THE WITCHER ADVENTURE GAME - LEGAL RULES

Hello and thank you for your interest in The Witcher Adventure Game! These are the legal rules which we ask you to follow if you download, install or play it.

This is a legal agreement between CD Projekt Red and you regarding The Witcher Adventure Game.
We’ve included short, informal summaries of each of these Rules (though it’s the full version which is present after the summaries that is legally binding).


(2) WHAT YOU GET WITH THE GAME

You have the personal right to play The Witcher Adventure Game on your chosen device. This right can be stopped by us in some situations (more on that below).
We own The Witcher Adventure Game - we worked very hard on it, so please enjoy it but behave and do not cause trouble.


(3) WHAT YOU CAN'T DO WITH THE GAME

Opposite are some examples of things we ask you not to do regarding The Witcher Adventure Game (e.g. don’t cheat or use hacks).

We hope you enjoy The Witcher Adventure Game, but bill payer permission first!

(5) USING GOG GALAXY WITH THE GAME

You can register a GOG Galaxy account if you’d like to play The Witcher Adventure Game online multiplayer (it is not required for Steam users) – but that’s totally optional.

(6) USING THE GAME IN LET’S PLAY VIDEOS AND OTHER FAN WORKS

You can make Let’s Play and other fan works regarding The Witcher Adventure Game, but you’re responsible for them.

(7) WARRANTIES AND LIABILITY REGARDING THE GAME

We make legally binding promises (called 'warranties') about the Game, for example that we will take reasonable care regarding you being able to play it. We also explain a bit further how we are responsible legally for them.

(8) OTHER LEGAL STUFF

Sometimes we will patch or update The Witcher Adventure Game.
You click on a link or use software taking you outside of our little kingdom = we cannot look after you anymore.
It’s cool to send us feedback and suggestions about The Witcher Adventure Game - thank you! But we don’t *have* to use them and we won’t owe you anything regarding them.
If unforeseen events beyond your or our control occur (war, earthquake, gigantic flood, alien attack, Godzilla, etc.- ok the last two are jokes), then neither of us will be liable to the other for any obligations, which can't be performed.
If part of the Rules don’t work legally, the rest of it will still work!
These Rules and our Privacy Policy together are a contract between you and us. If anything is missing, contact us ASAP otherwise it will legally bind you.
This document is just about our legal relationship with you (no one else’s).
Sometimes we may have to comply with legal or law enforcement requests.
If you breach these Rules, you may lose access to The Witcher Adventure Game (temporarily or permanently).


(9) CHANGES TO THESE RULES

We can change these Rules but if we do we'll put the changed version online and normally it will take effect a reasonable time period afterwards.
If you have any problems with our changes, please contact us so we can talk to you.

(10) GOVERNING LAW AND JURISDICTION

Any legal questions/complaints/ claims regarding these Rules are under Polish law and jurisdiction for users all around the world with the exception of users resident in the USA, who are under California law and jurisdiction.

LEGALLY BINDING CONTRACT

(1) LEGAL STUFF ABOUT THESE RULES

These ‘Rules’ are a legally binding contract between CD Projekt Red (part of the CD Projekt group) and you regarding The Witcher Adventure Game. Also, our Privacy Policy protects any personal information gathered from users. These Rules also supplement any terms and conditions of any digital distribution platforms which you might use to download and play the game.

(2) WHAT YOU GET WITH THE GAME

We (meaning CD Projekt Red) give you the personal and non-transferable right (called a 'licence' legally) to download, install and play The Witcher Adventure Game on your PC, Mac, iOS or Android devices (depending on which version which you bought), as long as you follow these Rules.

At all times we continue to own all of The Witcher Adventure Game, all in-game content, any updates or additional content for them, manuals or other materials about them and the intellectual property rights in them, including all copyright, trademarks, patents and legal things like that (all of this together we call the ‘Game’).

(3) WHAT YOU CAN'T DO WITH THE GAME

Please act reasonably and don't do any of the following:
a. Copy, distribute, hack, reverse engineer, decompile, disassemble or modify the Game or any part of it
b. do anything with the Game for commercial use (e.g. for money)
c. create, distribute or use any cheats or exploits on the Game
d. do or say anything harmful or offensive regarding the Game
e. do anything we might consider inappropriate or illegal with the Game
f. copy, rent, lend, lease, sublicense, distribute, publicly display, create derivative works from or give your copy of the Game to someone else


(4) PURCHASES

Please make sure when buying the Game that you have any necessary bill payer permission to buy it. No refunds, returns or exchanges can be offered once digital purchases are made


(5) USING GOG GALAXY WITH THE GAME

GOG Galaxy is a series of services provided by our sister company, GOG Ltd – including online multiplayer technology. It’s totally optional, but if you do decide to register a GOG Galaxy account then you can play online cross-platform with other PC and Mac players of the Game (there is no GOG Galaxy registration needed for iOS or Android players). If you decide not to register a GOG Galaxy account, then you won’t be able to play online (on PC and Mac) but you can play offline against the AI or you can play on one computer with your friends (hot seat mode). (6) USING THE GAME IN LET’S PLAY VIDEOS AND OTHER FAN WORKS

We give you permission to create fan work (e.g. machinima, 'Let's Play' or other videos, artwork and fan mods) regarding the Game. Please remember that you’re responsible for your fan works (especially any content which you make or which involves third parties).


(7) WARRANTIES AND LIABILITY REGARDING THE GAME

We warrant that: (i) we have the right to enter these Rules and to grant you a licence to play the Game; and (ii) we will use reasonable endeavours to comply with applicable laws in performing our obligations to you under these Rules.
We work hard to make our games and services work on your system but we can’t always get that perfectly right. Therefore, we can’t accept liability or responsibility if the Game does not work fully or completely. Also, we are not responsible or liable for anything that happens to the Game which is outside of our reasonable control.


(8) OTHER LEGAL STUFF

Occasionally we may need to patch, update, or change the Game (for example to add or remove features or to resolve software bugs). We need these rights in order to keep our games and services running efficiently.
You might get links from us to third party websites, content or resources, or you may be able to use third party software in connection with the Game. Using them is up to you – we can't promise they'll work, what they'll be like or if they're free.
You’re welcome to give us feedback and suggestions to improve the Game on our forums (http://forums.cdprojektred.com/forums/101-The-Witcher-Adventure-Game). However, just so we’re clear, we don’t have to use or accept them and we won’t owe you anything (financially or otherwise) regarding them.
We will not be liable for any failure to perform any obligation under these Rules or to provide access to the Game if that failure is caused by the happening of any unforeseen event beyond our reasonable control including without limitation, Internet outages, communications outages, fire, flood, war or act of God.
If any part of these Rules is found not to be legally enforceable, this will not affect any other part of it.
These Rules and our Privacy Policy constitute the entire agreement between you and us regarding the Game and supersede any prior oral or written agreements. If you disagree with this, we encourage you contact us as soon as possible after you start using the Game at legal@cdprojektred.com since otherwise they will be binding on you after a reasonable time period (usually 30 days unless there are exceptional circumstances).
These Rules govern our relationship with you (and vice versa). They do not create any rights for anyone else.
Please be aware that we are subject to various laws and we may be required to comply with law enforcement or other legal requirements from time to time.
These Rules are here for a reason. As a result, if you break any of them, we reserve the right to suspend or take away your access to the Game or do anything else we think necessary.


(9) CHANGES TO THESE RULES

We may change these Rules if we think it is necessary, e.g. for legal reasons or to reflect changes in the Game. If so, we will make the changed document available online and make reasonable efforts to tell you about it.
Once we change these Rules, it will become legally binding on you a reasonable time period after we post it online (we think 30 days will normally be reasonable unless there are exceptional circumstances). During that period, you're welcome to contact us at legal@cdprojektred.com if you have questions about the changes.
If we don't hear from you before the end of that time period, the changes will automatically become binding on you. If you don't agree to those changes, then unfortunately we must ask you to cease using the Game. We're sorry we have to say that, but we hope you'll appreciate that for the Game to work properly we need to have everyone using it under the same rules instead of different people having different rules. That's why we encourage you to get in contact if you have queries or concerns.
Just so you know, we'll never just make a bunch of changes to these Rules, not tell you what they are and force you to agree to changes you don't understand before you can play the Game!


(10) GOVERNING LAW AND JURISDICTION

For users resident in the European Union and elsewhere in the world (but not the USA):
You and we agree that your use of the Game and these Rules, will be governed by and interpreted according to the laws of Poland and under the jurisdiction of the courts of Poland. In any legal claim under it, the side which wins will be entitled to its legal fees and expenses.
For users resident in the USA:
You and we agree that your use of the Game and these Rules will be deemed to be entered into in Los Angeles, California and governed by and interpreted according to the laws of the State of California, USA (and, if applicable, US Federal law). Any legal claim by you against CD Projekt Red will be made exclusively any state or federal court located in Los Angeles, California, which will have subject matter jurisdiction regarding the dispute between you and us and therefore we both consent to the exclusive jurisdiction of those courts. In any legal claim under these Rules, the side, which wins will be entitled to its legal fees and expenses.
