This is a legal agreement ("LICENSE") between an individual or legal entity ("YOU") and AwingSoft ("AUTHOR") for Awakening 3D Authoring Software, which includes computer software and any accompanying media ("SOFTWARE" or "SOFTWARE PRODUCT"). BY INSTALLING OR OTHERWISE USING THIS SOFTWARE YOU AGREE TO THE TERMS OF THIS AGREEMENT. DO NOT INSTALL THIS PRODUCT IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT. AUTHOR RESERVES THE RIGHT TO MAKE CHANGES TO THIS AGREEMENT.
1. The SOFTWARE is protected by copyright laws and international treaties. Any unauthorized redistribution or reproduction of the SOFTWARE is strictly prohibited and will be prosecuted to the maximum extent permissable under the law. All intellectual property rights in the SOFTWARE are owned by AUTHOR.
2. AUTHOR hereby gives YOU a non-exclusive license to use the SOFTWARE. This SOFTWARE is licensed, not sold. YOU may not modify, translate, reverse engineer, decompile, or disassemble the SOFTWARE (except and only to the extent allowed under applicable laws notwithstanding this LICENSE).
3. You may not redistribute this SOFTWARE without express written permission from AUTHOR.
4. This LICENSE shall terminate immediately if YOU fail to comply with the terms of this LICENSE. Upon termination, YOU must remove and destroy all copies of the SOFTWARE.
5. THIS SOFTWARE IS PROVIDED ON AN AS-IS BASIS. AUTHOR DOES NOT WARRANT THAT THE SOFTWARE IS ERROR FREE, NOR IS THERE A WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF THIRD PARTY RIGHTS.
The entire risk as to the quality and performance of the SOFTWARE is carried by YOU. Should the SOFTWARE prove defective, YOU and not AUTHOR assume the entire cost of any service and repair.
IN NO EVENT IS AUTHOR RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THIS SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL AUTHORS'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.
6. Use of the this SOFTWARE for noncommercial purposes is free of charge; Also free for commercial purpose.
