PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLATING OR USING THIS SOFTWARE YOU AGREE WITH ALL TERMS OF THIS AGREEMENT. THIS AGREEMENT HAS LEGAL FORCE. IF YOU DO NOT WISH TO ENTER INTO THIS AGREEMENT PLEASE PRESS 'CANCEL' BUTTON DURING THE INSTALLATION AND DO NOT USE THIS SOFTWARE.
THIS AGREEMENT GIVES YOU NON-EXCLUSIVE LICENCE TO USE THE SOFTWARE ON THE TERMS OF THIS AGREEMENT. YOU DO NOT HAVE ANY RIGHTS IN THE SOFTWARE. ALL RIGHTS IN THE SOFTWARE ARE OWNED BY ANDREW SHPAGIN.
1. DEFINITIONS
"Software" means this software as a result of computer programming in form of application computer program and its components including license serial number or registration code.
"Licensee" means you as a person which uses the Software under this Agreement.
1.1 If you press 'I agree' button during the installation you will enter into this Agreement in the capacity as a Trial-Demo version User as of the date that you press the button.
1.2 If you enter license serial number which Andrew Shpagin sends to you for the 3D-Coat Academic version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Academic version User as of the date that you press the button 'Continue'.
1.3 If you enter license serial number which Andrew Shpagin sends to you after the payment for the 3D-Coat Educational version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Educational version Purchaser as of the date that you press the button 'Continue'.
1.4 If you enter license serial number which Andrew Shpagin sends to you after the payment for the 3D-Coat Professional version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Professional version Purchaser as of the date that you press the button 'Continue'.
1.5 If you enter license serial number which Andrew Shpagin sends to you after the payment for the 3D-Coat Floating version and press 'Continue' button in the registration form during the registration you will enter into this Agreement in the capacity as a Floating version Purchaser as of the date that you press the button 'Continue'.
2. USE OF THE SOFTWARE
2.1 If you represent a company, a legal entity, a governmental institution or a body of local self government, you may install and use the Software only on one office computer - either on a desktop computer or on a portable (laptop) computer, as well as on one home computer. You may not use the Software on two computers simultaneously.
2.2 If you represent a university, college, school or other educational institution, you may install and use the Software only on one computer - either on a desktop computer or on a portable (laptop) computer.
2.3 If you are a private individual, you may install and use the Software maximum on three computers - on one office computer and on two your personal home computers, provided that you do not use the Software simultaneously on more than one computer. Nobody else can use the Software on your computers.
2.4 Sometimes the Software will connect to the Andrew Shpagin's web-based server to check simultaneous use of the software on a computer. No private information will be transferred, except for the serial number authentication. Andrew Shpagin's web-based server will prohibit the work of the Software in case several computers simultaneously use the Software with one serial number. In case of repeated simultaneous use of the same serial number on several computers the serial number and the normal work of the Software will be permanently blocked.
2.5 The same serial number authentication as in the Section 2.4 will be made between the computers connected into a local area network.
3. INTELLECTUAL PROPERTY OWNERSHIP
3.1 The Software are the intellectual property of Andrew Shpagin. The Software is protected by international copyright laws. The code of the Software are the valuable trade secrets of Andrew Shpagin.
3.2 Any Andrew Shpagin's shopmarks, logos, trade names, domain names and brands are the property of Andrew Shpagin.
3.3 The Software may come bundled with, or otherwise include or be distributed with, third party software licensed by a respective supplier and/or open source software provided under an open source license. Use of third party software is subject to the third-party license terms, or in the absence of third party terms, the terms of this Agreement. Copyright to third party software is held by the copyright holders indicated in the third-party software or license.
4 RESTRICTIONS
4.1 You may not attempt to extract the source code of the Software by disassemble or any other means.
4.2 You may not use Demo version, Academic version and Educational version of the Software in commercial purposes for your profit.
5. DISCLAIMER
ANDREW SHPAGIN PROVIDES THE SOFTWARE AS-IS WITH ALL DEFECTS AND FAULTS. ANDREW SHPAGIN DISCLAIMS ALL WARRANTIES TO ANY MATTER. ANDREW SHPAGIN IS NOT LIABLE TO YOU FOR ANY LOSS, DAMAGE OR DETRIMENT. THIS CLAUSE OF THE AGREEMENT IS VALID ANY TIME AND IT WILL APPLY EVEN IN THE BREACH OF THE AGREEMENT.
3.3 The Software may come bundled with, or otherwise include or be distributed with, third party software licensed by a respective supplier and/or open source software provided under an open source license. Use of third party software is subject to the third-party license terms, or in the absence of third party terms, the terms of this Agreement. 6. CONFORMITY TO THE LICENCE
Andrew Shpagin has authority to make request to you concerning observance of this agreement. You agree to provide Andrew Shpagin within 40 days with all documentation that confirms yours conformity to licences from Andrew Shpagin.
7. PERIOD OF VALIDITY
7.1 In the case of yours compliance with the licence the agreement is valid during the period of Software's use.
7.2 Andrew Shpagin may terminate the Agreement if you breach any terms of it. In this case you agree to destroy all copies of the Software on your computer and do not use it. Andrew Shpagin may not be hold liable for any such termination.

2. USE OF THE SOFTWARE
2.1 If you represent a company, a legal entity, a governmental institution or a body of local self government, you may install and use the Software only on one office computer - either on a desktop computer or on a portable (laptop) computer, as well as on one home computer. You may not use the Software on two computers simultaneously.
2.2 If you represent a university, college, school or other educational institution, you may install and use the Software only on one computer - either on a desktop computer or on a portable (laptop) computer.
2.3 If you are a private individual, you may install and use the Software maximum on three computers - on one office computer and on two your personal home computers, provided that you do not use the Software simultaneously on more than one computer. Nobody else can use the Software on your computers.
2.4 Sometimes the Software will connect to the Andrew Shpagin's web-based server to check simultaneous use of the software on a computer. No private information will be transferred, except for the serial number authentication. Andrew Shpagin's web-based server will prohibit the work of the Software in case several computers simultaneously use the Software with one serial number. In case of repeated simultaneous use of the same serial number on several computers the serial number and the normal work of the Software will be permanently blocked.
2.5 The same serial number authentication as in the Section 2.4 will be made between the computers connected into a local area network.
3. INTELLECTUAL PROPERTY OWNERSHIP
3.1 The Software are the intellectual property of Andrew Shpagin. The Software is protected by international copyright laws. The code of the Software are the valuable trade secrets of Andrew Shpagin.
3.2 Any Andrew Shpagin's shopmarks, logos, trade names, domain names and brands are the property of Andrew Shpagin.
3.3 The Software may come bundled with, or otherwise include or be distributed with, third party software licensed by a respective supplier and/or open source software provided under an open source license.
