PLEASE READ THIS END USER GAMING SOFTWARE LICENSE AGREEMENT AND TERMS OF SERVICE ("LICENSE") CAREFULLY BEFORE CLICKING THE "ACCEPT" BUTTON OR DOWNLOADING OR USING OUR GAMING SOFTWARE HIGH NOON REVOLVER (HEREIN REFERRED TO AS “GAMING SOFTWARE") ACCOMPANYING THIS LICENSE.
BY CLICKING THE "ACCEPT" BUTTON OR DOWNLOADING OR USING THE SERVICES OF MIKE STUDIOS, LEGAZPI, ALBAY, PHILIPPINES 4500; MEANS YOU ARE ENTERING INTO AND AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE AND THE TERMS AND CONDITIONS OF MIKE STUDIOS AS WELL. IN ADDITION, MIKE STUDIOS MAY CHANGE THESE TERMS OF SERVICE AT ANY TIME AT THEIR SOLE DISCRETION.

Product License & Acceptance
This copy of the game (the “Gaming Software”) is intended solely for your personal non-commercial home entertainment use. Mike Studios and its Licensors retain all right, title and interest in this Gaming Software including all intellectual property rights embodied therein and derivatives thereof. You may not decompile, reverse engineer, or disassemble Gaming Software, except as permitted by law. The Gaming Software, including, without limitation, all code, data structures, images, sounds, text, screens, game play features/contents, derivative works and all other elements of this Gaming Software may not be copied, resold, rented, leased, distributed (electronically or otherwise), used on a pay-per-play, coin-op and other for-change basis, or for any commercial purpose. Any permission granted herein is provided on a temporary basis and can be withdrawn by Mike Studios at any time. All rights not expressly granted are reserved. By acquiring and retaining this Gaming Software and using our Services [Collectively referred to as “Services”], you assent to the terms and restrictions of this limited license. By installing, copying, or otherwise using Gaming Software or any updates, you agree to be bound by the terms of this Agreement and our privacy policy as well. If you do not agree to the terms of this Agreement or/and privacy policy, do not download, install or use Gaming Software.
Limitations
Mike Studios does not warrant that the User's use of the Services during the Game Play will be uninterrupted or error-free; or that the Services, and/or the information obtained by the User through Gaming Software will be correct.
Condition of Use
a) High Noon Revolver is a multi platform PC Game, officially available on the Steam & Humble store.
b) This Gaming Software is for personal use only and may be installed and used by only one PC. Its component parts may not be separated for use on more than one Device. All components accompanying the Gaming Software are copyrighted by Mike Studios and may not be taken apart, modified, used or published with other Gaming Software or means except with the GAMING SOFTWARE PRODUCT Gaming Software and may not be distributed or copied in any manner.
c) Your use of our gaming software has to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of YOUR COUNTRY, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Mike studios harmless from any claims resulting from the use of this High Noon Revolver, which may cause damage to any other party.
Grant of License
Mike Studios grants you a Creative Commons Attribution License to access and make personal use of this Gaming Software without express written consent of Mike Studios. This license includes any personal use of this site or its contents: any downloading or copying: or any use of data mining, robots, or similar data gathering and extraction tools etc.; Subject to where the credit has been given to its original Author (e.g. by including copyright notices, by citing Author’s name or title, By mentioning if the work is a derivative work or adaptation etc.). However, the License does not include any resale or commercial use. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Mike Studios and our associates without express written consent. Any unauthorized use terminates the permission or license granted by Mike Studios.
Acknowledgement of Ownership
You agree that the Service provided by us through our Gaming Software, including but not limited to graphics, audio clips, and editorial content, contains proprietary information and material that is owned by Mike Studios and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary information or materials in any way whatsoever except for use of the Service in compliance with the terms of this Agreement. No portion of this Gaming Software may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, and you shall not exploit this Gaming Software in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity.
Removal of Content or Other Materials
Notwithstanding any other provision of this Agreement, Mike Studios and its licensors reserve the right to change, suspend, remove, or disable access to any content(including any game play content), or other materials comprising a part our Gaming Software at any time without notice. In no event will Mike Studios be liable for the removal of or disabling of access to any such content or materials under this Agreement. Mike Studios may also impose limits on the use of or access to certain features or portions of this Gaming Software, in any case and without notice or liability.
Copyrights
a) All copyrights in and to the Service, including but not limited to, the compilation any game play content, links to other Internet resources, and descriptions of those resources), and Gaming Software, are owned by Mike Studios and/or its licensors. THE USE OF THE GAMING SOFTWARE OR ANY PART OF THE SERVICE, EXCEPT FOR USE OF THE SERVICE AS PERMITTED IN THESE TERMS OF SERVICE, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
b) Our Gaming Software uses an integrated web browser. It allows users to search for other players on the internet. Therefore, all other intellectual property of third parties not owned by Mike Studios or its subsidiaries that appear while using High Noon Revolver are the property of their respective owners and are protected by the Republic Act No. 8293, Digital Millennium Copyright Act as well as other international copyright laws, who may or may not be affiliated with, connected to, or sponsored by Mike Studios or its subsidiaries. You may not use any third-party intellectual property without their express authorization.
Confidentiality
You may not disclose to other persons the data or techniques relating to this GAMING SOFTWARE PRODUCT that you know or should know that it is a trade secret of the Mike Studios in any manner.
Disclaimer
This Gaming Software and its all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
In no event shall Mike Studios, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of this GAMING SOFTWARE PRODUCT.
Applicable Law
These terms of this agreement shall be governed by and construed in accordance with the laws of State of Albay, Philippines, and Courts of Philippines shall have the exclusive jurisdiction in respect of any actions or claims under these terms of use and you hereby consent and submit to the personal jurisdiction of such courts; provided that nothing herein shall prevent Gaming Software and enforcement of mandatory and applicable law.
Entire Agreement
This agreement represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them.
