This document is an agreement between you and S1T2 ("Company"). The Game is licensed to you only on the condition that you accept all of the terms contained in this End User License Agreement (EULA).
Please read through this document carefully. By copying, installing, downloading, or otherwise using this game software, you agree that you understand it and agree to be bound by its terms and conditions.
If you have not reached the age of majority and/or age permitting you to form a contract in your jurisdiction, you must have a parent of legal guardian read and accept the terms and conditions of this license on your behalf and take full responsibility for compliance with the terms and conditions of this license.
By consenting to this License, downloading and/or using the Game, or allowing it to be downloaded and/or used, you acknowledge that:
a) You are at least 18 years of age or any other legal age required to form a contract in your jurisdiction;
b) You have the right, authority and legal capacity to enter into this License;
c) You have read, understood and agree to be bound by the terms and conditions of this License with respect to yourself and any minor child authorised by you; and
d) You have read, understood and agree to be bound by S1T2’s Privacy Policy available at https://www.s1t2.com.au/disclaimer/ (“Privacy Policy”) with respect to yourself and any minor child authorised by you.
If you do not agree with the terms and conditions of the License and Privacy Policy, then do not download or use the Game and delete any copies installed on your devices. Your agreement with regards to this License becomes effective immediately upon installation and/or use of the Software, and shall end on the earliest date on which you dispose of the Game or S1T2’s termination of this License.
COPYRIGHT
All title, ownership rights and intellectual property rights in and to the Game (including but not limited to any patches and updates) and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, text, dialog, catch phrases, locations, concepts, artwork, animation, sounds, musical compositions, music, audio-visual effects, images, photographs, methods of operation, moral rights, any related documentation) are owned by S1T2.
The Game is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. You acknowledge that S1T2 owns all rights in and to the Game, including, but not limited to worldwide statutory and common law rights associated with:
(a) patents and patent applications;
(b) works of authorship, including copyrights, copyright applications, copyright registrations and “moral rights;”
(c) the protection of trade and industrial secrets and confidential information;
(d) trademarks; and
(e) divisions, continuations, renewals, derivative works, and re-issuances of any of the foregoing, now existing or acquired in the future.
LIMITED USE LICENSE GRANT AND TERMS OF USE
The Game is licensed to you, not sold.
Provided that you fully comply with the terms and conditions of this License, S1T2 grants you, and you accept, the non-exclusive, non-transferable, non-sublicensable, revocable license, during the term, to install, access and use one copy of the Game per device that you own or control, solely and exclusively for your personal use and as permitted by the Terms of Use for the Steam Store. All rights not specifically granted under this License are reserved to S1T2.
Your use of the Software is limited to the rights expressly granted to you by this License. This License does not permit any commercial use which is strictly prohibited. You acknowledge and agree that you shall not use the Game for any purpose other than for non-commercial personal enjoyment, entertainment purposes, and that you shall use the Game in accordance with all applicable laws, rules and regulations.
RESTRICTIONS
1. You may not delete or obscure any copyright, trademark or other proprietary notice on the Game or accompanying printed materials.
2. You may not decompile, modify, reverse engineer, disassemble or otherwise reproduce the Game.
3. You may not copy, rent, lease, sublicense, distribute, publicly display the Game, create derivative works based on the Game (except to the extent expressly permitted in the Editor and End-User Variation section of this Agreement or other documentation accompanying the Game) or otherwise commercially exploit the Game.
4. You may not electronically transmit the Game from one computer, console or other platform to another or over a network.
5. You may not use any backup or archival copy of the Game for any purpose other than to replace the original copy in the event it is destroyed or becomes defective.
Privacy
The collection, use and disclosure, if any, of information collected from you, or a child authorised by you, by S1T2 is detailed in S1T2’s Privacy Policy - that can be found at https://www.s1t2.com.au/disclaimer/- which is incorporated by reference and made an integral part of this License.
Consent to Use of Data
Your access and use of the Game is not private or confidential. You agree that S1T2 may collect and use technical data and related information, including but not limited to technical information about your device, system, application software and peripherals, and use of the Game, that is gathered to facilitate the provision of software updates, product support and other services to you (if any) related to the Game. S1T2 may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services and technologies to you.
Updates
S1T2 may, at its entire discretion, make updates or modifications to certain parameters of the Game to fine-tune its gameplay or for other purposes. These updates or modifications may result in loss of data or progress within the game. S1T2 reserves the right to make these updates or modifications and will not be held liable to you for such updates or modifications and their resulting loss of data or progress. Please note that you may need to update your version of the Game to continue playing.
TERMINATION
This EULA is effective until terminated. You may terminate this EULA at any time by destroying the Game. This EULA will terminate automatically without notice from the Company if you fail to comply with any provisions of this EULA. All provisions of this EULA as to warranties, limitation of liability, remedies and damages will survive termination.
LIMITATION OF LIABILITY
IN NO EVENT WILL THE COMPANY OR ITS EMPLOYEES OR LICENSORS BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR INJURY TO PERSON OR PROPERTY, FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY AND NEGLIGENCE) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF THE COMPANY OR AN AUTHORISED REPRESENTATIVE OF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
DISPUTE RESOLUTION
This EULA is governed by the laws of Australia and you agree to submit any dispute arising out of this EULA to the exclusive jurisdiction of the state courts in New South Wales, Australia and the federal court of Australia.
