This Agreement is a legally binding contract between you and KUO-KAI YUEN 5F., No.1, Ln. 382, Sec. 1, Zhongxing Rd., Dali Dist., Taichung City 41275, Taiwan (R.O.C.) (which I will further call “LICENSOR”). LICENSOR gives you the personal right (known as a 'license') to install and play Kai Yuen’s Overlapped Universe (I will further call it “THE PRODUCT”). BY OPENING “THE PRODUCT”, INSTALLING, USING ANY MATERIALS INCLUDED WITH “THE PRODUCT”, YOU HEREBY ACCEPT THE TERMS OF THIS LICENSE.
OWNERSHIP
This license is for your personal use only, it does not give you ownership rights, nor can you sub-license it to someone else. The contents of “THE PRODUCT”, including (but not limited to) computer code, UI(user interface), the graphics, layout, audio, text, data and any other content included with “THE PRODUCT” and all legal rights regarding them, are owned by LICENSOR or are licensed from third parties.
LIABILITY
I do my best to make the game work, but I won’t always be able to get everything right. Therefore, I cannot accept any liability or responsibility if “THE PRODUCT” does not work completely.
LIMITATION OF LIABILITY
IN NO EVENT SHALL LICENSOR OR ANY OF ITS ASSOCIATES, PARTNERS BE LIABLE FOR ANY (i) SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES, (ii) LOSS OR DAMAGE TO ANY SYSTEMS, HARDWARE, SOFTWARE, RECORDS OR DATA. IN NO EVENT SHALL THE ENTIRE LIABILITY OF KUO-KAI YUEN ARISING FROM OR IN ANY WAY RELATED TO “THE PRODUCT”, OR THIS AGREEMENT, EXCEED IN THE AGGREGATE THE PURCHASE PRICE OF “THE PRODUCT”.
OTHER
If any part of this Agreement is found not to be legally enforceable, this will not affect any other part of it.
if you breach any of the terms of this Agreement, LICENSOR reserve the right to cancel or suspend your access to the Game.
I may change this Agreement in the future. If this is the case, I will make the changed Agreement available online and try to inform you. Once I change the agreement, it will become legally binding after 30 days after I post it online. If you do not agree to the new terms, you must cease using “THE PRODUCT” immediately and destroy/uninstall it.
