The Legendary Player - Make Your Reputation is a paid game that was made available through Early Access in the Steam Online Store being distributed by Ninetales Studios.
The game is under development Beta, which gives players the possibility of participating in the testing and development processes, with the help of the community giving ideals and interacting with feedback about the game.

Ninetales Studios is an Individual Micro Enterprise operating in BRAZIL and respects the international treaties where the game is made available providing products and services to all the squares where the game is sold. And in this License Agreement, the expression "Ninetales Studios [/b] refers to Ninetales Studios MEI; the expressions" Player "," Consumer "and" Final Consumer "refer to the user who bought and plays the game, the expression "Game Community" refers to all users who bought the game, the expression "Game development community" to the players who assist in the development of the BETA version of the game, and the expressions "The Legendary Player", "TLP", "The Legendary Player - Make Your Reputation", "TLP - MYR", "Make Your Reputation" MYR "," Game "," Software " refer to the game title relating to this contract.
PLEASE READ THIS END USER LICENSE AGREEMENT (THIS "EULA" OR "LICENSE AGREEMENT") CAREFULLY. BY CLICKING THE "I ACCEPT" BUTTON BELOW OR BY USING THE GAME OR INSTALLING THE GAME, YOU AGREE THAT THIS LICENSE AGREEMENT IS VALID AS ANY WRITTEN CONTRACT SIGNED BY YOU. BY AGREEING TO THIS LICENSE AGREEMENT, YOU DECLARE THAT YOU HAVE AGE EQUAL OR HIGHER AGE OF THE INDICATIVE RECOMMENDATION OF THE GAME AND YOU SHALL COMMIT TO OBSERVE AND FOLLOW ALL THE RULES PRESENT IN THIS AGREEMENT.
1 - LIMITED USE LICENSE
The Player is subject to the limited terms of use under this agreement that allow the consumer who purchased the game to play the game, play streams or videos, participate in the game community, participate in the game development community and shall have no exclusivity other than those described in this agreement. The player agrees that he will not

D) Make use of, or cause any other person or entity to make use of, the Game for any commercial purpose, including, but not limited to, (i) participating in the game in exchange for payment (eg " about the game"); or (ii) sale of Virtual Goods and Game Assets out of Game, or sale of game products, unless such operations are authorized by Ninetales Studios and conducted directly through Ninetales Studios;
E) Use any unauthorized third party programs that interact with the Software in any way, including, but not limited to, mods, hacks, cheats, scripts, bots, trainers, or automation or any third party programs that intercept, emulate or redirect any communication between the Game and Ninetales Studios or that collect information about the Game by reading areas of memory used by the Game to store information about the Game.
Failure to comply with these terms may be penalized by removal of the game from the player's library and also punishable through legal proceedings.
2 - REQUIREMENTS
By installing the game the player acknowledges that he has read, understood and agreed to the terms of the game and the terms of this license agreement, in addition to agreeing, understands that to play the game it is necessary to be bought or won as a gift, or activated by the Keys and the Keys not sold by third parties without authorization from Ninetales Studios. These requirements can be changed as the Game evolves.
3 - PROPERTY

4 - MORAL CODE AND CONDUCT

E) To transmit or communicate any content that, in Ninetales Studios' sole and exclusive discretion, is considered offensive, including, but not limited to, illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or racial, ethnic or otherwise objectionable;
F) Transmit or facilitate the transmission of any content containing viruses, corrupted data, Trojan, bot keystroke logger, keylogger, worm, time bomb, logic bomb, cancelbot or other computer programming that is intended to damage, to interfere in a harmful way, to intercept or to mince surreptitiously, to scratch or to expropriate any system, data or personal information;
G) Sending spam in chats, comments in the Steam community or on any social network or softwares / applications / socialization programs through chats, messages, calls, calls, for personal or commercial purposes, interrupting the flow of the conversation with repeated posts of a similar nature;
H) Participate in any action that, in Ninetales Studios sole and exclusive judgment, "exploits" an undocumented aspect of the Game to ensure an unfair or unfair advantage over other users;

5 - UPDATES AND MODIFICATIONS
A) Game: Ninetales Studios can provide Updates to the game, which must be installed so that you can continue to play the Game. Each time you start the Software to play the Game, you hereby give your consent to Ninetales Studios to remotely install all Updates to the Software that is installed on your computer, regardless of whether you are sending a notification to you .
B) License Agreement: Ninetales Studios reserves the right, in its sole and exclusive discretion, to review, update, alter, modify, add, supplement or exclude certain terms of this License Agreement as the Game and the law evolve; provided that any material changes made in this License Agreement are not retroactively applied. Such changes will be effective upon their acceptance. If any future changes to this License Agreement are unacceptable to you or cause you to no longer comply with or comply with this License Agreement, or if at any time you no longer agree to any part of the current version of this License Agreement, Ninetales Studios reserves the right to terminate this License Agreement in accordance with our right to terminate under this clause. 6 - TERMINATION OF THE LICENSE AGREEMENT
This License Agreement is valid until terminated. You may terminate this License Agreement at any time and for any reason by notifying Ninetales Studios of your intention to terminate. Ninetales Studios may terminate this License Agreement at any time for any reason. Termination by Ninetales Studios shall take effect either by sending you a notice, or by terminating or deleting the game from the player's game library, or by Ninetales Studios's decision not to offer the Game or Game support . In the event of termination, either on your own initiative or at the discretion of Ninetales Studios, the license granted to the player will terminate immediately, and you must immediately and permanently remove the Software from the permanent memory of your computer and destroy any copies of the Software that may be in possession.

7 - CLOSURE OF THE GAME SERVICE

8 - EXPORT CONTROLS
The Software is subject to all applicable export restrictions. You must comply with all export and import laws, restrictions and regulations related to the Software and your use of any Brazilian agency or authority, from the United States or abroad. The Software shall not be re-exported, downloaded or exported, or downloaded or installed, by a citizen or resident of any country for which the game has been restricted and censored. The player represents and warrants that it is not located in, under the control of, or is a citizen or resident of, such country that prohibits this game or is part of the list of banned users of Ninetales Studios present in Clause 9.
9 - LIST OF BANNED USERS
Ninetales Studios reserves the right to refuse the sale to users who break the code of conduct and commit serious crimes of any nature, not limited to cyber crimes that bring problems or terror to the good players, thus, the character of the company , create a list of banned users containing specific data such as name, document records, qualifications, passports and even bank accounts and credit cards, in order to protect the other users and players community of any product or brand of Ninetales Studios in order to keep its users protected from real criminals. 10 - DISCLAIMER OF WARRANTIES
THE GAME (INCLUDING, WITHOUT LIMITATION, THE SOFTWARE AND DOCUMENTATION) IS PROVIDED TO YOU FROM AN "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Ninetales STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WHICH MAY BE APPLIED TO OR PLAY THE SOFTWARE, INCLUDING BUT NOT LIMITED TO PROPERTY OF IMPLIED WARRANTIES OR POSSESSION, NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTIES THAT MAY ARISE FROM THE HANDLING, PERFORMANCE OR COMMERCIAL USE, AND ANY WARRANTIES AS TO THE ACCURACY, RELIABILITY OR QUALITY OF ANY CONTENT OR INFORMATION CONTAINED WITHIN THE GAME AND / OR SOFTWARE. The Ninetales STUDIOS DOES NOT WARRANT THAT THE GAME AND / OR THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL PLAYER GAME SELECTION RESPONSIBILITY AND / OR SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM THE GAME AND SOFTWARE.
TO AVOID QUESTIONS, NINETALES STUDIOS DOES NOT DISCLAIM GUARANTEES RELATED TO THE INTENTIONAL BREACH OF YOUR DUTY. DISCLAIMER OF WARRANTY DOES NOT AFFECT THE LIMITATION OF LIABILITY AS SET OUT BELOW.
As some states or jurisdictions do not allow the disclaimer of implied warranties, this exemption, in whole or in part, may not apply to all players.
11 - INDEMNIFICATION
THE PLAYER AGREES TO INDEMNIFY, DEFEND AND INDEMNIFY NINETALES STUDIOS AGAINST ANY AND ALL CLAIMS, COURTS, DAMAGES, LOSSES, LIABILITIES AND EXPENSES (INCLUDING ADVOCATE FEES) THAT DIRECTLY OR INDIRECTLY ARE ATTRIBUTELY TO, OR ARISING OUT OF, OR ARISING OUT OF THEIR USE OR BAD USE OF THE GAME OR ANY BREACH BY THE PLAYER OF ANY PROVISION OF THIS LICENSE AGREEMENT. Ninetales Studios reserves the right, at its own expense and in its sole and exclusive discretion, to assume, exclusively, the defense and control of any matter subject to indemnification by the player, provided that in this case the player will cooperate with Ninetales Studios in the evaluation and determination of the available defenses.
12 - LIMITATION OF LIABILITY
IN NO EVENT SHALL AND UNDER NO LEGAL THEORY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, NINETALES STUDIOS BE LIABLE TO THE PLAYER OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. PUNITIVE DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS DAMAGES, LOSS OF DATA, LOSS OF gOODWILL, OR LOST PROFITS), OR ANY DAMAGES FOR NEGLIGENCE OF ANY gROSS KIND (INCLUDING, WITHOUT LIMITATION, THE sTOPPAGE FOR DAMAGES WORK COMPUTER FAILURE OR IMPROPER OPERATION, OR ANY OTHER DAMAGES OR COMMERCIAL LOSS) ARISING OUT OF YOUR USE OR IMPROPER USE OF THE SOFTWARE, EVEN IF STUDIOS Ninetales BE AWARE OR SHOULD BE THE POSSIBILITY OF SUCH DAMAGES AWARE. IN ADDITION, NINETALES STUDIOS SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE TO PLAYER CHARACTERS, VIRTUAL GOODS (FOR ANY WEAPONS, ARMS, ARMOR, SKINS, ETC.) OR VIRTUAL CURRENCY, ACCOUNTS, STATISTICS, OR USER CLASSIFICATIONS , RANKINGS, OR PROFILE INFORMATION STORED BY THE GAME. NINETALES STUDIOS SHALL NOT BE LIABLE FOR ANY INTERRUPTION OF SERVICE, INCLUDING WITHOUT LIMITATION, INTERNET ACCESS PROVIDER INTERRUPTION, SOFTWARE OR HARDWARE FAILURE, OR ANY OTHER EVENT THAT MAY RESULT IN LOSS OF DATA OR SERVICE INTERRUPTION. IN NO EVENT SHALL NINETALES STUDIOS BE LIABLE FOR ANY DAMAGES OF ANY AMOUNT THAT YOU HAVE PAYABLE TO NINETALES STUDIOS FOR PRODUCTS RELATED TO THE GAME, IF APPLICABLE, FOR THE SIX (6) MONTHS IMMEDIATELY UP TO THE TIME YOU REASON FOR ACTION.
Notwithstanding the above limitations of liability, NOTHING IN THIS LICENSE AGREEMENT SHALL LIMIT THE LIABILITY OF NINETALES STUDIOS (i) for damages resulting from injury to life, body or health due to negligent breach of its duties, or due to intentional infringement or negligent breach of your duties by a legal representative or person designated to perform an obligation of Ninetales Studios, or (ii) for other damages resulting from a gross negligent breach by Ninetales Studios of your duties, or intentional or negligent breach of your duties by a legal representative or designee to perform an obligation of Ninetales Studios; (iii) for intentional misconduct; (iv) damages resulting from negligent breach of an obligation that is essential to the performance of the License Agreement by Ninetales Studios to the extent that it is typical and predictable; (v) any guarantee given by Ninetales Studios to the player; and (vi) for any liability under applicable product liability law.
Insofar as some states or jurisdictions do not allow the exclusion or limitation of liability in such states or jurisdictions, Ninetales Studios' liability shall be limited to the maximum extent permitted by applicable law.
13 - FAIR COMPENSATIONS
You acknowledge and agree that Ninetales Studios would suffer irreparable damage if this License Agreement were not applicable and enforceable or subject to specific enforcement. Consequently, in addition to financial indemnities, among other remedies that may be obtained by law, you agree that Ninetales Studios will have the right to specific enforcement or any other precautionary measure, without bail, or any other security or proof of damages, such as compensation for any breach or threat of breach of this License Agreement. In addition, in the event of any legal or administrative action or proceeding to be brought by either party in connection with this License Agreement and in accordance with clause 14 below, the party prevailing in such proceedings or lawsuit shall have the right to recover from the other party all costs, legal fees and other expenses incurred by the prevailing party as a result of the action or proceeding.
14 - NEGOTIATIONS
A) Negotiations. Disputes can be expensive and time-consuming for both parties. In an effort to expedite resolution and reduce the cost of any dispute or claim under this License Agreement ("Claim"), you and Ninetales Studios agree to attempt to informally negotiate any claim for at least thirty (30) days ( except those Claims expressly excluded in Section 15B below). Ninetales Studios will send a notice to the address you have on file or email, provided the player has provided additional contact information to Ninetales Studios (for example, by participating in a promotion or search, or by contacting a service representative to the client). The player must send his notification to Ninetales Studios through the email address: ninetalesdeveloper@gmail.com with the subject and text body of the email duly filled in, "No subject" emails will not be taken into account. Please note that this informal resolution procedure is voluntary for the player and is intended to resolve Claims more quickly and cheaply for both you and Ninetales Studios. This procedure also does not suspend any legal limitation period on the filing of a Claim, nor does it limit any rights that the player or Ninetales Studios have to seek legal action.
B) Exceptions to the Negotiations. To the extent permitted by applicable law, the player and Ninetales Studios agree that the following Claims are not subject to the above negotiation provisions: (i) any Claims they seek to impose or protect or relate to the validity of any rights of their intellectual property or of Ninetales Studios; (ii) any Claim relating to, or arising out of, charges of theft, piracy, invasion of privacy or unauthorized use; and (iii) any request for fair compensation.
C) Applicable Law and Jurisdiction. Except as otherwise provided in this Agreement, this Agreement shall be governed by and construed in accordance with the laws of the country to which the player is located, without regard to any conflict of law applicable. The parties hereby elect the central forum of the country or state to the exclusion of all others, regardless of their ability to resolve any disputes, disputes or claims arising out of or in connection with this Agreement.
15 - GENERAL PROVISIONS
This License Agreement represents the entire Agreement between you and Ninetales Studios with respect to the subject matter and supersedes any prior or current Contracts between you and Ninetales Studios, provided that this License Agreement coexists with, and does not replace, the Terms of Use or Privacy Policy. To the extent that the provisions of this License Agreement conflict with the Terms of Use, the conflicting provisions of the Terms of Use shall prevail. The Game is operated by Ninetales Studios in BRAZIL. Those who choose to access the Site Game outside of Brazil do so on their own initiative and are responsible for compliance with applicable local laws. Ninetales Studios' failure to enforce or enforce any provision of this License Agreement shall in no way be construed as a present or future waiver of such a clause, nor in any way affect the right of either party to enforce any provision thereafter . Ninetales Studios' express waiver of any clause, condition or requirement of this License Agreement shall not constitute a waiver of any future obligation to comply with that same clause, condition or requirement. If any provision of this License Agreement is held to be invalid or unenforceable for any reason, such provision shall be amended to the extent necessary to become enforceable in order to obtain the intent of the parties up to the maximum allowable limit, and the remainder of this License Agreement shall continue in full force and effect. If, however, it is determined that such a clause can not be changed, then that clause shall be deemed excluded from these License Agreements and shall not affect the validity or enforceability of the other clauses. The provisions of Section 3 and Sections 8 to 15 shall survive any termination of this License Agreement. In the event of a conflict between this license agreement, Ninetales Studios' terms of use and privacy policy conflict with the terms of use or the privacy policy of STEAM, the virtual store where the TLP will be disposed of, the rules that will prevail will be the STEAM Store Terms of Use and Privacy Policy. And it is of supreme importance that the player notifies Ninetales Studios in case of conflict to avoid any confusion between the players, Ninetales Studios and VALVE, responsible for the STEAM Store.

BY CLICKING THE "I ACCEPT" BUTTON BELOW OR BY USING THE GAME OR INSTALLING THE GAME, YOU AGREE THAT THIS LICENSE AGREEMENT IS VALID AS ANY WRITTEN CONTRACT SIGNED BY YOU. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS LICENSE AGREEMENT, CLICK THE BUTTON THAT YOU DO NOT AGREE TO ACCEPT THE TERMS OF THIS LICENSE AGREEMENT AND THE SOFTWARE INSTALLATION WILL NOT BE COMPLETED. BY AGREEING TO THIS LICENSE AGREEMENT, YOU DECLARE THAT YOU HAVE AGE EQUAL OR HIGHER AGE OF THE INDICATIVE RECOMMENDATION OF THE GAME AND YOU SHALL COMMIT TO OBSERVE AND FOLLOW ALL THE RULES PRESENT IN THIS AGREEMENT.
1 - LIMITED USE LICENSE
The Player is subject to the limited terms of use under this agreement that allow the consumer who purchased the game to play the game, play streams or videos, participate in the game community, participate in the game development community and shall have no exclusivity other than those described in this agreement. D) Make use of, or cause any other person or entity to make use of, the Game for any commercial purpose, including, but not limited to, (i) participating in the game in exchange for payment (eg " about the game"); or (ii) sale of Virtual Goods and Game Assets out of Game, or sale of game products, unless such operations are authorized by Ninetales Studios and conducted directly through Ninetales Studios;
E) Use any unauthorized third party programs that interact with the Software in any way, including, but not limited to, mods, hacks, cheats, scripts, bots, trainers, or automation or any third party programs that intercept, emulate or redirect any communication between the Game and Ninetales Studios or that collect information about the Game by reading areas of memory used by the Game to store information about the Game.
Failure to comply with these terms may be penalized by removal of the game from the player's library and also punishable through legal proceedings.
2 - REQUIREMENTS
By installing the game the player acknowledges that he has read, understood and agreed to the terms of the game and the terms of this license agreement, in addition to agreeing, understands that to play the game it is necessary to be bought or won as a gift, or activated by the Keys and the Keys not sold by third parties without authorization from Ninetales Studios. 4 - MORAL CODE AND CONDUCT

The player is also not allowed to transmit content that violates or infringes on the rights of third parties, including, without limitation, patent, trademark, trade secret, copyright, publicity, personal rights or other property rights or not;
E) To transmit or communicate any content that, in Ninetales Studios' sole and exclusive discretion, is considered offensive, including, but not limited to, illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or racial, ethnic or otherwise objectionable;
F) Transmit or facilitate the transmission of any content containing viruses, corrupted data, Trojan, bot keystroke logger, keylogger, worm, time bomb, logic bomb, cancelbot or other computer programming that is intended to damage, to interfere in a harmful way, to intercept or to mince surreptitiously, to scratch or to expropriate any system, data or personal information;
G) Sending spam in chats, comments in the Steam community or on any social network or softwares / applications / socialization programs through chats, messages, calls, calls, for personal or commercial purposes, interrupting the flow of the conversation with repeated posts of a similar nature;
H) Participate in any action that, in Ninetales Studios sole and exclusive judgment, "exploits" an undocumented aspect of the Game to ensure an unfair or unfair advantage over other users;
I) Participate in any action that, in the sole and exclusive judgment of Ninetales Studios, misleads any other user of the Game, including, but not limited to, the use of scams or fraudulent schemes or social engineering;

5 - UPDATES AND MODIFICATIONS
A) Game: Ninetales Studios can provide Updates to the game, which must be installed so that you can continue to play the Game. Each time you start the Software to play the Game, you hereby give your consent to Ninetales Studios to remotely install all Updates to the Software that is installed on your computer, regardless of whether you are sending a notification to you .
B) License Agreement: Ninetales Studios reserves the right, in its sole and exclusive discretion, to review, update, alter, modify, add, supplement or exclude certain terms of this License Agreement as the Game and the law evolve; provided that any material changes made in this License Agreement are not retroactively applied. Such changes will be effective upon their acceptance. If any future changes to this License Agreement are unacceptable to you or cause you to no longer comply with or comply with this License Agreement, or if at any time you no longer agree to any part of the current version of this License Agreement, Ninetales Studios reserves the right to terminate this License Agreement in accordance with our right to terminate under this clause. 6 - TERMINATION OF THE LICENSE AGREEMENT
This License Agreement is valid until terminated. You may terminate this License Agreement at any time and for any reason by notifying Ninetales Studios of your intention to terminate. Ninetales Studios may terminate this License Agreement at any time for any reason. Termination by Ninetales Studios shall take effect either by sending you a notice, or by terminating or deleting the game from the player's game library, or by Ninetales Studios's decision not to offer the Game or Game support . In the event of termination, either on your own initiative or at the discretion of Ninetales Studios, the license granted to the player will terminate immediately, and you must immediately and permanently remove the Software from the permanent memory of your computer and destroy any copies of the Software that may be in possession.

7 - CLOSURE OF THE GAME SERVICE

8 - EXPORT CONTROLS
The Software is subject to all applicable export restrictions. You must comply with all export and import laws, restrictions and regulations related to the Software and your use of any Brazilian agency or authority, from the United States or abroad. The Software shall not be re-exported, downloaded or exported, or downloaded or installed, by a citizen or resident of any country for which the game has been restricted and censored. The player represents and warrants that it is not located in, under the control of, or is a citizen or resident of, such country that prohibits this game or is part of the list of banned users of Ninetales Studios present in Clause 9.
9 - LIST OF BANNED USERS
Ninetales Studios reserves the right to refuse the sale to users who break the code of conduct and commit serious crimes of any nature, not limited to cyber crimes that bring problems or terror to the good players, thus, the character of the company , create a list of banned users containing specific data such as name, document records, qualifications, passports and even bank accounts and credit cards, in order to protect the other users and players community of any product or brand of Ninetales Studios in order to keep its users protected from real criminals. Thus, Ninetales Studios can "terminate" any contract without reimbursement to the banned user.
10 - DISCLAIMER OF WARRANTIES
THE GAME (INCLUDING, WITHOUT LIMITATION, THE SOFTWARE AND DOCUMENTATION) IS PROVIDED TO YOU FROM AN "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Ninetales STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WHICH MAY BE APPLIED TO OR PLAY THE SOFTWARE, INCLUDING BUT NOT LIMITED TO PROPERTY OF IMPLIED WARRANTIES OR POSSESSION, NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTIES THAT MAY ARISE FROM THE HANDLING, PERFORMANCE OR COMMERCIAL USE, AND ANY WARRANTIES AS TO THE ACCURACY, RELIABILITY OR QUALITY OF ANY CONTENT OR INFORMATION CONTAINED WITHIN THE GAME AND / OR SOFTWARE. The Ninetales STUDIOS DOES NOT WARRANT THAT THE GAME AND / OR THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL PLAYER GAME SELECTION RESPONSIBILITY AND / OR SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM THE GAME AND SOFTWARE.
TO AVOID QUESTIONS, NINETALES STUDIOS DOES NOT DISCLAIM GUARANTEES RELATED TO THE INTENTIONAL BREACH OF YOUR DUTY. DISCLAIMER OF WARRANTY DOES NOT AFFECT THE LIMITATION OF LIABILITY AS SET OUT BELOW.
As some states or jurisdictions do not allow the disclaimer of implied warranties, this exemption, in whole or in part, may not apply to all players.
11 - INDEMNIFICATION
THE PLAYER AGREES TO INDEMNIFY, DEFEND AND INDEMNIFY NINETALES STUDIOS AGAINST ANY AND ALL CLAIMS, COURTS, DAMAGES, LOSSES, LIABILITIES AND EXPENSES (INCLUDING ADVOCATE FEES) THAT DIRECTLY OR INDIRECTLY ARE ATTRIBUTELY TO, OR ARISING OUT OF, OR ARISING OUT OF THEIR USE OR BAD USE OF THE GAME OR ANY BREACH BY THE PLAYER OF ANY PROVISION OF THIS LICENSE AGREEMENT. Ninetales Studios reserves the right, at its own expense and in its sole and exclusive discretion, to assume, exclusively, the defense and control of any matter subject to indemnification by the player, provided that in this case the player will cooperate with Ninetales Studios in the evaluation and determination of the available defenses.
12 - LIMITATION OF LIABILITY
IN NO EVENT SHALL AND UNDER NO LEGAL THEORY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, NINETALES STUDIOS BE LIABLE TO THE PLAYER OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. PUNITIVE DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS DAMAGES, LOSS OF DATA, LOSS OF gOODWILL, OR LOST PROFITS), OR ANY DAMAGES FOR NEGLIGENCE OF ANY gROSS KIND (INCLUDING, WITHOUT LIMITATION, THE sTOPPAGE FOR DAMAGES WORK COMPUTER FAILURE OR IMPROPER OPERATION, OR ANY OTHER DAMAGES OR COMMERCIAL LOSS) ARISING OUT OF YOUR USE OR IMPROPER USE OF THE SOFTWARE, EVEN IF STUDIOS Ninetales BE AWARE OR SHOULD BE THE POSSIBILITY OF SUCH DAMAGES AWARE. IN ADDITION, NINETALES STUDIOS SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE TO PLAYER CHARACTERS, VIRTUAL GOODS (FOR ANY WEAPONS, ARMS, ARMOR, SKINS, ETC.) OR VIRTUAL CURRENCY, ACCOUNTS, STATISTICS, OR USER CLASSIFICATIONS , RANKINGS, OR PROFILE INFORMATION STORED BY THE GAME. NINETALES STUDIOS SHALL NOT BE LIABLE FOR ANY INTERRUPTION OF SERVICE, INCLUDING WITHOUT LIMITATION, INTERNET ACCESS PROVIDER INTERRUPTION, SOFTWARE OR HARDWARE FAILURE, OR ANY OTHER EVENT THAT MAY RESULT IN LOSS OF DATA OR SERVICE INTERRUPTION. IN NO EVENT SHALL NINETALES STUDIOS BE LIABLE FOR ANY DAMAGES OF ANY AMOUNT THAT YOU HAVE PAYABLE TO NINETALES STUDIOS FOR PRODUCTS RELATED TO THE GAME, IF APPLICABLE, FOR THE SIX (6) MONTHS IMMEDIATELY UP TO THE TIME YOU REASON FOR ACTION.
Notwithstanding the above limitations of liability, NOTHING IN THIS LICENSE AGREEMENT SHALL LIMIT THE LIABILITY OF NINETALES STUDIOS (i) for damages resulting from injury to life, body or health due to negligent breach of its duties, or due to intentional infringement or negligent breach of your duties by a legal representative or person designated to perform an obligation of Ninetales Studios, or (ii) for other damages resulting from a gross negligent breach by Ninetales Studios of your duties, or intentional or negligent breach of your duties by a legal representative or designee to perform an obligation of Ninetales Studios; (iii) for intentional misconduct; (iv) damages resulting from negligent breach of an obligation that is essential to the performance of the License Agreement by Ninetales Studios to the extent that it is typical and predictable; (v) any guarantee given by Ninetales Studios to the player; and (vi) for any liability under applicable product liability law.
Insofar as some states or jurisdictions do not allow the exclusion or limitation of liability in such states or jurisdictions, Ninetales Studios' liability shall be limited to the maximum extent permitted by applicable law.
13 - FAIR COMPENSATIONS
You acknowledge and agree that Ninetales Studios would suffer irreparable damage if this License Agreement were not applicable and enforceable or subject to specific enforcement. Consequently, in addition to financial indemnities, among other remedies that may be obtained by law, you agree that Ninetales Studios will have the right to specific enforcement or any other precautionary measure, without bail, or any other security or proof of damages, such as compensation for any breach or threat of breach of this License Agreement. In addition, in the event of any legal or administrative action or proceeding to be brought by either party in connection with this License Agreement and in accordance with clause 14 below, the party prevailing in such proceedings or lawsuit shall have the right to recover from the other party all costs, legal fees and other expenses incurred by the prevailing party as a result of the action or proceeding.
14 - NEGOTIATIONS
A) Negotiations. Disputes can be expensive and time-consuming for both parties. In an effort to expedite resolution and reduce the cost of any dispute or claim under this License Agreement ("Claim"), you and Ninetales Studios agree to attempt to informally negotiate any claim for at least thirty (30) days ( except those Claims expressly excluded in Section 15B below). Ninetales Studios will send a notice to the address you have on file or email, provided the player has provided additional contact information to Ninetales Studios (for example, by participating in a promotion or search, or by contacting a service representative to the client). The player must send his notification to Ninetales Studios through the email address: ninetalesdeveloper@gmail.com with the subject and text body of the email duly filled in, "No subject" emails will not be taken into account. Please note that this informal resolution procedure is voluntary for the player and is intended to resolve Claims more quickly and cheaply for both you and Ninetales Studios. This procedure also does not suspend any legal limitation period on the filing of a Claim, nor does it limit any rights that the player or Ninetales Studios have to seek legal action.
B) Exceptions to the Negotiations. To the extent permitted by applicable law, the player and Ninetales Studios agree that the following Claims are not subject to the above negotiation provisions: (i) any Claims they seek to impose or protect or relate to the validity of any rights of their intellectual property or of Ninetales Studios; (ii) any Claim relating to, or arising out of, charges of theft, piracy, invasion of privacy or unauthorized use; and (iii) any request for fair compensation.
C) Applicable Law and Jurisdiction. Except as otherwise provided in this Agreement, this Agreement shall be governed by and construed in accordance with the laws of the country to which the player is located, without regard to any conflict of law applicable. The parties hereby elect the central forum of the country or state to the exclusion of all others, regardless of their ability to resolve any disputes, disputes or claims arising out of or in connection with this Agreement.
15 - GENERAL PROVISIONS
This License Agreement represents the entire Agreement between you and Ninetales Studios with respect to the subject matter and supersedes any prior or current Contracts between you and Ninetales Studios, provided that this License Agreement coexists with, and does not replace, the Terms of Use or Privacy Policy. To the extent that the provisions of this License Agreement conflict with the Terms of Use, the conflicting provisions of the Terms of Use shall prevail. The Game is operated by Ninetales Studios in BRAZIL. Those who choose to access the Site Game outside of Brazil do so on their own initiative and are responsible for compliance with applicable local laws. Ninetales Studios' failure to enforce or enforce any provision of this License Agreement shall in no way be construed as a present or future waiver of such a clause, nor in any way affect the right of either party to enforce any provision thereafter . Ninetales Studios' express waiver of any clause, condition or requirement of this License Agreement shall not constitute a waiver of any future obligation to comply with that same clause, condition or requirement. If any provision of this License Agreement is held to be invalid or unenforceable for any reason, such provision shall be amended to the extent necessary to become enforceable in order to obtain the intent of the parties up to the maximum allowable limit, and the remainder of this License Agreement shall continue in full force and effect. If, however, it is determined that such a clause can not be changed, then that clause shall be deemed excluded from these License Agreements and shall not affect the validity or enforceability of the other clauses. The provisions of Section 3 and Sections 8 to 15 shall survive any termination of this License Agreement. In the event of a conflict between this license agreement, Ninetales Studios' terms of use and privacy policy conflict with the terms of use or the privacy policy of STEAM, the virtual store where the TLP will be disposed of, the rules that will prevail will be the STEAM Store Terms of Use and Privacy Policy. And it is of supreme importance that the player notifies Ninetales Studios in case of conflict to avoid any confusion between the players, Ninetales Studios and VALVE, responsible for the STEAM Store.
YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS END USER LICENSE AGREEMENT AND AGREE THAT BY CLICKING TO "ACCEPT" AND / OR INSTALL THE SOFTWARE AND PLAY THE GAME, YOU WILL AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT OF LICENSE.
