End User License Agreement
Please read this Agreement carefully. It is a legal document that explains your rights and obligations related to your use of the Edvog Explorer Game and related content. By downloading or using this software or any related content, you are agreeing to be bound by the terms of this Agreement. If you do not or cannot agree to the terms of this Agreement, please do not download or use this software or any related content.
1. Terms of Agreement
The Terms of this Agreement may be amended, supplemented, or modified at any time by Edvog Explorer Game / Edvog.com in its sole discretion. Edvog Explorer Game / Edvog.com may change, modify, suspend, or discontinue any aspect of the Software Product at any time. Edvog Explorer Game / Edvog.com may also impose limits on certain features or restrict your access to parts or all of the Software Product without notice or liability. You have no interest, monetary or otherwise, in any feature or content contained in the Software Product.
2. Scope of Agreement
This Agreement is a legal contract between you and Edvog Explorer Game / Edvog.com. The Software Product and any and all copies and derivative works of the Software Product are the proprietary and copyrighted work of Edvog.com . Any use, reproduction, modification, or distribution of the Software Product not expressly authorized by the terms of this Agreement is expressly prohibited. All rights in and to the Software Product not granted herein are hereby expressly reserved by Edvog Explorer Game / Edvog.com .
3. Limited use License
You may install the applicable software comprising of the Software Product (the "Game Software") onto your computer or applicable hardware device, solely for purposes of playing the Software Product. Subject to your agreement to and full ongoing compliance with the terms and conditions of this Agreement, Edvog Explorer Game / Edvog.com hereby grants to you a limited, non-exclusive, non-transferable license to (a) install one copy of the Game Software on one or more computers and/or applicable hardware devices owned by you or under your legitimate control, and (b) use the Game Software in conjunction with the Service solely for your lawful and non-commercial entertainment purposes. You may install the Game Software on multiple computers and/or applicable hardware devices owned by you or under your legitimate control.
4. License restrictions and limitations
You agree that you will not, under any circumstances:
a. sell, sublicense, assign, rent, lease, or otherwise transfer the Software Product
b. reverse engineer, decompile, disassemble, or otherwise derive source code from the Software Product or reduce the Software Product to a human-readable form, except to the extent that such actions are expressly permitted by applicable law;
c. copy, photocopy, or reproduce the Software Product, in whole or in part; provided, however, that you may make one (1) copy of the Game Software;
d. modify, translate, or create derivative works based on or utilizing the Software Product, Service, or Software Product experience, or any portion thereof;
e. remove or tamper with any copyright, trademark, or other proprietary notices contained in or relating to the Software Product, Service, or Game experience, or any portion thereof;
f. use cheats, automation software (bots), hacks, mods, or any other unauthorized third-party software, tools, or content designed to or capable of modifying the Software Product;
g. exploit the Software Product or any portion thereof for any commercial purpose.
5. Intellectual Property Rights
The Software Product is protected by copyright laws and international copyright treaties, conventions, and other applicable law. Unless otherwise permitted by law, you shall not, at any time during or after the effective term of this Agreement, dispute or contest, directly or indirectly, Edvog Explorer Game / Edvog.com exclusive right, title, and interest in and to the Software Product or the validity thereof. You agree to promptly assign to Edvog Explorer Game / Edvog.com any and all rights that you may obtain in or to the Software Product arising under applicable law.
6. Termination
This Agreement is effective until terminated. You may terminate this Agreement at any time by (a) permanently destroying all copies of the Software Product in your possession or control; (b) removing the Game Software completely from each computer or applicable hardware device on which you have installed the Software Product. Edvog Explorer Game / Edvog.com may terminate this Agreement at any time for any reason or no reason, with or without notice. Upon termination for any reason, all licenses granted to you in this Agreement shall immediately terminate and you must immediately and permanently destroy all copies of the Software Product in your possession and control and remove the Game Software completely from each computer or applicable hardware device on which you have installed the Software Product.
7. Limited warranty
The service is provided “AS IS” without warranty of any kind, either express or implied, including, without limitation, any implied warranties of condition, uninterrupted use, merchantability, or non-infringement. The entire risk arising out of use or performance of the Software Product and Service remains with the user.
8. Limitation of liability
Neither Edvog Explorer Game / Edvog.com nor its parent, subsidiaries, affiliates, partners, or vendors shall be liable in any way for any loss or damage of any kind arising out of the Software Product or any use of the Software Product or service, including, without limitation, loss of data, loss of goodwill, work stoppage, computer failure or malfunction, applicable Hardware device failure or malfunction, or any and all other damages or losses. You hereby agree to defend, indemnify, and hold Edvog Explorer Game / Edvog.com and its parent, subsidiaries, affiliates, and vendors harmless from and against any claim, liability, loss, injury, damage, cost, or expense (including reasonable attorneys’ fees) incurred by Edvog Explorer Game / Edvog.com arising out of or related to your use of the Software Product or Service.
Edvog Explorer Game includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Edvog Explorer Game, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Edvog Explorer Game, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Edvog Explorer Game, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve Edvog Explorer Game, or will not revoke approval of Edvog Explorer Game for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Edvog Explorer Game and Epic. Edvog Explorer Game, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Edvog Explorer Game, Epic, Epic’s licensors, nor its or their affiliates, nor any of Edvog Explorer Game or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this [Agreement], including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Edvog Explorer Game, Epic, Epic’s licensors, nor its or their affiliates, nor any of Edvog Explorer Game or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this [Agreement] or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Edvog Explorer Game, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Edvog Explorer Game, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Edvog Explorer Game, Epic, Epic’s licensors, its and their affiliates, and any of Edvog Explorer Game or Epic’s service providers shall be limited to the full extent permitted by law.
9. Equitable Remedies
You hereby agree that Edvog Explorer Game / Edvog.com would be irreparably damaged if the terms of this Agreement were not specifically enforced, and therefore you agree that Edvog Explorer Game / Edvog.com shall be entitled, without bond or other security or proof of damages, to appropriate equitable remedies in any court of competent jurisdiction with respect to any breach of this Agreement.
