End-User License Agreement ("Agreement")

Please read this End-User License Agreement (heretofore known as "Agreement") carefully before clicking the "I Agree" button, downloading or using Atlas Tile Editor (ATE) (heretofore known as "Application"). Please read the following terms and conditions carefully before using this Application. Your use, distribution or installation of this copy of Application indicates your acceptance of this License. Application here means Software, image files, all accompanying files, data and materials received with your order of "Atlas Tile Editor (ATE)".
By clicking the "I Agree" button, downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not download or use the Application.
License
Herbert Elwood Gilliland III (DBA "Lost Astronaut Studios", heretofore known as "Company") grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
Restrictions
You agree not to, and you will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
The Restrictions section is for applying certain restrictions on the app usage, e.g. user can't sell app, user can't distribute the app. For the full disclosure section, create your own EULA.
Modifications to Application
Company reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
The Modifications to Application section is for apps that will be updated or regularly maintained. For the full disclosure section, create your own EULA.
Term and Termination
This Agreement shall remain in effect until terminated by you or My Company (change this).
Company may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from Company, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Amendments to this Agreement
Company reserves the right, at its sole discretion, to modify or replace this Agreement at any time. What constitutes a material change will be determined at our sole discretion.
Additional Terms
If you do not agree to any of the terms of this License, then do not install, distribute or use the Application. If you have purchased a single copy from Company or an authorized distributor, reseller or any retail channel, you may return it unused, within thirty (30) days after purchase, for a refund of your payment less any incidental charges. The 30-day warrantee is applicable only to products bought within a Steam-supported refund area. Products downloaded to or shipped out of the Steam-supported refund area are strictly non-refundable.
Warrantee covers defects in the software, which prevents successfully installing the software in the buyer's PC. Warrantee does not cover fitness of purpose, not meeting of expectations or needs in the mind of the buyer.
This Application is for personal use only and may be installed and used by on only one computer. Its component parts may not be separated for use on more than one computer. Application may be accessed through a network only after obtaining a site license. All components accompanying the software are copyrighted by Company and may not be taken apart, modified, used or published with other software or means except with the Application software and may not be distributed or copied in any manner.
This Application, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
Any liability of Company will be limited exclusively to refund of purchase price. In addition, in no event shall Company, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of Application.
In addition, in no event does Company authorize you to use this Application in applications or systems where Application 's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Company harmless from any claims or losses relating to such unauthorized use.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of United States of America OR STATE.
Company the owner of the copyright of this Application, all of its derivatives, title and accompanying materials are the exclusive property of Company. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Company. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this Application. You may not make access to Application available to others in connection with a service bureau, application service provider, or similar business, or use this Application in a business to provide file compression, decompression, or conversion services to others. There are no third party beneficiaries of any promises, obligations or representations made by Company herein.
You may not disclose to other persons the data or techniques relating to this Application that you know or should know that it is a trade secret of the [Company] in any manner that will cause damage to Company.
This Application and all services provided may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any United States of America, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Company harmless from any claims resulting from the use of this Application, which may damage any other party.
If you buy: you will receive the Application, a sample Workspace containing Atlas Tiles from Lost Astronaut's Fringes of the Empire (some sources for the tiles includes OpenGameArt.org), demonstrating various techniques with the Application, and lifetime updates. You are free to use the output of the Application for commercial work. You are encouraged to mention your use of the Application in your credits, but it is not required. You are not allowed to sell the Application itself.
