Summary
Any copy of Ethereal Legends (“the Game”) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties in the United States and elsewhere, as well as laws and treaties related to other forms of intellectual property. Soverance Studios, ("Soverance", “me”, or “I”), along with their affiliates and/or suppliers owns all intellectual property rights in the Game. The Licensee’s (“you” or “your”) license to download, use, or copy the Game is subject to these rights, to all applicable laws, and to all the terms and conditions of this End User License Agreement (“Agreement”).
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY DOWNLOADING THE GAME OR BY INSTALLING, USING, COPYING, OR CHANGING THE GAME. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST NOT DOWNLOAD, INSTALL OR USE THE GAME.
What that means
You paid money (or someone paid for you) so that you can play the Game – I can't thank you enough! This purchase gives you a license to install, play, and use the Game on your personal computer. This permission is granted to you for your personal use only; you cannot sell or rent the Game (or any of it’s contents) and you cannot sell or rent license keys for the Game (or any of it’s contents).
Disclaimers and Limitation of Liability
Ethereal Legends includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Soverance, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Soverance or Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Soverance, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in Ethereal Legends, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve the Game, or will not revoke approval of the Game for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Soverance and Epic. Soverance, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
Updates and Maintenance
Soverance may release upgrades, updates, or patches (all called “version updates”) for the Game at some point in the future. Update notes will always published online in the Ethereal Version History. However, at no point will Soverance be required to make any updates to the Game. Soverance is also not obliged to provide ongoing support or maintenance of the Game.
LIABILITY AND GOVERNING LAW
To the maximum extent permitted by applicable law, neither Soverance, Epic, Epic’s licensors, nor its or their affiliates, nor any of Soverance's or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Soverance, Epic, Epic’s licensors, nor its or their affiliates, nor any of Soverance's or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this [Agreement] or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Soverance's, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if [Soverance, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Soverance, Epic, Epic’s licensors, its and their affiliates, and any of Soverance's or Epic’s service providers shall be limited to the full extent permitted by law
Sharing
With a few specific exceptions (detailed below) You may not incorporate, modify, or otherwise use the Ethereal Legends or Soverance logo (or any associated assets or images) in any content you may create. The exception to this is that you may use any of the assets provided in the Presskit area of the Game website in any video or press content you create (e.g., for streams or blogs). In these specific cases the assets must be used without color or aspect adjustments or embellishments of any kind. Some limited cropping is acceptable.
You are free to stream, screenshot, record, and upload to the internet gameplay recordings of the Game, provided you have correctly attributed the game as Ethereal Legends, and provided links to the Game's website at www.ethereallegends.com.
Some final legal stuff.
This EULA is effective as of January 1, 2017. Soverance Studios reserves the right to make changes to this EULA at any time, and your continued use of the Game constitutes acceptance of the EULA as it may exist at the time you play or otherwise use the Game. This Agreement represents the complete agreement between you and Soverance Studios concerning the Game, and replaces all prior agreements and understandings between you and Soverance Studios regarding your use of the Game. If a dispute involving your use of the Game arises, we agree to resolve it in an American court, in the U.S. state of Georgia.
