End-User License Agreement for Skyling Garden Defense
This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the mentioned author (Mighty Studios LLC) of this Software for the software product identified above, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (“SOFTWARE PRODUCT”).
By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bounded by the terms of this EULA.
If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE
Skyling Garden Defense is being sold for personal, non-commercial use as a digital download through the Steam Online Game Service ("STEAM"). You are NOT allowed copy, reverse engineer or distribute this SOFTWARE PRODUCT in any way. It may be used only within the rules and limitations of the STEAM game service and the STEAM user account which was used to purchase this SOFTWARE PRODUCT.
If, at any time, the SOFTWARE PRODUCT detects that it is being used outside of, or without online connectivity to, the STEAM service, it may cease operation until such connectivity is restored.
1. GRANT OF LICENSE. This EULA grants you the following rights: Installation and Use. You may install and use any number of copies of the SOFTWARE PRODUCT on any number of computers or devices as allowed by the STEAM service for the user account which purchased the SOFTWARE PRODUCT.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
Limitations on Reverse Engineering, Decompilation, Disassembly and change (add,delete or modify) the resources in the compiled the assembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not extract, modify or duplicate any artwork, written text, animations or audio from the SOFTWARE PRODUCT.
Broadcast and demonstration
You may use images, recordings, and live execution of the SOFTWARE PRODUCT in your own videos, broadcasts and websites for the purposes of reviewing, previewing, or demonstrating the SOFTWARE PRODUCT without restrictions. You may monetize such videos, broadcasts and websites containing imagery from the SOFTWARE PRODUCT at your discretion.
Update and Maintenance
Skyling Garden Defense upgrades made available through the STEAM service are FREE of charge through the STEAM service. There is no guarantee of ongoing support, maintenance or upgrades to the SOFTWARE PRODUCT. Support for SOFTWARE PRODUCT may end at any time at the sole discretion of Mighty Studios LLC.
Termination.
Without prejudice to any other rights, the Author of this Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
3. COPYRIGHT.
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, text, artwork, animation, audio, and design elements incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material. The licensed users can NOT use any portion of the SOFTWARE PRODUCT to create new works of any kind.
LIMITED WARRANTY
NO WARRANTIES.
The Author of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.
NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business or personal information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.
In no event shall the author of this Software be liable for any personal injury, property damage or emotional distress caused by the use of, or inability to use this product, even if the Author is aware of the possibility of such damages or risk. The author makes no apologies for the difficulty level and learning curve built into this Software. Play at your own risk.
