END-USER LICENSE AGREEMENT FOR THE SOFTWARE
"ALL HAZE EVE"
General
"The Author" is referring to the individual named xrrawva who created this Work. "This Work" or "the Software" refers to the binary executable all_haze_eve and its resource files. "You" refers to anyone who obtained a license directly from the Author or one of his official distributors. Anyone who did not license the Software is not allowed to store, copy or use it.
The Author only agrees to make this Work of software available to You, subject to the following terms and conditions. The terms and conditions apply to the maximum extent permitted by applicable law.
1. License
The Author hereby grants to You a limited, revocable, non-exclusive and non-transferable right to use the Software for Your personal, non-commercial purposes. You may only execute and operate one instance of the Software simultaneously on one device that you own or control and as far as permitted by the computer's owner. You may copy the Software for Your personal archival purposes, provided any copy contains all of the original proprietary notices. You are not allowed to share/redistribute the Software.
2. Further Restrictions
You may not: copy, modify, translate, reverse engineer, decompile, disassemble or create derivative works based on the Software in any form, except as specified above. You may not sublicense, rent or transfer rights regarding the Software to third parties. You may not remove any proprietary notices or labels from the Software.
3. No Other Rights Transferred
The Author claims title of the Software and all rights and benefits afforded under intellectual property rights. The Software is not sold to you, it is licensed and no title or ownership in the Software is being assigned or transferred. This Work may ship with some required third party libraries. 4. Disclaimer of Warranty
You accept the Software on an "AS IS" basis. Any warranty of any kind, express, implied or otherwise, including without limitation, any warranty of merchantability or fitness for a particular purpose are disclaimed. In no event shall the Author be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, business interruption and on any theory of liability, arising out of or in connection with the use or performance of this Software. You acknowledge that the Software may contain errors or bugs. You must determine whether the Software sufficiently meets your requirements. Do not install this Software in a safety-related environment or on production servers and take care of backups before using it. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE AGREEMENT.
5. Indemnification; No Consequential Damages
In no event shall the Author be liable for any lost profits or other incidental or consequential damages relating to the subject matter of this agreement. You agree to indemnify, defend, and hold harmless the Author against all losses, expenses, claims, demands, suits, or other actions arising from Your use of the Software, except to the extent caused by the gross negligence or willful misconduct of the Author. You acknowledge and agree that in case infringement by third party claims takes place, You will be held responsible for legal issues arising from the infringement.
6. Health Warnings
Exposure to certain patterns on a computer screen may trigger epileptic seizures for individuals even if they have no history of such. Playing video games may affect different parts of the body. Consult your physician before playing video games such as this Work.
7. Miscellaneous
All places, objects, characters, events, etc. displayed in this Work are purely fictional. They are not related to real life or other intellectual properties and similarities are not intended.
8. Termination
This license agreement will terminate automatically if You fail to comply with any of the limitations it describes. On termination of this license agreement, You must uninstall and destroy all your copies of the Software. You will not receive a refund on license fees. The Author may, in his sole and absolute discretion, at any time and for any or no reason, suspend or terminate this license and the rights afforded to You hereunder with or without prior notice.
9. Export/Import Restrictions
You acknowledge that export or import of the Software for a country may be subject to compliance with various and differing laws, rules, and regulations that restrict the export of certain products and technical data. You have to make sure that the restrictions of Your country or the country within You are downloading or using the Software are not violated and that the usage is according to its ruling laws, international export control agreements and import restrictions on using certain types of software within this country.
10. Steam(R) Integration
This particular version of the Software is only distributed using Valve(R)'s Steam(R) platform which implies that You agree to their terms of use and privacy policy. You agree that the Software will automatically make use of Steam(R)'s networking and other features. For example it's achievement system.
