This Licence is proof of your entitlement to exercise the rights granted herein and you must conserve it. NEOCORE may terminate this Licence immediately if you fail to comply with any of the terms thereof.3. RESTRICTIONSNEOCORE reserves all rights which have not been expressly granted in this Licence. Therefore, the Product must be given the same treatment as any other material subject to copyright (for example, a book or a musical recording) with the exception that, as the Product is a computer program, the Product may be transferred to a single hard disk and the original conserved solely for filing purposes or as a backup copy. In addition, if the Product contains a map or level editor, you may use it in accordance with the instructions given in the accompanying documents to create maps or levels for your own personal use and enjoyment and you may authorise other people to use these maps or levels for their own use and enjoyment, but in no case may said maps or levels be commercially exploited in any form whatsoever, neither by yourself nor by any other natural person or legal entity. It is not permitted to copy the written materials which accompany the Product.The Product Licence is granted to you solely for your personal use and enjoyment; the Product may not be used for any commercial purpose of any nature whatsoever. You may not rent out, lend, sell or transfer the Product nor any element incorporated into it, including images which appear on screen, sounds or accompanying documents, to any third party by any means whatsoever, nor offer it for sale or grant subordinated licences, and nor may you permit any other person to use the Product in exchange for payment. Moreover, you may not place the Product in any computer system which permits multiple users to access it. Notwithstanding the above, you may permanently transfer your rights by virtue of this Licence, provided you transfer this Licence and the Product, including all accompanying written materials, without conserving any copy thereof, and the recipient agrees to be bound by the terms of this Licence. If the Product is an update, any transfers that are made must include this update and all later revisions.Save to the extent permitted by Law, you may not copy, modify, adapt, translate, create works derived from, give public performances of, distribute, transmit, decompile, disassemble or try to decipher the source code of all or any part of the Product or any element incorporated into it, including any image shown on screen, sound or accompanying document, nor permit or encourage any third party to do so.Without limiting the general nature of the above restrictions, specifically you may not offer the Product as payment for playing in a computer system or network which may be accessed by means of rental, nor electronically distribute the Product or part of the Product or any element incorporated into it, including any image shown on screen, sound or accompanying document.4. LIMITED WARRANTYYou expressly acknowledge and agree to use the Product on your own exclusive account and risk. NEOCORE guarantees that the program will work substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of initial acquisition of the Product. No dealership, distributor, agent or employee of NEOCORE is authorised to make any modification or addition whatsoever to this warranty.5. EXCLUSION OF OTHER WARRANTIESNEOCORE does not recognise any other warranties, express, implicit or, insofar as law permits, legal, including any warranty of satisfactory quality, suitability for a specific use and non-infraction of intellectual property rights, in relation to the Product. NEOCORE does not guarantee that the Product meets the requirements of the computer system nor that the Product is entirely error- or defect-free nor that the functioning of the Product will be uninterrupted.NOTHING IN THE CONTENT OF THIS LICENCE AFFECTS YOUR LEGAL RIGHTS AS A CONSUMER PROTECTED BY AN APPLICABLE LAW.6. REMEDIES AVAILABLE TO THE CUSTOMERNEOCORE’s sole responsibility, and the sole remedy available to the customer shall be either, at the choice of NEOCORE: (a) the return of the sum paid for the Product; or (b) the repair or replacement of the Product that does not meet the requirements of the limited warranty established in Section 4 of this Licence, provided the Product is returned to NEOCORE together with proof of purchase. The limited warranty established in Section 4 of this Licence shall be invalid if the failure of the Product is due to accident, abuse, incorrect use or intentional or negligent act by you. Any replacement of the Product shall have the same limited warranty, which will last for the remainder of the original warranty or thirty days, whichever is longer.7. LIMITATION OF LIABILITYIn no case shall NEOCORE be liable for any kind of damage (this term includes, though is not restricted to, derived, special, indirect, direct or incidental damage, loss of earnings, interruptions in mercantile activity or other pecuniary loss) deriving from the use of the Product, even when NEOCORE has been notified of the possibility of this damage. In no case shall NEOCORE's liability by virtue of the law be greater than the price paid for the Product.8. GENERALThis Licence contains the complete agreement between NEOCORE and yourself in relation to the object thereof and replaces all previous negotiations, understandings and agreements, written or oral, between NEOCORE and yourself in relation to the object thereof. This Licence shall be governed and interpreted in accordance with Swiss law and you specifically agree to submit to the non-exclusive jurisdiction of Swiss law courts. If any term or condition of this Licence is declared invalid or null and void, all remaining terms and conditions thereof shall remain in full force and effect as if the invalid terms or conditions had been removed from this Licence.
