END USER LICENSE AGREEMENT FOR THE GAME OF INEVITABLE FRUSTRATION HD EDITION

Your use and modification of THE GAME OF INEVITABLE FRUSTRATION HD EDITION (hereby referred to as the "software") is subject to the terms and conditions of this end user license agreement, a legal agreement between "you" (either an individual or an entity) and Ruby Dennington and Ginever Entertainment (collectively, the "licensors"). The "software" includes all software included with this agreement, the accompanying manuals, packaging and other written, electronic or online materials or documentation relating to the software, along with any and all copies of such software and its materials. By opening, installing, using and/or modifying the software or its materials, you hereby accept the terms of this license agreement as dictated by the licensors. If you do not agree to the terms of this agreement, promptly return the software and its materials to the place you obtained them, along with your receipt, for a full refund.
Subject to this agreement and its terms and conditions, the licensors hereby grant you a non-exclusive, non-transferable, limited right and license to use the software for your personal, non-commercial use on any computers which are owned by you, as long as your usage of the software does not result in harm or damage to the licensors in any way, either directly or indirectly. It is up to the discretion of the licensors as to what constitutes harm or damage. The software is deemed to be in use on a computer when it is loaded into temporary memory (i.e., RAM) or installed into the permanent memory (e.g., hard disk, DVD-ROM, or other storage device) of that computer. Installation on a network server is strictly prohibited.
You hereby acknowledge that no title or ownership in the software is being transferred or assigned, and that this agreement should not be construed as a sale or transfer of any rights in the software.
This software is protected by copyright laws in both the United Kingdom and the United States along with applicable laws and treaties throughout the world. The licensors retain all rights not specifically granted under this agreement, along with all title and interest to this software, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audiovisual effects, themes, characters, character names, stories, dialog, settings, artwork, sounds effects, musical works, and moral rights. The software may not be copied, reproduced or distributed in any manner or medium, in whole or in part, without the express prior written consent from the licensors. Any persons copying, reproducing or distributing all or any portion of the software in any manner or medium which is not authorized by this agreement will be willfully violating copyright laws, and may be subject to civil and criminal penalties.
The licensors may revoke or terminate your license at any time and for any reason without prior notice.
CUSTOMIZED SOFTWARE MATERIALS
Any direct modifications to the software, along with any content items which do not directly modify the software but are designed or intended to work with the software (for example, save files, scenarios, map files, plug-ins, etc) are considered to be "customized software materials". As a license holder, the licensors authorize you to create customized software materials, but any customized software materials you create are exclusively owned by the licensors, and you hereby transfer, assign and convey to the licensors all rights, titles and interests in and to the customized software materials.
Any customized software materials you create must not result in harm or damage to the licensors in any way, either directly or indirectly. It must also be implausible for the customized software materials to be considered a separate product from the original software.
As a license holder, the licensors authorize you to use and modify any customized software materials you have in your possession under the same terms as the original software. You are also allowed to distribute those customized software materials to other license holders, as long as you distribute them at no charge, and as long as the recipient is unable to use your distribution of customized software materials without a legally installed and licensed copy of the software.
The licensors are not required to help you with modifying the software, nor are they required to provide any means to do so.
The licensors reserve the right to incorporate any customized software materials into official or unofficial revisions or releases of any software product, either temporarily or permanently, without any requirement to provide any form of reimbursement or accreditation to the original author(s) of the customized software materials.
The licensors reserve the right to remove or take down any customized software materials which it believes to be in violation of these license terms.
SALE AND TRANSFER
You may not sell or transfer the software under any circumstances.
PROVISION OF ONLINE SERVICES
The licensors may provide official online services for this software if they wish to (such as game servers, authentication servers, map download websites, etc). If any such services exist, they are provided as-is with no warranty of any kind, and may be revoked, rescinded, shut down or terminated at any time, or may be access-controlled with whatever form of whitelist or blacklist the licensors choose. Your license to use the software does not grant you with any rights to access or use the online services, and the online services may be governed by their own terms and conditions if the licensors so wish.
In the event that online services are provided for the software, it is forbidden to operate alternative services that run in competition or in parallel with the official online services. This restriction applies to you regardless of your level of access to the official online services.
If you are unable to access the online services for any reason (e.g. you are banned, the services are shut down, etc), this does not terminate your license.
LICENSING AND SUB-LICENSING
Only the licensors have the authorization to license or sub-license the software.
ENDORSEMENT
The names of the licensors or of any other software developers who have worked on this software or its customized software materials may not be used to endorse or promote this software without specific prior written permission.
NO WARRANTY
This software and its online services are provided "as is", without warranty of any kind, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software, its online services, or the use of other dealings in the software or its online services.
The views and conclusions contained in the software, online services and documentation are those of the authors and should not be interpreted as representing official policies, either expressed or implied, of the licensors.
