Karaski: What Goes Up End-User License Agreement ("EULA") is a legal agreement between you (the "User") and Unbound Creations LLC (the "Licensor") for the Licensor software product(s) identified above which may include associated software components, media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and Licensor and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE.
* Applications Software. You may install and use one copy of this package, or any prior version for the same operating system, on a single computer. The primary user of the computer on which the package is installed may make a second copy for his or her exclusive use as a backup.
* Application Content. You may not sell, license or otherwise distribute the application files contained within the Software on a stand-alone basis or as part of any collection, or as part of any product or service for resale except where such files are protected by the GNU or public domain.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
You agree not to:
* Commercially exploit the SOFTWARE PRODUCT;
* Distribute, lease, license, sell, rent or otherwise transfer or assign the SOFTWARE PRODUCT, or any copies of the SOFTWARE PRODUCT, without the express prior written consent of Licensor or as set forth in this EULA;
* Make a copy of the SOFTWARE PRODUCT or any part thereof (other than as set forth herein);
* Making a copy of this SOFTWARE PRODUCT available on a network for use or download by multiple users;
* Except as otherwise specifically provided by the SOFTWARE PRODUCT or this EULA, use or install the SOFTWARE PRODUCT (or permit others to do same) on a network, for on-line use, or on more than one computer or gaming unit at the same time;
* Copy the SOFTWARE PRODUCT onto a hard drive or other storage device in order to bypass the requirement to run the SOFTWARE PRODUCT from the included CD-ROM or DVD-ROM (this prohibition does not apply to copies in whole or in part that may be made by the SOFTWARE PRODUCT itself during installation in order to run more efficiently);
* use or copy the SOFTWARE PRODUCT at a computer gaming center or any other location-based site; provided, that Licensor may offer you a separate site license agreement to make the SOFTWARE PRODUCT available for commercial use;.
* Reverse engineer, decompile, disassemble, prepare derivative works based on or otherwise modify the SOFTWARE PRODUCT, in whole or in part;
* Remove or modify any proprietary notices, marks or labels contained on or within the SOFTWARE PRODUCT; and
* transport, export or re-export (directly or indirectly) into any country forbidden to receive such SOFTWARE PRODUCT by any U.S. export laws or accompanying regulations or otherwise violate such laws or regulations, that may be amended from time to time.
You must also comply with all applicable laws regarding use of the SOFTWARE PRODUCT.
3. TERMINATION
Without prejudice to any other rights, Licensor may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT in your possession.
4. COPYRIGHT
All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCT and any copies thereof are owned by Licensor or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Licensor.
5. NO WARRANTIES
Licensor expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. Licensor does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. Licensor makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. Licensor further expressly disclaims any warranty or representation to Authorized Users or to any third party.
6. LIMITATION OF LIABILITY
In no event shall Licensor be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorized Users' use of or inability to use the SOFTWARE PRODUCT, even if Licensor has been advised of the possibility of such damages. In no event will Licensor be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. Licensor shall have no liability with respect to the content of the SOFTWARE PRODUCT or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
7. INFORMATION COLLECTION & USAGE.
By installing and using this software, you consent to these information collection and usage terms, including (where applicable) transfer of data to Licensor and affiliated companies into a country outside of the European Union and the European Economic Area. If you connect to the Internet when using the Software, either through a gaming platform network, or any other method, Licensor may receive information from hardware manufacturers or gaming platform hosts and may automatically collect certain information from your computer or gaming unit. This information may include, but is not limited to, user IDs (such as gamer tags and screen names), game scores, game achievements, game performance, locations visited, buddylists, hardware MAC address, internet protocol address, and your usage of various game features. All information collected by Licensor is intended to be anonymous information that does not disclose your identity or constitute personal information, however, if you include personal information (such as your real name) in your user ID, then such personal information will automatically be transmitted to Licensor and used as described herein.
The information collected by Licensor may be posted by Licensor on publicly-accessible web sites, shared with hardware manufacturers, shared with platform hosts, shared with Licensor’s marketing partners or used by Licensor for any other lawful purpose. By using this Software you consent to the Licensor’s use of related data, including public display of your data such as identification of your user created content or displaying your scores, ranking, achievements and other gameplay data. If you do not want your information shared in this manner, then you should not use the Software.
