END USER LICENSE AGREEMENT (EULA)
Please read this Agreement carefully before using the electronic game MAGICAE MUNDI (the "ELECTRONIC GAME") and all services offered on it (the "Services"). By using the ELECTRONIC GAME, you agree to and accept the terms and conditions of this Agreement. If you do not agree, do not use the ELECTRONIC GAME and the LICENSOR'S SERVICES.
The use of any electronic game or service provided by the LICENSOR is subject to the acceptance of this EULA in its entirety.
DECLARATION OF WILL
The USER declares to have read, understood and accepted all the terms and conditions of this EULA, and also declares to be aware of the rights and obligations contained therein, this instrument being the complete agreement between the parties.
LICENSE TO USE THE SOFTWARE
LICENSOR, who is the owner and the legitimate owner of all rights to the ELECTRONIC GAME, hereby grants to the USER the right of non-exclusive, non-transferable use to any third party in any form or condition. By using the ELECTRONIC GAME, the USER will be bound by and agree to the terms of this EULA. In case of disagreement of the terms presented here, the use of the ELECTRONIC GAME must be immediately interrupted.
Subject to the terms and conditions of this instrument, this EULA grants the USER a revocable, non-exclusive and non-transferable license to use the ELECTRONIC GAME. In no case will the USER have access to the source code of the ELECTRONIC GAME now licensed, as this is intellectual property of the LICENSOR.
The license granted to this EULA is restricted in the use of the ELECTRONIC GAME within the limits necessary for the provision of the service by the LICENSOR. The USER does not acquire, by this instrument, any intellectual property rights or other exclusive rights, including patents, drawings, trademarks, copyrights or rights in confidential information or business secrets, over or related to the ELECTRONIC GAME or any part of it. The USER also does not acquire any rights over or related to the ELECTRONIC GAME or any component thereof, other than the rights expressly licensed thereto under this EULA or in any other mutually agreed upon written agreement that the USER may have entered into with the LICENSOR. Any rights not expressly granted herein are reserved.
OF USER OBLIGATIONS
The USER is obliged to:
Access the ELECTRONIC GAME via Steam and always keep it updated in the latest version of the manufacturer;
Report clearly on the occurrence of any technical problem, if necessary;
Not to publish, through the ELECTRONIC GAME, racist, pornographic, offensive, copyrighted, libelous or defamatory material;
Do not use any software that changes restricted information in the game or may compromise the gameplay of other players.
LICENSOR'S OBLIGATIONS
The LICENSEE is obliged to:
Maintain absolute secrecy about any and all information, which in any way or at any time is entrusted to you by the USER.
OF INTELLECTUAL PROPERTY
The USER does not acquire, by this instrument, any intellectual property right or right over the ELECTRONIC GAME and its components, so it will not, under any circumstances, have access to its source code;
The SOFTWARE, the logo, the brand, the insignia, the symbols, the manuals, the technical documentation or any other material related to the ELECTRONIC GAME, constitute copyright, trade secrets of LICENSOR properties;
Any rights not expressly granted herein are reserved entirely to LICENSOR.
Any breaches of the intellectual property of the LICENSOR shall subject the USER to the immediate suspension of the use of the ELECTRONIC GAME and termination of this EULA, without any contractual refunds by the LICENSOR and without prejudice to the compensation of any losses and damages caused to the LICENSOR.
OF THE GENERAL PROVISIONS
This EULA is intended to regulate the actions of both parties, however any of them may tolerate any noncompliance with any item, without this entails novation or waiver of rights. The tolerant party may, at any time, demand from the other party the faithful and complete fulfillment of this EULA;
The continued use of the ELECTRONIC GAME after making any changes to this EULA will imply the tacit acceptance of the changes by the USER;
The failure to comply with the obligations assumed herein as a result of facts that are independent of the will of the parties, such as those that constitute the fortuitous event and the force majeure provided for in article 393 of the Brazilian Civil Code, do not constitute contractual termination cause;
OF THE FORUM AND APPLICABLE LEGISLATION
This EULA shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil;
