countries do not allow the exclusion or limitation of liability for certain damages, in such countries CTK’s and its licensors’ liability is limited to the extent permitted by law.
8. INDEMNITY:
At CTK request, you agree to defend, indemnify and hold harmless CTK, its developers, artists affiliates and licensors from all damages, losses, liabilities, claims and expenses, including attorneys’ fees, arising directly or indirectly from your acts and omissions to act in using the game pursuant to the terms of this EULA or any breach of this EULA by you.
9. TERMINATION:
Without prejudice to any other rights of CTK, this EULA and your right to use the game may automatically terminate without notice from CTK if you fail to comply with any provision of this EULA or any terms and conditions associated with the game. In such event, you must destroy all copies of the game and all of its component parts.
10. INJUNCTION:
Because CTK would be irreparably damaged if the terms of this EULA were not specifically enforced, you agree that CTK shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to breaches of this EULA, in addition to such other remedies as CTK may otherwise have under applicable laws.
11. GENERAL PROVISIONS:
CTK’s failure to enforce at any time any of the provisions of this EULA shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by CTK of any provision, condition or requirement of this EULA shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

CTK, ITS DEVELOPERS, ARTISTS AND LICENSORS MAKE NO WARRANTY WITH RESPECT TO ANY RELATED GAME OR HARDWARE USED OR PROVIDED BY CTK IN CONNECTION WITH THE GAME EXCEPT AS EXPRESSLY SET FORTH ABOVE.
