Please read this End-User License Agreement ("Agreement") carefully before clicking the "I Agree" button, downloading or using Snowed IN ("Application").
This Agreement is a binding agreement between you ( "You" or "Your" ) and Rascal Devworks (“Rascal Devworks”). This Agreement governs your use of Snowed IN ( "Application").
By clicking the "I Agree" button, downloading or using the Application, You are agreeing to be bound by the terms and conditions of this Agreement.
If You do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not download or use the Application.
Your use of the Application is also subject to the terms and conditions set forth in the Steam subscriber agreement and/or any other terms set forth by Valve corporation in relation to the Steam service.
License
Rascal Devworks grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for Your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
The Application is licensed to You, not sold. This License does not give You any ownership of the Application, and should not be construed as a sale or transfer of any intellectual property or other rights to the Application.
Restrictions
You agree not to, and You will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
b) decompile, reverse engineer, decrypt or attempt to derive the source code of the Application.
c) make any modification, adaptation, improvement, translation or derivative work from the Application.
d) violate any applicable laws or regulations in connection with your access or use of the Application.
Modifications to Application
Rascal Devworks reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to You.
Term and Termination
This Agreement shall remain in effect until terminated by You or Rascal Devworks.
Rascal Devworks may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from Rascal Devworks, in the event that You fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your desktop, laptop or other devices.
Upon termination of this Agreement, You shall cease all use of the Application and delete all copies of the Application from your desktop, laptop or similar devices.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Amendments to this Agreement
Rascal Devworks reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Limitations of Warranties
YOU ACKNOWLEDGE AND AGREE THAT THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND THAT YOUR USE OR RELIANCE UPON THE APPLICATION AND ANY THIRD PARTY CONTENT AND SERVICES ACCESSED IS AT YOUR SOLE RISK AND DISCRETION.
RASCAL DEVWORKS AND ITS AFFILIATES, PARTNERS, SUPPLIERS AND LICENSORS HEREBY DISCLAIM ANY AND ALL REPRESENTATIONS, WARRANTIES AND GUARANTEES REGARDING THE APPLICATION AND THIRD PARTY CONTENT AND SERVICES, WHETHER EXPRESS, IMPLIED OR STATUTORY.
NEITHER RASCAL DEVWORKS OR ITS THIRD-PARTY PROVIDERS, NOR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING ANY CONTENT OR SERVICES CONTAINED IN THE GAME, MAKE ANY WARRANTY WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THAT THE GAME WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE GAME OR AS TO THE ACCURACY, RELIABILITY, QUALITY OR CONTENT OF ANY INFORMATION OR SERVICE PROVIDED ON OR THROUGH THE GAME.
FURTHERMORE, RASCAL DEVWORKS WILL NOT BE HELD RESPONSIBLE FOR ANY INTERRUPTION OF SERVICE OR FAILURE TO PROVIDE FOR ANY RELATED ISSUES THAT OCCUR FROM ACCESSING THE SERVICE FROM OUTSIDE OF THE COUNTRIES FOR WHICH THIS SERVICE IS MEANT FOR.
Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RASCAL DEVWORKS OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF RASCAL DEVWORKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
ALTHOUGH THE APPLICATION MAY BE ACCESSIBLE WORLDWIDE, WE MAKE NO REPRESENTATION THAT THE APPLICATION OR RELATED MATERIALS ARE APPROPRIATE OR AVAILABLE FOR USE IN YOUR LOCATION , AND THE APPLICATION MAY NOT BE ACCESSED FROM TERRITORIES WHERE THE CONTENT IS PROHIBITED BY LOCAL LAWS. THOSE WHO CHOOSE TO ACCESS THE APPLICATION FROM SUCH LOCATIONS DO SO ON THEIR OWN INITIATIVE AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAWS, IF AND TO THE EXTENT LOCAL LAWS ARE APPLICABLE.
Applicable Law
This Agreement is governed by and construed in accordance with the laws of the Netherlands.
