End User Licence Agreement (EULA)
Definitions:
'These terms' refers to the conditions outlined in this user license agreement.
'Game' refers to the PC game Fake Happy End, that was developed by Neok and completed in December 2016.
'You' refers to the end-user and licensee, who is considering whether to buy, download, use, or play this game, and is only one person.
'Developer' refers to the developer of this game, Neok, also known as Neo Kuriyo, who developed Fake Happy End in 2016 and released it on Steam in 2017.
'Third-party' refers to any person that has contributed to the game's resources and development.
'Resources' refers to the files contained within this game's folder, including (but is not limited to) graphic files, audio files, system files, and text (which includes the game's script, and code.)
'Region' refers to your country, province/state, and any other relevant territory local to you as recognized by the laws of your country.
'Device' refers to any electronic machines used to operate this game, or contain this game or its resources.
To 'adhere to these terms' means that you will within reasonable limits, not take any actions that break the rules stipulated by these terms.
1. This is a legal binding agreement between you and the developer. The purpose of this license agreement is to protect anyone associated with this game's development, including the developer, and third-party. Many of these terms are unlikely to be enforced, but are required to be stipulated for this protection. If you use this game or its resources to harm the developer or third-party in any way, these terms will be enforced.
2. If you buy, download, use, or play this game, you agree to adhere to these terms. If you don't agree to adhere to these terms, you may not buy, download, use, or play this game, and must uninstall it from your device and destroy all copies if you have downloaded it.
3. The developer and third-party are not responsible for any loss or damages resulting from buying, downloading, using, or playing this game. You accept all responsibility, and agree to release, indemnify, defend, and hold harmless the developer and any third-party elements from all liability or for claims arising from use of this game by you or anyone you allow to access the game.
4. You may not sell, rent out, trade this game, or otherwise make it available to anyone in exchange for material gain, such as (but not limited to) monetary currency, and material wealth. You may not use this game or this game's resources to obtain material gain, unless otherwise stated in this license.
5. You may broadcast video footage of this game and earn revenue from your broadcast, whether by streaming this game online, or recording footage of this game and making the footage available to the public. If the developer or any third-party elements whose resources you are using in your footage, requires you to stop your footage of this game from being publicly accessible, you must comply within a week. If there are reasonable extenuating circumstances preventing you from complying within a week, then that time limit will be extended to the duration of your extenuating circumstances, plus an additional week.
6. You may not distribute this game to anyone, unless in the process of distributing, you lose possession of that particular instance of the game. For example, if you were to give it to someone as a gift, then that is permissible under these terms.
7. You may not alter, or reuse the game or its resources for any illegal or immoral purpose. Many of the game's resources are provided by third-party elements. If you wish to use those resources, you may obtain them from the associated third-party if you agree to their terms and conditions. For this purpose, links to each contributing third-party are provided in the game's readme file.
8. If you use this game's resources for any purpose, you must adhere to both these terms, and any terms stipulated by third-party elements whose resources you plan to use. It is your responsibility to read those third-party terms and adhere to them. The developer is not responsible for your actions.
9. You may not decrypt the game's encryption. You may not disassemble or reverse engineer the game.
10. This license permits you to install the game on up to three devices and to operate only one instance of the game at a time. Ownership of the game, non-third-party resources, and the game's brand, trademark, and copyright are all retained by the developer. Third-party resources are retained by their respective creators.
11. The game is provided as is. The developer is not obligated to provide ongoing support or maintenance to the game. The developer is not obligated to respond to your feedback or questions. However, the developer intends to provide support and maintenance within reasonable limits, and make this game (and any future games of the developer's) an enjoyable experience for you, and your feedback may be used for that purpose. Unless otherwise agreed on by the developer and you, any feedback you provide is provided for free. The developer is not obligated to provide compensation for your feedback.
12. You agree not to submit any claims or disputes against third-party elements concerning the use of their resources in this game. Third-party elements have provided resources, but are not directly involved in the development of this game. Any claims or disputes must go to the developer.
13. In the event that you have a dispute or claim concerning this game, you agree to informally negotiate a settlement, or resolution of the claim or dispute by contacting the developer and providing all relevant information regarding the claim or dispute, and to wait at least one month for the developer's response, before resorting to any legal action.
14. In the event that you have a legal dispute or claim concerning this game, you agree not to take class action against the developer or third-party elements. Class action includes, but are not limited to: class action lawsuits, and class-wide arbitrations. The laws of Ontario, Canada apply to this license agreement, and you agree to submit exclusively to a court of Ontario's jurisdiction. You agree to resolve any disputes in a court of law operating in the Greater Toronto Area, Canada.
15. In the event that the developer obtains legal assistance to enforce these terms for your apparent breach of these terms, you agree to pay any legal fees incurred while enforcing these terms.
16. These terms do not override any legal (statutory) rights that you may have in your region.
17. If at any time, you breach these terms, or decide you do not agree to adhere to them, you must cease playing, or using this game, and uninstall it from your device, and destroy all copies.
