LICENSE AGREEMENT AND GUARANTEE FOR THE SOFTWARE OF UNSTOPABLE PUG STUDIO
IMPORTANT: READ ATTENTIVELY. THE PROGRAM DELIVERED WITH THIS AGREEMENT IS PROVIDED TO YOU ON THE CONDITIONS PROVIDED BELOW AND MAKING THE LEGAL AGREEMENT BETWEEN YOU AND THE UNSTOPABLE PUG STUDIO TEAM. USING THIS PROGRAM, YOU THEREBY CONFIRM THE OBLIGATION TO SATISFY TERMS OF AGREEMENT WITH UNSTOPABLE PUG STUDIO.
The PROGRAM is protected by laws of the Russian Federation on an author's right, international treaties on an author's right and other laws.
The program is provided in use on
licenses, and also this Agreement does not transfer a title or the right
property on the Program.
1. License for limited use. Unstopable Pug Studio provides you the non-exclusive, not assigned limited right and the license to use of one copy of the Program only for your personal needs.
2. Property right. All intellectual property rights on the Program (including videos, sound and other contents) and also a title on any copy of the Program belong to the Unstopable Pug Studio company or its licensors, and you do not acquire any property rights or the other rights to the Program, except the limited license specified in paragraph 1 of this document.
YOU HAVE NO RIGHT:
* To copy the program.
* To sell the Program, to lease it or temporary use, to extend, transfer or make available, in whole or in part, to other persons and also to use the Program or any its part for commercial purposes, including, among other things, use in service office, Internet cafe, the centers of computer games or other commercial centers where numerous users can address the Program.
* To make reverse engineering, to receive the source code, to change, decompile or unassemble the Program or its part and to create derivative works on their basis.
* To delete and disconnect any copyright notices and the property rights which are contained in the Program and also to mislead users otherwise.
LIABILITY LIMIT.
UNSTOPABLE PUG STUDIO UNDER NO CIRCUMSTANCES DOES NOT BEAR RESPONSIBILITY FOR THE SPECIAL, ACCIDENTAL OR INDIRECT LOSSES AND DAMAGE WHICH AROSE IN COMMUNICATION BY USE, MALFUNCTION OF THE PROGRAM OR OWNERSHIP OF IT INCLUDING DRAWING PROPERTY DAMAGE, LOSS OF REPUTATION, REFUSAL OR FAILURES OF THE COMPUTER AND ALSO AS FAR AS THE CURRENT LEGISLATION, DAMNIFICATION ALLOWS HEALTH EVEN IF THE UNSTOPABLE PUG STUDIO COMPANY WAS NOTIFIED ON POSSIBILITY OF SUCH LOSSES AND DAMAGE. RESPONSIBILITY OF UNSTOPABLE PUG STUDIO CANNOT EXCEED THE AMOUNT WHICH IS ACTUALLY PAID FOR THE LICENSE FOR THIS PROGRAM. IN SOME COUNTRIES AND JURISDICTIONS RESTRICTION OF TERM OF THE IMPLIED GUARANTEE AND ALSO THE EXCEPTION AND THE LIABILITY LIMIT FOR INDIRECT LOSSES ARE NOT ALLOWED, BOTH THE ABOVE-STATED RESTRICTIONS AND EXCEPTIONS CAN NOT CONCERN YOU. THIS GUARANTEE GRANTS TO YOU THE CONCRETE LEGAL RIGHTS. YOU CAN ALSO HAVE THE ADDITIONAL RIGHTS DEPENDING ON JURISDICTION.
CANCELLATION.
This Agreement is terminated automatically, without prejudice to other rights of Unstopable Pug Studio in case you are not able to comply its condition. In that case you have to destroy all copies of this Program and all its components. Besides, the data which are stored on the Unstopable Pug Studio servers can be also destroyed at the discretion of Unstopable Pug Studio with the prior notice in 30 days on the page of the official blog or the page of news of a product.
EQUITABLE REMEDIES.
As violation of terms of this agreement will cause irreparable damage to the Unstopable Pug Studio company, you agree that Unstopable Pug Studio will have the right to equitable reliefs without pledge, other ensuring or presentation of proofs of damage, in addition to other remedies which Unstopable Pug Studio can have by the current legislation.
COMPENSATION OF DAMAGE.
You undertake to protect the Unstopable Pug Studio company, her partners, affiliates, contractors, the management, employees and agents from any material and other responsibility which arose directly or indirectly in connection with your actions or failure to act in usage time of the Program on terms of this agreement.
OTHER CONDITIONS.
This Agreement is the entire agreement of the parties according to this license and replaces all former agreements and representations between them. Any changes have to be approved by both parties, are accepted and observed. If any provision of this agreement is recognized unrealizable for any reason, this situation will be changed exactly so to make it feasible, and other provisions of this agreement will be left without change. This Agreement is regulated and interpreted according to laws of the Russian Federation, and you agree to exclusive jurisdiction of vessels.
